Portion of Lane Street, in the Borough of Hastings, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government House at Wellington, this 2nd day of July, 1947

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Hastings Borough Council on the twentieth day of March, one thousand nine hundred and forty-seven, viz. :

“ That the Hastings Borough Council, being the local authority having control of the streets in the Borough of Hastings, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, do not apply to that portion of Lane Street fronting Lots 3 and 4, D.P. 7107, and Lot 13, D.P. 2557 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portion of Lane Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

ALL that portion of street situated in the Hawke's Bay Land District, Borough of Hastings, known as Lane Street, fronting Lots 3 and 4, D.P. 7107, and Lot 13, D.P. 2557, part Heretaunga Block. As the same is more particularly delineated on the plan marked P.W.D. 125508, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The North-western Side of Portion of Cuba Street, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the sixteenth day of October, one thousand nine hundred and forty-six, viz. :

“ The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the western side of Cuba Street fronting part Section 178, Town of Wellington, being the land comprised in Certificate of Title 41/45 ” ;

such portion of street being described in the Schedule hereto.

SCHEDULE

THE north-western side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Cuba Street, fronting the land contained in Certificate of Title, Volume 41, folio 45, being part Section 178, Town of Wellington. As the same is more particularly delineated on the plan marked P.W.D. 125203, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Southern Side of Portion of Alfred Street, in the Borough of Blenheim, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 2nd day of July, 1947

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Blenheim Borough Council on the eighteenth day of December, one thousand nine hundred and forty-six, viz. :

“ The Blenheim Borough Council, being the local authority having control of the streets in the Borough of Blenheim, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern portion of Alfred Street fronting subdivision of part of Allotment 39 (D.P. 361), being part of Section 1, Omaka, Borough of Blenheim, and contained in the Certificate of Title 21/20 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Alfred Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

THE southern side of all that portion of street situated in the Marlborough Land District, Borough of Blenheim, known as Alfred Street, fronting part Lot 39 of Section 1, District of Omaka, Borough of Blenheim. As the same is more particularly delineated on the plan marked P.W.D. 125401, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

At the Government House at Wellington, this 2nd day of July, 1947

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waitaki County Council on the eighteenth day of April, one thousand nine hundred and forty-seven, viz. :

“ The Waitaki County Council, being the local authority having control of the roads in the County of Waitaki, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern portion of the district road abutting on part Section 26, Block IV, Oamaru Survey District, Certificate of Title, Volume 241, folio 233 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of the unnamed road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

THE southern side of all that portion of unnamed road situated in the Otago Land District, County of Waitaki, fronting part Section 26, Block IV, Oamaru District. PURSUANT to section one hundred and sixty-seven of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vary an Order in Council made on the twenty-ninth day of February, one thousand nine hundred and thirty-two, and published in the Gazette on the third day of March, one thousand nine hundred and thirty-two, at page 424, and affecting Paeroa East 3B 1 and other blocks, by excluding therefrom the land described in the Schedule hereto.
