The South-eastern Side of Portion of Campbell Street and the North-western Side of Portion of Brunner Street, in the City of Nelson, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 7th day of May, 1947

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Nelson City Council on the nineteenth day of December, one thousand nine hundred and forty-six, viz. :

“ That the Nelson City Council, being the local authority having control of the streets in the City of Nelson, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply—firstly, to the south-eastern side of the portion of Campbell Street adjoining Section 987, City of Nelson; and, secondly, to the north-western side of the portion of Brunner Street adjoining the said Section 987, being all the land comprised and described in Certificate of Title, Volume 49, folio 26 (Nelson Registry) ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Campbell Street or the north-western side of the portion of Brunner Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE

THE south-eastern side of all that portion of street situated in the Nelson Land District, City of Nelson, known as Campbell Street, fronting Section 987, City of Nelson.

Also the north-western side of all that portion of street situated in the said land district and city, known as Brunner Street, fronting Section 987, City of Nelson.

As the same are more particularly delineated on the plan marked P.W.D. 125012, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Main Highways Board on the twenty-first day of April, one thousand nine hundred and forty-seven, viz. :

“ The Main Highways Board, being the local authority having control of the Nelson-Westport Main Highway, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-western side of the portion of the said highway known as Queen Street fronting Part 9 of Section 26, District of Waimea East, being the land comprised and described in Certificate of Title, Volume 33, folio 279 (Nelson Land Registry) ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of the Nelson-Westport Main Highway (Queen Street) (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE south-western side of all that portion of the Nelson-Westport Main Highway, known as Queen Street, in the Nelson Land District, Borough of Richmond, fronting Part 9 of Section 26, District of Waimea East. As the same is more particularly delineated on the plan marked P.W.D. 124895, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Portions of an Unnamed Road, in the County of Cheviot, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 7th day of May, 1947

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Cheviot County Council on the thirteenth day of September, one thousand nine hundred and forty-six, viz. :

“ That the Cheviot County Council, being the local authority having control of the roads in the County of Cheviot, by resolution hereby declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western side and portion of the south-eastern side of the road passing through Section 20, Block IX, Cheviot Survey District (Cheviot Set), part Certificate of Title 309/54 (Canterbury Registry) ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the unnamed road or the south-eastern side of the portion of such unnamed road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portions of road.

SCHEDULE

THE north-western side of an unnamed road situated in the Canterbury Land District, County of Cheviot, fronting part Section 20, Block IX, Cheviot Survey District.

The south-eastern side of all that portion of the said road fronting part Section 20, Block IX, Cheviot Survey District.

As the same are more particularly delineated on the plan marked P.W.D. 124973, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Palmerston North City Council on the twenty-fourth day of March, one thousand nine hundred and forty-seven, viz. :

“ The Palmerston North City Council, being the local authority having control of the streets in the City of Palmerston North, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the northern and southern sides of a portion of unnamed street fronting a subdivision of part Section 179, Town of Palmerston North, being the balance of the land contained in Certificate of Title, Volume 143, folio 20 (Wellington Registry) ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the unnamed street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said street.

SCHEDULE

ALL that unnamed street, off Weston Avenue, situated in the Wellington Land District, City of Palmerston North, fronting part Section 179, Town of Palmerston North. As the same is more particularly delineated on the plan marked P.W.D. 125316, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
