the Provisions of Section 128 of the Public Works Act, 1928,
subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 7th day of
May, 1947
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
PURSUANT to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said Dominion,
doth hereby approve of the following resolution passed by the
Oamaru Borough Council on the eleventh day of December, one
thousand nine hundred and forty-six, viz. :
“ The Mayor, Councillors, and Burgesses of the Borough
of Oamaru, being the local authority having control of the
streets in the Borough of Oamaru, by resolution declares that
the provisions of section one hundred and twenty-eight of the
Public Works Act, 1928, shall not apply to the west side of
Clyde Street abutting Allotment 6, Plan No. 387, Township
of Newburgh, comprised in Certificate of Title, Volume 61,
folio 263, and to the east side of Tay Street abutting Allot-
ment 15, said plan, Township of Newburgh, comprised in
Certificate of Title, Volume 83, folio 157 ”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the western side of the
portion of Clyde Street or the eastern side of the portion of Tay
Street (described in the Schedule hereto) within a distance of thirty-
three feet from the centre-lines of the said portions of streets.
SCHEDULE
THE western side of all that portion of street situated in the Otago
Land District, Borough of Oamaru, known as Clyde Street, fronting
Lot 6, D.P. 387, Township of Newburgh.
Also the eastern side of all that portion of street situated in
the said land district and borough, known as Tay Street, fronting
Lot 15, D.P. 387, Township of Newburgh.
As the same are more particularly delineated on the plan
marked P.W.D. 125191, deposited in the office of the Minister of
Works at Wellington, and thereon coloured red.

exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-line

PURSUANT to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said Dominion,
doth hereby approve of the following resolution passed by the
Blenheim Borough Council on the twentieth day of February, one
thousand nine hundred and forty-seven, in so far as it affects the
sides and portions of streets described in the Schedule hereto, viz. :
“ The Blenheim Borough Council, being the local authority
having control of the roads in the Borough of Blenheim, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the southern portion of Alfred Street fronting the
northern portion of Part 246, Section 3, District of Omaka,
and the western portion of Beaver Road fronting the eastern
portion of Part 246 and Part 247, part Section 3, District of
Omaka, and contained in the Certificate of Title 33/209 ”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the southern side of
the portion of Alfred Street or the western side of the portion of
Beaver Road (described in the Schedule hereto) within a distance
of thirty-three feet from the centre-lines of the said portions of
streets.
SCHEDULE
THE southern side of all that portion of street situated in the
Marlborough Land District, Borough of Blenheim, known as Alfred
Street, fronting part Lot 246, Town of Blenheim, being part of
Section 3, District of Omaka.
Also the western side of all that portion of street in the said
land district and borough, known as Beaver Road, fronting part
Lots 246 and 247, Town of Blenheim, being part of Section 3,
District of Omaka.
As the same are more particularly delineated on the plan
marked P.W.D. 125235, deposited in the office of the Minister of
Works at Wellington, and thereon coloured red.

“ The New Plymouth Borough Council, being the local
authority having control of the streets in the Borough of New
Plymouth, by resolution declares that the provisions of section
one hundred and twenty-eight, subsection one, of the Public
Works Act, 1928, shall not apply to the southern side of the
portion of Vivian Street adjoining Sections 335, 336, 337, and
part Section 338, Town of New Plymouth, Certificates of Title,
Volume 81, folio 169, and Volume 138, folio 204 ”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the southern side of
the portion of Vivian Street (described in the Schedule hereto)
within a distance of thirty-three feet from the centre-line of the
said portion of street.
SCHEDULE
THE southern side of all that portion of street situated in the
Taranaki Land District, Borough of New Plymouth, known as
Vivian Street, fronting Sections 335, 336, 337, and part Section 338,
Town of New Plymouth. As the same is more particularly
delineated on the plan marked P.W.D. 125108, deposited in the
office of the Minister of Works at Wellington, and thereon coloured
red.

PURSUANT to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-General
of the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion, doth
hereby approve of the following resolution passed by the Waimea
County Council on the eleventh day of October, one thousand nine
hundred and forty-six, viz. :
“ The Waimea County Council, being the local authority
having control of the roads in the Waimea County, by resolution
declares that the provisions of section one hundred and twenty-
eight of the Public Works Act, 1928, shall not apply to the south-
eastern side of a public road fronting subdivision of Section 195,
Waimea East, Block II, Waimea Survey District, and con-
tained in Certificate of Title 59/135 ”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the south-eastern side
of the portion of the unnamed road (described in the Schedule hereto)
within a distance of thirty-three feet from the centre-line of the said
portion of road.
SCHEDULE
THE south-eastern side of all that portion of an unnamed road
situated in the Nelson Land District, County of Waimea, fronting
Section 195, District of Waimea East. As the same is more parti-
cularly delineated on the plan marked P.W.D. 124568, deposited
in the office of the Minister of Works at Wellington, and thereon
coloured red.
