Regulations for the New Zealand Military Forces 1927, Amendment No. 57

IN pursuance and exercise of the powers and authority conferred on me by the Defence Act, 1909, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby amend, in the manner and to the extent set forth in the Schedule hereto, the Regulations for the New Zealand Military Forces published in the New Zealand Gazette dated the 25th day of May, 1927.
SCHEDULE

  1. THESE regulations may be cited as the Regulations for the New Zealand Military Forces 1927, Amendment No. 57.
  2. These regulations shall be read together with and form part of the Regulations for the New Zealand Military Forces 1927 (hereinafter called the principal regulations).
  3. These regulations shall come into force on the day following notification in the Gazette of the making hereof.
  4. Paragraph 123 is hereby revoked, and the following substituted :—
    “123. Promotion will, except in special cases, be governed by length of service and by selection within establishment, but no officer, except as provided in paragraphs 125 and 128, will be eligible for promotion until he has passed the prescribed examination.”
  5. Paragraph 129 is hereby revoked, and the following substituted :—
    “129. The promotion of officers in the N.Z. Permanent Forces up to and including the rank of Major will be governed by length of service, and above the rank of Major will be made by selection to complete establishment, subject to the following conditions :—
    “(i) Lieutenants will be promoted to the rank of Captain after six years’ commissioned service :
    “(ii) Captains will be promoted to the rank of Major after seven years’ service in the rank of Captain :
    “(iii) In making selections for promotion within establishment above the rank of Major, the chief considerations will be professional qualifications, efficiency, and character ; and only when these are approximately equal in the cases of two or more candidates will consideration be given to length of service :
    “(iv) No officer will be considered eligible for promotion until he has passed the necessary qualifying examination for the higher rank as laid down from time to time :
    “(v) Officers will be required to be recommended and to be reported upon as in all respects efficient and qualified for promotion, and to be passed as medically fit for service in the field :
    “(vi) Officers suffering from disabilities as a result of active service in the field may be promoted notwithstanding such disabilities, providing they are in other respects eligible.
  6. Paragraph 130 of the principal regulations is hereby revoked, and the following substituted :—
    “130. Officers of the N.Z. Permanent Force may be granted brevet rank in specially selected cases as a reward for outstanding service or where recognition in this respect is warranted.
    “130A. Brevet rank is army rank as distinct from corps or regimental rank, and shall not confer any advantages as regards pay.”
  7. Paragraph 164 of the principal regulations (as amended by Amendments Nos. 15, 18, and 54) is hereby revoked, and the following substituted :—
    “164. Except as provided in paragraphs 167 and 169, an officer of the N.Z. Military Forces will be retired on attaining the ages set out below :—

    “An officer holding temporary or brevet rank will, for retirement purposes, be regarded as holding the same substantive rank.”
  8. Paragraphs 165 and 166 of the principal regulations are hereby revoked.
  9. Paragraph 209, as amended by Amendments Nos. 3 and 40, and paragraph 209A of the principal regulations are revoked, and the following substituted :—
    “209. On completion of the original period of enlistment, warrant officers, non-commissioned officers, and men may, if recommended by their officer commanding unit or corps, be permitted to re-engage for permanent service up to the age of forty-five years ; provided that no private soldier will be permitted to re-engage unless he has qualified for promotion.”
  10. Paragraph 252 of the principal regulations is hereby revoked, and the following substituted :—
    “252. Warrant officers, non-commissioned officers, and men of the Permanent Forces shall be discharged on attaining the age of forty-five years.”

    HIS Excellency the Governor-General has been pleased to approve of the following appointments, promotions, and retirements of officers of the New Zealand Military Forces :—
    N.Z. STAFF CORPS
    The undermentioned Staff Cadets, on graduation from the Royal Military College of Australia, to be Lieutenants :—
    Desmond Stuart Smith.
    John Hearsey McMillan Salmon.
    Valentine Brinsley Brown.
    Brian Matauru Poananga.
    Dated 10th December, 1946.
    REGIMENT OF ROYAL N.Z. ARTILLERY
    Major C. E. Weir, C.B., C.B.E., D.S.O., to be temp. Brigadier. Dated 7th September, 1946.
    Major (temp. Brigadier) C. E. Weir, C.B., C.B.E., D.S.O., to be Lieutenant-Colonel, and retains the temporary rank of Brigadier. Dated 1st December, 1946.
    Major (temp. Lieutenant-Colonel) R. C. Queree, C.B.E., D.S.O., to be Lieutenant-Colonel, with seniority from 31st July, 1941. Dated 13th December, 1946.
    Major (temp. Lieutenant-Colonel) L. W. Thornton, O.B.E., to be Lieutenant-Colonel. Dated 13th December, 1946.
    Major (temp. Lieutenant-Colonel) C. S. J. Duff, D.S.O., to be Lieutenant-Colonel, with seniority next below Lieutenant-Colonel L. W. Thornton, O.B.E. Dated 13th December, 1946.
    N.Z. TEMPORARY STAFF
    Temp. Lieutenant-Colonel H. P. Conyers-Brown is posted to the Retired List with the rank of Lieutenant-Colonel. Dated 6th January, 1947.
    Temp. Lieutenant A. S. Blackie is posted to the Retired List with the rank of Lieutenant. Dated 13th January, 1947.
    Temp. 2nd Lieutenant J. H. Stubbs to be temp. Lieutenant. Dated 10th August, 1946.
    TERRITORIAL FORCE
    N.Z. INFANTRY
    The Canterbury Regiment
    Edward Branen Curtis to be 2nd Lieutenant (on prob.), and is seconded to the Cathedral Grammar School Cadets, Area 10. Dated 1st January, 1947.

    2nd Lieutenant M. W. Sandlant to be temp. Lieutenant. Dated 5th December, 1946.
