Varying the Determinations in respect of Portion (£8,688) of the Coromandel County Council's Loan of £9,000 by extending the Term within which the said Loan may be borrowed

At the Government Buildings at Wellington, this 12th day of March, 1947

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS by Order in Council made on the second day of May, one thousand nine hundred and forty-five (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Coromandel County Council (hereinafter called the said local authority) of a loan of nine thousand pounds (£9,000), to be known as “Main Highways Loan, 1945” (hereinafter called the said loan):

And whereas the authority conferred by the said Order in Council has not been exercised to the extent of eight thousand six hundred and eighty-eight pounds (hereinafter called the said sum), and it is expedient to extend the term, as specified in clause four of the said Order in Council, within which the said sum or any portion thereof may be raised:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing that no moneys shall be borrowed under the consent given by the said Order in Council after the expiration of four (4) years from the date thereof.

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 12th day of March, 1947

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS by Order in Council made on the twenty-first day of March, one thousand nine hundred and forty-five (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Maniototo County Council (hereinafter called the said local authority) of the sum of six thousand seven hundred and fifty pounds (£6,750), to be known as “Housing Loan, 1945” (hereinafter called the said loan):

And whereas by Order in Council made on the twenty-third day of January, one thousand nine hundred and forty-seven, the determinations were varied in respect of a portion of the said loan amounting to nine hundred and seventy-five pounds (£975):

And whereas no portion of the said loan has yet been raised, and it is expedient to vary the determinations in respect of the balance of the said loan amounting to five thousand seven hundred and seventy-five pounds (£5,775) (hereinafter called the said sum), and also to extend the period within which the said loan may be raised:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations of the said Order in Council by prescribing as follows:—

(1) In lieu of a rate of interest not exceeding three pounds ten shillings (£3 10s.) per centum per annum, as specified in clause two of the said Order in Council, the rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds five shillings (£3 5s.) per centum per annum.

(2) In lieu of repayment by annual instalments of principal, as specified in clause three of the said Order in Council, the said sum or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the term as determined in clause one of the said Order in Council.

(3) In lieu of a period of two (2) years within which the said loan shall be raised, as specified in clause six of the said Order in Council, no moneys shall be borrowed under the consent contained in the said Order in Council after the expiration of three (3) years from the date thereof.

IN pursuance and exercise of the powers conferred by the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke an Order in Council dated the twenty-fifth day of August, one thousand nine hundred and forty-three, and published in the Gazette of the twenty-sixth day of that month, appointing a Domain Board to control the Rapahoe Domain, and doth hereby appoint

Edward Noble (jun.),
Hawtrey Francis Wordsworth Elwood,
William Fraser Forbes,
Leonard Edward Noble,
James Craig,
Richard Leech,
Vivian Sweeney,
Ephraim John Quy, and
Ronald Ramage Wafer

to be the Rapahoe Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Monday, the fourteenth day of April, one thousand nine hundred and forty-seven, at eight o’clock p.m., as the time when, and the Rapahoe Hall, as the place where, the first meeting of the Board shall be held.

SCHEDULE

WESTLAND LAND DISTRICT.—RAPAHOE DOMAIN

ALL that area containing 4 acres 0 roods 11·9 perches, more or less, being Reserve 629, Block IX, Town of Rapahoe. As the same is more particularly delineated on plan marked L. and S. 1/976, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

IN pursuance and exercise of the powers conferred by section forty-eight of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

The Raglan County Council

to be the Tainui Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Monday, the twenty-fourth day of March, one thousand nine hundred and forty-seven, at half past ten o’clock a.m., as the time when, and the Council Chambers, Ngaruawahia, as the place where, the first meeting of the Board shall be held.
