Authorizing the Laying-off of a Street off High Street, in the City of Lower Hutt, of a Width less than 66 ft., but not less than 50 ft., subject to a Condition as to the Building-line

At the Government House at Wellington, this 18th day of June, 1947

Present:

His Excellency The Governor-General in Council

Pursuant to the Municipal Corporations Act, 1933, and the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Lower Hutt City Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet, but not less than fifty feet, subject to the condition that no building or part of a building shall at any time be erected on Lots 5, 8, 9, 10, 11, and 15, and on the parts of Lots 4 and 14 of a subdivision of the land fronting the said street, as shown on the plan referred to in the Schedule hereto, within a distance of forty-eight feet from the centre-line of the said street.

SCHEDULE

That proposed street in the Wellington Land District, City of Lower Hutt, containing by admeasurement 1 rood 9.91 perches, more or less, being part Lot 3, D.P. 12911, part Section 38, Hutt District. As the same is more particularly delineated on the plan marked P.W.D. 120346, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Setting apart Native Land as a Native Reservation

At the Government House at Wellington, this 18th day of June, 1947

Pursuant to section five of the Native Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Native freehold land described in the Schedule hereto as a Native reservation for the common use of the Ngatimaru Tribe as a meeting-place and marae.

SCHEDULE

All that parcel of land containing 18 acres, known as Pukehou, being Section 4, Block III, Huira Survey District, and being all the land contained in Certificate of Title, Volume 17, folio 56 (Taranaki Registry).

Pursuant to section one hundred and sixty-seven of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vary the Order in Council made on the seventh day of May, one thousand nine hundred and thirty-seven, and published in the Gazette on the twentieth day of May, one thousand nine hundred and thirty-seven, at page 1162, and affecting Kinohaku West E 1B 2 and other blocks, by excluding therefrom the land described in the Schedule hereto.

Vesting Reclaimed Land in Bluff Harbour in the Bluff Harbour Board

Whereas it is provided by section twenty-three of the Harbours Amendment Act, 1933 (hereinafter called the said Act), that the Governor-General may from time to time, by Order in Council, vest in any local authority or Harbour Board any area of land not exceeding five acres in extent which has, pursuant to section one hundred and sixty-eight of the Harbours Act, 1923, been authorized to be reclaimed: And whereas the Bluff Harbour Board (hereinafter called the Board) was, by Order in Council dated the twenty-fifth day of September, one thousand nine hundred and thirty-three, and published in the Gazette on the twenty-eighth day of the same month, at page 2453, authorized to reclaim certain land from the sea in Bluff Harbour, as shown on the approved plan marked M.D. 7168 and deposited in the office of the Marine Department at Wellington: And whereas the said land as shown hatched red on the said plan M.D. 7168 has been reclaimed, and it is desirable that the said land should be vested in the Board: Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby vest in the Board all that land reclaimed from the sea in Bluff Harbour shown hatched red on plan marked M.D. 7168, such vesting in the Board to date from the first day of July, one thousand nine hundred and forty-seven.

Authorizing Sidney Hurst, of Pentland Hills, Farmer, to use Water for the Purpose of generating Electricity

His Excellency The Governor-General in Council

Pursuant to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to Sidney Hurst, of Pentland Hills, Farmer (hereinafter referred to as the licensee), a licence subject to the conditions hereinafter set forth to obstruct, impound, or divert the waters of the Waihaorunga Stream at a point in part Lot 19 on D.P. 1584, Block XIII, Waihao Survey District, in the Land District of Canterbury, and to take and use therefrom for the purposes hereinafter set forth a stream of water not exceeding one cubic foot per second at any one time.

CONDITIONS

  1. Implied Conditions

The conditions directed to be implied in all licences by the Water-power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.

  1. Licence Subject to Regulations

This licence is issued under the Water-power Regulations 1934, and is subject thereto and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, and the Radio Interference Regulations 1934, and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.
