FRASER PRESIDING IN COUNCILP URSUANT to section one hundred and twenty-eight of thePublic Works Act, 1928, His Excellency the Governor-Generalof the Dominion of New Zealand, acting by and with the adviceand consent of the Executive Council of the said Dominion, dothhereby approve of the following resolution passed by the Bay ofIslands County Council on the ninth day of October, one thousandnine hundred and forty-six, viz. :-“That this Council, being the local authority havingcontrol of the roads and streets hereinafter mentioned, herebyresolves that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to thewestern side of portion of Doel's Access Road fronting Allotment 26, Ruapekapeka Parish, Block XII, Kawakawa SurveyDistrict, Bay of Islands County”;subject to the condition that no building or part of a building shallat any time be erected on the land fronting the western side of theportion of Doel's Access Road (described in the Schedule hereto)within a distance of thirty-three feet from the centre-line of the saidportion of road.SCHEDULETHE western side of all that portion of road situated in the NorthAuckland Land District, Bay of Islands County, known as Doel'sAccess Road, fronting Allotment 26, Parish of Ruapekapeka. FRASER PRESIDING IN COUNCILP URSUANT to the Waikato-Maniapoto Maori Claims SettlementAct, 1946, His Excellency the Governor-General, acting byand with the advice and consent of the Executive Council, dothhereby make the following regulations.REGULATIONSPRELIMINARY1. THESE regulations may be cited as the Tainui Maori Trust BoardRegulations 1947.2. In these regulations, unless inconsistent with the context,-“Board” means the Tainui Maori Trust Board establishedby the said Act:“Member” means a member of the Board:“Chairman” means the Chairman of the Board:“The said Act” means the Waikato-Maniapoto MaoriClaims Settlement Act, 1946:“The Under-Secretary” means the Under-Secretary of theNative Department:“Tainui tribes” means the Tainui tribes as defined insection 2 of the said Act:“Tribal divisions” means the divisions of the Tainui tribbesdescribed in the First Schedule hereto.MEMBERS3. Of the members nominated to the Native Minister pursuantto section 5 of the said Act- (a) One shall represent the head of the Kahui Ariki for the timebeing recognized by the Tainui tribes: (b) Each of the remaining members shall represent one or moreof the tribal divisions, provided that no such tribaldivision shall be represented by more than one member.4. (1) The nomination of every candidate for appointment asa member shall be in writing signed by not less than two membersof the tribal division whom he proposes to represent, provided thatany candidate proposing to represent more than one tribal divisionshall be nominated in writing by at least two members of each ofsach divisions. (2) The consent of every candidate shall be enfaced on thenomination-paper or otherwise notified to the Board. (3) Nominations shall be lodged with the Secretary of theBoard not later than three months prior to the day on which theterm of office of the members for the time being shall expire. (4) A candidate may at any time upon notice to the Boardwithdraw his nomination.(5) A nomination-paper may be in the form set out in theSecond Schedule hereto.5. (1) If more than one candidate is nominated to representa tribal division, or two or more tribal divisions, the names of thecandidates shall be submitted to a public meeting of the tribaldivision or divisions for the purpose of selecting the candidate torepresent the tribal division or divisions on the Board. (2) In any case where a public meeting shall be necessary,for the purposes of this regulation such meeting shall be calledby the Secretary of the Board for a date not earlier than twomonths nor later than one month prior to the day on which theterm of office of the members for the time being shall expire.6. When the tribal divisions and the recognized head of theKahui Ariki shall have selected the candidates to represent themon the Board, the names of the candidates so selected shall beforwarded to the Under-Secretary, for the consideration of theNative Minister, not later than twenty-one days prior to the dayon which the term of office of the members for the time being shallexpire.MEETINGS7. If within half an hour after the time for which a meetingof the Board has been appointed, whether by summons or byadjournment from a previous meeting, a quorum is not present,the member or members present, or, if no member be present, anofficer of the Board may adjourn the meeting to such time and placeas is thought fit.8. All proceedings and resolutions of the Board shall berecorded in a minute-book to be kept for the purpose, and as soonas may be after the conclusion of each meeting a copy of the minutesshall be forwarded to the Under-Secretary for the information ofthe Native Minister.COMMITTEES9. If and whenever the Board, pursuant to section 10 of thesaid Act, decides to delegate any of its powers and duties to accommittee, the Board shall, in its resolution, specify the powersand duties so delegated.10. The Board shall not delegate to any such committee thepower to make any loan or grant in excess of £25 or to enter intoany contract involving, or otherwise to incur or to authorize,expenditure in excess of that amount in respect of any onetransaction or matter.11. The Chairman of any such committee may be appointedor removed by the Board, provided that such committee may atany meeting appoint one of its members to act in the absence ofthe Chairman from such meeting.12. (1) The members of any such committee may meet for thedespatch of business and adjourn their meetings as they think fit. (2) Every such committee shall fix a quorum which shall besubject to the approval of the Board, and no business shall betransacted at any meeting of a committee unless a quorum ispresent. (3) All questions coming before a committee at any meetingshall be decided by a majority of the votes of the members presentthereat and, in the case of an equality of votes, the Chairman shallhave a casting vote. (4) All proceedings and resolutions of any such committeeshall be recorded in a minute-book to be kept for the purpose,and as soon as practicable after the conclusion of every meetingof the committee a copy of the minutes shall be forwarded to theSecretary of the Board. (5) Every such committee shall cause books to be kept andtrue and regular accounts to be entered therein of all moneysreceived and expended by such committee and of the severalpurposes for which such moneys have been received and paid. (6) Such books of account, together with properly certifiedand receipted vouchers accounting for every payment made bysuch committee during each financial year, shall be made availablefor inspection at all reasonable times by any person duly authorizedin that behalf by the Board, and shall be transmitted to theSecretary of the Board in the month of April in every year.13. Every such committee shall be subject in all things to thecontrol of the Board and shall carry out all directions of the Boardgiven in relation to such committee or its affairs.ACCOUNTS14. All money received by the Board shall be acknowledgedon a printed form of receipt. A counterfoil or carbon duplicatecopy of each receipt shall be retained by the Board.15. Receipts shall be numbered consecutively, and the numberof each receipt shall be quoted in the cash-book and other booksof account kept by the Board.TRAVELLING ALLOWANCES AND EXPENSES16. (1) Members shall be paid for their attendance at allregular and special meetings of the Board, to which they shall havebeen duly summoned to attend, the sum of one pound (£1) for eachand every day of attendance at such meetings. (2) A member shall be entitled to a refund of the reasonableexpense of transport to and from the place of meeting by publicconveyance. If no such public conveyance is available, then thereasonable cost of other transport may be allowed. In cases wherethe cost would be less than by public conveyance a member maybe allowed at the rate of 6d. per mile of the distance measuredeach way by the shortest available route for the use of his ownhorse, motor-car, or other vehicle.17. With the prior written approval of the Native Minister amember may be paid or have refunded to him in respect of anybusiness or work authorized by the Board to be done or performedthe same allowances and expenses as he would be entitled to be paidor have refunded in accordance with the last preceding regulationfor his attendance at a meeting of the Board.
