The Servicemen’s Settlement and Land Sales Act, 1943.—Notice declaring Land taken for the Settlement of Discharged Servicemen

WHEREAS, pursuant to section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, notice was given of the intention of the Minister of Lands to take under Part II of the said Act the lands described in the Schedule hereto, and a copy of the said notice was published in the New Zealand Gazette No. 75 on the 24th day of October, 1946, at page 1635 :

And whereas objections were made by the occupiers, in the manner prescribed by the said Act, objecting to the taking of the said lands :

And whereas the Land Sales Committee to which the objections were referred made an order disallowing such objections and fixing the 31st day of May, 1948, as the date of vesting :

And whereas no appeal from the said Order was made within the time prescribed by the said Act :

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :

Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the lands described in the said Schedule are taken for the settlement of discharged servicemen, and hereby specifies the 31st day of May, 1948, as the date on which the said lands shall be deemed to be vested in His Majesty the King.

SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL that parcel of land situated in Block X, Awhitu Survey District, containing by admeasurement one hundred and twenty-seven (127) acres one (1) rood and thirty-six (36) perches, more or less, being part of Allotment 5, Kahawai Parish, and being the residue of the land described in Deeds Index, Vol. 7A, folio 61 (Auckland Registry).

And whereas an objection was made by the owner, in the manner prescribed by the said Act, objecting to the taking of the said lands :

And whereas the owner withdrew such objection and agreed to an amended vesting-date :

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :

Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the lands described in the said Schedule are taken for the settlement of discharged servicemen, and hereby specifies the 1st day of September, 1947, as the date on which the said lands shall be deemed to be vested in His Majesty the King.

SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL that parcel of land containing by admeasurement six hundred and eleven (611) acres two (2) roods, more or less, being Sections 5 and 7, Block XIII, Hukerenui Survey District, and being the whole of the land described in certificate of title, Vol. 114, folio 37 (Auckland Registry).

As witness my hand, this 25th day of July, 1947.

WHEREAS, pursuant to section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, notice was given of the intention of the Minister of Lands to take under Part II of the said Act the lands described in the First Schedule hereto, and a copy of the said notice was published in the New Zealand Gazette No. 46 of the 27th day of June, 1946, at page 914 :

And whereas an objection was made by the owner in the manner prescribed by the said Act objecting to the taking of the said lands and claiming the right to retain part of the said lands :

And whereas the Minister of Lands did not revoke his notice of intention to take the said lands :

And whereas the Minister of Lands did not agree to the retention by the owner of the area specified in the said objection :

And whereas the Minister of Lands did make to the owner an offer of an area to be retained :

And whereas the owner has accepted the offer of such retention area :

And whereas the owner has withdrawn his objection to the taking of the lands described in the Second Schedule hereto :

And whereas the owner has agreed to an amended vesting-date :

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :

Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the lands described in the said Second Schedule are taken for the settlement of discharged servicemen, and hereby specifies the 18th day of February, 1948, as the date on which the said lands shall be deemed to be vested in His Majesty the King.

FIRST SCHEDULE

GISBORNE LAND DISTRICT

ALL that parcel of land containing three thousand seven hundred and forty-four (3,744) acres and twelve (12) perches, more or less, being Hangaroa-Matawai 2c Block, Tauwharetoi 1A Block, Sections 25, 36, 73, 74, 75, 76, and 77, Hangaroa Village, Sections 2, 3, 4, 5, 6, 7, 10, 12, 13, 14, 15, 16, 17, 21, 22, 78, 79, and Part 8, Block VIII, Hangaroa Survey District, and being all the land comprised in certificate of title, Vol. 89, folio 9 (Gisborne Registry), subject as to part to section 248 of the Native Land Act, 1931.

Also all that parcel of land containing sixty-six (66) acres two (2) roods and two and two-tenths (2·2) perches, more or less, being Section 25, Block VIII, Hangaroa Survey District, and being all the land comprised in certificate of title, Vol. 91, folio 98 (Gisborne Registry).

SECOND SCHEDULE

GISBORNE LAND DISTRICT

ALL those parcels of land containing together one thousand three hundred and forty-eight (1,348) acres two (2) roods and thirty-eight (38) perches, more or less, being Lot 1 of Section 4 on Deposited Plan No. 1672, Lot 2 of Section 6 on Deposited Plan No. 1672, Sections 7 and 10, and part of Section 5, Block VIII, Hangaroa Survey District, and being part of the land comprised in certificate of title, Vol. 89, folio 9 (Gisborne Registry). As the same is more particularly delineated on a plan deposited in the Head Office, Department of Lands and Survey, at Wellington, under No. 2969, and thereon edged red.

The Servicemen’s Settlement and Land Sales Act, 1943.—Notice declaring Land taken for the Settlement of a Discharged Serviceman

———

WHEREAS an application has been made for the consent of the Land Sales Court to a transaction which relates to the land described in the Schedule hereto and to which Part III of the Servicemen’s Settlement and Land Sales Act, 1943, applies :

And whereas the Land Sales Committee to which the application has been referred is of opinion that the land to which the application relates is farm land suitable or adaptable for the settlement of a discharged serviceman :

And whereas the said committee, not being satisfied that the Crown had decided not to acquire or arrange for the acquisition of the land, did on the 1st day of July, 1947, make an order determining the basic value of the land and no appeal from the said order was made within the time prescribed by the said Act or within any further time allowed by the Court :

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :

Now, therefore, the Minister of Lands, acting in pursuance of section 51 of the said Act, doth hereby declare that the said land is taken for the settlement of a discharged serviceman, and hereby specifies the 15th day of August, 1947, as the date on which the said land shall be deemed to be vested in His Majesty the King.

SCHEDULE

SOUTHLAND LAND DISTRICT

ALL that parcel of land containing by admeasurement seventeen (17) acres three (3) roods thirty-four (34) poles, more or less, being Section 60, Block XXII, Invercargill Hundred, and being all the land comprised in certificate of title, Vol. 101, folio 280 (Southland Registry).

———

THE Minister of Lands, acting in pursuance of section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, hereby gives notice of his intention to take the lands described in the Schedule hereto under Part II of the said Act, and specifies the 1st day of June, 1948, as the date on which possession of the land is required, and the 1st day of September, 1947, as the date on or before which objections may be made under section 25 of the said Act.
