Consenting to the Raising of the Balance (£8,000) of the Kaiapoi Borough Council's Loan of £20,000 and prescribing the Conditions thereof

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
WHEREAS by Order in Council made on the twenty-first day of June, one thousand nine hundred and forty-four, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Kaiapoi Borough Council (hereinafter called the said local authority) of a loan of twenty thousand pounds (£20,000), to be known as “ Housing Loan (No. 4), 1944 ” (hereinafter called the said loan):
And whereas the authority conferred by the said Order in Council has not yet been exercised to the extent of eight thousand pounds (£8,000):
And whereas the authority has lapsed in accordance with the provisions of clause six of the said Order in Council, and it is not now lawful or competent for the said local authority to raise the balance of the said loan or any portion thereof, except in accordance with the provisions of a further Order in Council that may be issued pursuant to section eleven of the Local Government Loans Board Act, 1926 (hereinafter called the said Act):
And whereas the said local authority is now desirous of raising the balance of the said loan amounting to eight thousand pounds (£8,000) (hereinafter called the said sum), and it is expedient to authorize the said local authority to raise the said sum or portion thereof on the conditions hereinafter set out:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said sum up to the amount of eight thousand pounds (£8,000) for the purpose for which the said loan was authorized, and in giving such consent doth hereby determine as follows:—
(1) The term for which the said sum or any part thereof may be borrowed shall not exceed twenty (20) years.
(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender a rate exceeding three pounds (£3) per centum per annum.
(3) The said sum or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the term as determined in (1) above.
(4) The payment of such instalments shall be made in New Zealand, and no such instalments shall be paid out of loan-moneys.
(5) No amount shall be payable for brokerage, underwriting, and procurement fees in respect of the borrowing of the said sum or any part thereof.
(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the assignment to William Alexander Russ, of Kohuratahi, Motor Engineer, and William Alfred Lambert Wilson, of Stratford, Motor Mechanic, as tenants in common in equal shares, by William James Dippie, of Whangamomona, Motor Engineer, of his rights, powers, and privileges under an Order in Council dated the eighth day of November, one thousand nine hundred and thirty-nine, and published in the Gazette on the sixteenth day of the same month, at page 3070, authorizing the said William James Dippie to erect certain electric lines in the Township of Whangamomona.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for public offices.

PURSUANT to section forty-one of the Statutes Amendment Act, 1945, and of all other powers him enabling, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the disposition to and the acquisition by the New Zealand Loan and Mercantile Agency Company, Limited, a company duly incorporated in London and having its head office for New Zealand in Wellington, of a half interest in the land described in the Schedule hereto, notwithstanding the provisions of Part XIII of the Land Act, 1924.

PURSUANT to the Municipal Corporations Act, 1933, and the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the New Plymouth Borough Council to permit the laying-off of the proposed street (described in the Schedule hereto) of a width less than sixty-six feet but not less than fifty feet, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said street (as shown on the plan referred to in the Schedule hereto) within a distance of forty-eight feet from the centre-line of the said street.
SCHEDULE
THAT proposed street off List Street, in the Taranaki Land District, Borough of New Plymouth, containing by admeasurement 23·83 perches, more or less, being part Lot 5, D.P. 4443, being part Section 49, Fitzroy District. As the same is more particularly delineated on the plan marked P.W.D. 124998, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
