Land of the Crown notified available as Site for Commercial or Industrial Purposes

PURSUANT to the authority conferred upon me by the Land Act, 1924, and section forty of the Statutes Amendment Act, 1945, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the undermentioned land is available for disposal as a site for commercial or industrial purposes.

SCHEDULE

TARANAKI LAND DISTRICT

ALL that area situated in the Borough of New Plymouth, containing an area of 2 roods 39 perches, more or less, being Sections 853, 854, 855, and 856, Grey District (formerly incorrectly described as Sections 2360, 2361, 2362, and 2363, Borough of New Plymouth), and being originally part Native Reserve 1, Block IV, Paritutu Survey District. As the same is more particularly delineated on the plan marked L. and S. 6/3/208A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

As witness the hand of His Excellency the Governor-General, this 26th day of July, 1947.

Land permanently reserved in the Auckland Land District

WHEREAS by the three-hundred-and-fifty-ninth section of the Land Act, 1924, it is enacted that the Governor-General may from time to time set apart temporarily as reserves, notwithstanding that the same may be then held under pastoral licence, any Crown lands which in his opinion are required for any of the purposes in the said section mentioned:

And whereas by the three-hundred-and-sixtieth section of the said Act it is provided that land temporarily reserved under the said three-hundred-and-fifty-ninth section may, at the expiration of one month, but not later than six months, after the publication in the Gazette of notice of such temporary reservation, be permanently reserved, and that notice of such permanent reservation shall be published in the Gazette:

And whereas the land described in the Schedule hereto was by the Warrant dated the sixteenth day of May, one thousand nine hundred and forty-seven, and published in the Gazette of the twenty-second day of that month, temporarily reserved under the authority of the said Act for a public-school site (Ellicott's Block):

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby permanently reserve the land described in the Schedule hereto for a public-school site for which purpose the said land was so temporarily reserved as aforesaid.

Vesting the Control of Scenic Reserves in the Tuatapere Scenic Board

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908 (hereinafter referred to as the said Act), His Excellency the Governor-General of the Dominion of New Zealand doth hereby revoke a Warrant dated the twenty-third day of May, one thousand nine hundred and forty-four, and published in the Gazette of the twenty-fifth day of that month, vesting the control of scenic reserves in the Tuatapere Scenic Board, and doth hereby vest the control of the scenic reserves described in the Schedule hereto (being land reserved under the said Act) for the period of five years from the date hereof (unless previously altered or revoked under the said Act) in the undermentioned persons, namely,——

Eric Mitchell Elder,
Roderick William Campbell,
Sydney Henry Reece,
Patrick Joseph Dolan,
James Stewart King,
William Faulkner,
James Nunn Clark Ballantyne,
John Albert Bennett, and
Charles Stuart McIntyre,

who are hereby constituted for that purpose a special Board by the name of the Tuatapere Scenic Board (herein referred to as the Board), in trust, for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say:—

  1. The first meeting of the Board shall be held on Monday, the eighteenth day of August, one thousand nine hundred and forty-seven, at half past eight o'clock p.m., at the B.S.A. Rooms, Tuatapere, and thereafter the Board shall meet for the transaction of business on the last Monday in each quarter at the time and place aforesaid, or at such other time or place as may from time to time be fixed by the Board.

  2. The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  3. Special meetings may be convened by the Chairman, provided that two days' notice of such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  4. Any five members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  5. All questions shall be determined by the majority of votes of the members of the Board present at the meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman for such meeting.

  7. If, by resignation, death, incapacity, or otherwise the seat of any member shall be or become vacant, or if any member absents himself without reasonable cause from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

  8. The Board shall prepare and submit at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister in Charge of Scenery Preservation as soon as possible after each annual meeting.

  9. The Board shall control the said reserves in accordance with the provisions of the said Act and of the regulations made thereunder.
