The South-western Side of Portion of Walter Street, in the Borough of Takapuna, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 12th day of March, 1947
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Takapuna Borough Council on the fifteenth day of October, one thousand nine hundred and forty-six, viz.:
“ The body corporate called the Mayor, Councillors, and Burgesses of the Borough of Takapuna, being the local authority having control of the streets in the Borough of Takapuna, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-western side of the portion of Walter Street adjoining Lots 118 and 119 of part Allotment 26 of Section 1 of the Parish of Takapuna, comprised in Certificate of Title, Volume 754, folio 144 (Auckland Registry) ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Walter Street (described in the Schedule hereto) within a distance of forty-eight feet from the centre-line of the said portion of street.

SCHEDULE
THE south-western side of all that portion of street situated in the North Auckland Land District, Borough of Takapuna, known as Walter Street, fronting Lots 118 and 119 of Allotment 26 of Section 1, Parish of Takapuna. As the same is more particularly delineated on the plan marked P.W.D. 124704, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Setting apart Native Land as a Native Reservation

At the Government Buildings at Wellington, this 11th day of February, 1947
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
PURSUANT to section five of the Native Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Native freehold land described in the Schedule hereto as a Native reservation for the common use of the descendants of Kaka Porowini, deceased, and the members of the sub-tribes of Whangarei, Mangakahia, Tautoro, Taiamai, Te Ahuahu, Taumarere, Waikare, Whangaruru, and Taiharuru, as a meeting-place and marae.

ALL that area of land in the North Auckland Land District, in the Borough of Whangarei, being Lots 15, 16, 17, and 18 on Deposited Plan 13841, together containing an area of 2 roods 4·9 perches, being parts of Allotment 1, Parish of Whangarei, and being the whole of the land comprised and described in Certificate of Title, Volume 329, folio 111, and Volume 318, folio 227 (Auckland Registry).

The Institute of Horticulture Examinations Order 1947

PURSUANT to the Royal New Zealand Institute of Horticulture Act, 1927, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following Order.

O R D E R
-
This Order may be cited as the Institute of Horticulture Examinations Order 1947.
-
This Order shall come into force on the day following notification in the Gazette of the making thereof.
-
For the purposes of this Order the “ said Act ” means the Royal New Zealand Institute of Horticulture Act, 1927.

Approval of the scheme of examination for the granting of certificates and diplomas in horticulture set forth in the Schedule to the Order in Council made under the said Act on the 10th day of March, 1928, and published in the Gazette on the 15th day of the same month at page 701, is revoked :
Provided that such revocation shall not affect the validity of any act, certificate, or diploma properly done or granted while the said approval was in force.
- The scheme of training and examination for the granting of certificates and diplomas under the said Act set forth in the Schedule hereto and submitted by the Royal New Zealand Institute of Horticulture for approval pursuant to section 4 of the said Act, as modified by section 60 of the Statutes Amendment Act, 1946, is hereby approved for the purposes of the said Act.

SCHEDULE
SCHEME OF TRAINING AND EXAMINATION OF CANDIDATES FOR THE CERTIFICATES AND DIPLOMA IN HORTICULTURE OF THE ROYAL NEW ZEALAND INSTITUTE OF HORTICULTURE (INC.)
- Preliminary
(1) THIS scheme of training and examination is issued under the authority of the Royal New Zealand Institute of Horticulture Act, 1927, as amended by the Statutes Amendment Act, 1946.
(2) In this scheme, unless inconsistent with the context, —
“ Act ” means the Royal New Zealand Institute of Horticulture Act, 1927 :
“ Garden ” means any botanic, institutional, municipal, nursery, or private garden in which the prescribed course of training and instruction in practical horticulture appropriate to the certificate or diploma sought may be undergone by the candidate :
“ Junior certificate ” means the Junior Certificate in Horticulture granted by the Institute :
“ Intermediate certificate ” means the Intermediate Certificate in Horticulture granted by the Institute :
“ Diploma ” means the National Diploma in Horticulture (N.D.H. (N.Z.) ) granted by the Institute :
“ Examining Board ” means a committee set up by the Institute for the purpose of controlling all matters relative to examinations under the Act :
“ Institute ” means the Royal New Zealand Institute of Horticulture (Inc.).
- Award of Certificates and Diploma
The Examining Board, acting for and on behalf of the Institute, may issue a junior certificate to a candidate who has passed the Junior Examination, an intermediate certificate to a candidate who has passed the Intermediate Examination, and a diploma to a candidate who has passed the Diploma Examination : Provided that in each case the candidate satisfies all the conditions prescribed by the Board for the appropriate examination.
- General Requirements
The examinations are open to candidates of either sex.
Before being eligible to qualify for the Institute’s certificates or diploma, a candidate must in general comply with the following conditions :—
(1) He must register his name with the Institute : Provided that no registration shall be effective before the first day of January nearest the candidate’s sixteenth birthday :
(2) He must furnish evidence, on registration, that he has secured the Primary School Certificate or its equivalent ; or he must satisfy the Examining Board that he is competent to proceed with the examinations of the Institute :
(3) He must satisfy the Examining Board that he has been engaged in horticulture, including a substantial amount of practical work, for the period prescribed for the examination concerned (hereinafter referred to as practical experience) :
(4) He must submit for the approval of the Examining Board on such occasions as it may require an account, in the form of a diary, of the work in which he has been engaged, and of such other matters of horticultural interest as have engaged his attention. If his diary is not considered satisfactory, the period of practical experience required may be extended for such further term as the Examining Board may determine.
- Equivalent Status
The Examining Board may in its discretion accept, for the purposes of the award of a certificate or a diploma, proof of the passing of an equivalent examination held by some competent public authority, and the Examining Board may also accept a pass in one or more subjects of an examination conducted by some competent public authority as equivalent to a pass in one or more similar subjects of the Institute’s examinations. Further, any of the conditions of the examination may be waived if the Examining Board is satisfied that substantially equivalent conditions have been complied with by the candidate.
- Conduct of Examination
(1) The examinations for the Institute’s certificates and diploma shall be held in the month of November, at such centres as may be recognized from year to year as suitable and necessary.
