The Northern Side of Portion of Downe Street, in the Borough of New Plymouth, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 7th day of May, 1947
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

Pursuant to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the sixteenth day of December, one thousand nine hundred and forty-six; viz. :—

"The New Plymouth Borough Council, being the local authority having control of the streets in the Borough of New Plymouth, by resolution declares that the provisions of section one hundred and twenty-eight, subsection one, of the Public Works Act, 1928, shall not apply to the northern side of the portion of Downe Street adjoining Sections 794 and 795, Town of New Plymouth, Certificate of Title, Volume 65, folio 228 (Taranaki Registry)";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Downe Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE northern side of all that portion of street situated in the Taranaki Land District, Borough of New Plymouth, known as Downe Street, fronting Sections 794 and 795, Town of New Plymouth. As the same is more particularly delineated on the plan marked P.W.D. 125178, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The North-eastern Side of Portion of Kerry Street, in the Borough of Alexandra, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

Pursuant to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Alexandra Borough Council on the second day of December, one thousand nine hundred and forty-six, viz. :—

"The Alexandra Borough Council, being the local authority having control of the streets in the Borough of Alexandra, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of the portion of Kerry Street adjoining part Section 4, Block XLIII, Town of Alexandra, such land being comprised and described in Certificate of Title, Register-book, Volume 314, folio 225";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Kerry Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE north-eastern side of all that portion of street situated in the Otago Land District, Borough of Alexandra, known as Kerry Street, fronting part Section 4, Block XLIII, Town of Alexandra. As the same is more particularly delineated on the plan marked P.W.D. 124710, deposited in the office of the Minister of Works at Wellington, and thereon edged red.

Pursuant to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Tahunanui Town Board on the eleventh day of February, one thousand nine hundred and forty-seven, viz. :—

"The Tahunanui Town Board, being the local authority having control of the roads in the Town District of Tahunanui, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of portion of Parker’s Road adjoining subdivision of parts Section 1, Suburban South, Block IV, Waimea Survey District (Certificates of Title 60/125, 60/120)";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Parker’s Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE north-eastern side of all that portion of street situated in the Nelson Land District, Town District of Tahunanui, known as Parker’s Road, fronting part Section 1, District of Suburban South. As the same is more particularly delineated on the plan marked P.W.D. 125081, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The North-western Side of Portion of an Unnamed Road, in the County of Eyre, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

Pursuant to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Eyre County Council on the ninth day of September, one thousand nine hundred and forty-six, viz. :—

"The Eyre County Council, being the local authority having control of the streets (or roads) in the County of Eyre, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-west side of the portion of the forty-foot road adjoining the land contained in Certificate of Title 432/151, and being Lot 2 of D.P. 684 in R.S. 809, Block III, Christchurch Survey District";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of unnamed road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE

THE north-western side of all that portion of unnamed road situated in the Canterbury Land District, County of Eyre, fronting part Lot 2, D.P. 684, part of Rural Sections 809 and 2385. As the same is more particularly delineated on the plan marked P.W.D. 124273, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
