The Southern Side of Portion of Hau Street, in the Borough of Motueka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government House at Wellington, this 9th day of July, 1947
Present:
His Excellency the Governor-General in Council
Pursuant to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the ninth day of May, one thousand nine hundred and forty-seven, viz. :
“ That the Waimea County Council, being the local authority having control of Hau Street in the Borough of Motueka, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of portion of Hau Street fronting part Sections 9 and 10 of 175, District of Motueka, and contained in the Certificate of Title 27/247 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Hau Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.
SCHEDULE
The southern side of all that portion of street situated in the Nelson Land District, Borough of Motueka, known as Hau Street, fronting part Sections 9 and 10 of 175, District of Motueka. As the same is more particularly delineated on the plan marked P.W.D. 124643, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Pursuant to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the St. Kilda Borough Council on the fifth day of May, one thousand nine hundred and forty-seven, in so far as it affects the side and portion of street described in the Schedule hereto, viz. :
“ That the St. Kilda Borough Council, being the local authority having control of the streets in the Borough of St. Kilda, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Eskvale Street fronting Lots 16, 17, 18, Block V, D.P. 68, Township of Musselburgh, being part of Section 67, Block VII, Town District ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Eskvale Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE
The south-western side of all that portion of street situated in the Otago Land District, Borough of St. Kilda, known as Eskvale Street, fronting Lots 16, 17, and 18, Block V, D.P. 68, Township of Musselburgh. As the same is more particularly delineated on the plan marked P.W.D. 125653, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Pursuant to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby consent to the assignment to Maurice John Moon, of Tutaki, Murchison, Farmer, by Herbert James Stewart, of Tutaki, Murchison, Farmer, of his rights, powers, and privileges under an Order in Council dated the twenty-seventh day of August, one thousand nine hundred and thirty-four, and published in the Gazette of the thirtieth day of the same month, at page 2765, authorizing the said Herbert James Stewart and Frank Pickford Watson, of Tutaki, Murchison, Farmer, to erect certain electric lines.

Pursuant to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby consent to the assignment to Linton Albert Wenzlick, of Kereta, Farmer, by Edward James Russek, of Kereta, Farmer, of his rights, powers, and privileges under the Order in Council dated the eleventh day of October, one thousand nine hundred and forty-four, and published in the Gazette on the twelfth day of the same month, at page 1216, authorizing the said Edward James Russek to use water for the purpose of generating electricity.

His Excellency the Governor-General in Council
Pursuant to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to Arthur Sheldon Hone, of Waverley, Farmer (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from an unnamed stream (hereinafter referred to as the said stream) situated in Section 205, Block I, Wairoa Survey District, in the Land District of Taranaki, for the purposes hereinafter set forth, a stream of water not exceeding twenty-one cubic feet per second at any one time.
CONDITIONS
- IMPLIED CONDITIONS
The conditions directed to be implied in all licenses by the Water-power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence except in so far as the same may be inconsistent with the provisions hereof.
- LICENCE SUBJECT TO REGULATIONS
This licence is issued under the Water-power Regulations 1934, and is subject thereto and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, and the Radio Interference Regulations 1934, and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.
- UTILIZATION OF WATER AND LOCATION OF HEADWORKS
Water shall be used under this licence solely for the purpose of generating electricity up to a maximum capacity of 1 kilowatt at 36 volts direct current, and shall be taken from the said stream at the point in Section 205, Block I, Wairoa Survey District, indicated on the plan marked P.W.D. 62970, deposited in the office of the Minister of Works at Wellington.
