Land reserved under the Scenery Preservation Act, 1908

A PROCLAMATION

WHEREAS the Scenery Preservation Board, constituted pursuant to the Scenery Preservation Act, 1908 (hereinafter referred to as the said Act), has recommended that the land described in the Schedule hereto should be permanently reserved for scenic purposes, and it is expedient to give effect to such recommendation:

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the said Act, do hereby proclaim and declare that the land described in the Schedule hereto shall be a scenic reserve under the said Act, and subject to the provisions thereof.

WESTLAND LAND DISTRICT

RESERVE 1879 (formerly Section 3570), Block I, Otira Survey District: Area, 12 acres and 1 rood, more or less.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 4th day of December, 1946.

Authorizing the Bay of Islands Electric-power Board to construct, maintain, and use further Electric Lines, and amending a License authorizing such Board to construct, maintain, and use certain Electric Lines

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to the Public Works Act, 1928, and the Electric-power Boards Act, 1925, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Bay of Islands Electric-power Board (hereinafter with its successors and assigns referred to as the licensee), subject to the conditions set forth in the First Schedule hereto, to lay, construct, put up, place, and use electric lines within the area described in the Second Schedule hereto; and, further, for the purposes of section seventy-six of the Electric-power Boards Act, 1925, subject to the said conditions, doth hereby authorize the Board to construct and maintain the said electrical works; and, further, doth hereby amend the Order in Council dated the eighth day of March, one thousand nine hundred and thirty-nine, and published in the Gazette of the ninth day of the same month at page 352, authorizing the licensee to construct, maintain, and use certain electric lines by deleting clause two of the Schedule thereto and substituting the clause set forth in the Third Schedule hereto.

FIRST SCHEDULE

1. IMPLIED CONDITIONS

THE conditions directed to be implied in all licenses by the Electrical Supply Regulations 1935 shall be incorporated herein and form part of this license, except in so far as the same may be inconsistent with the provisions hereof.

2. LICENSE SUBJECT TO REGULATIONS

The license hereby conferred is subject to compliance by the licensee with the Electrical Wiring Regulations 1935, the Electrical Supply Regulations 1935, the Radio Interference Regulations 1934, and with all regulations made or to be made in amplification or amendment thereof or in substitution therefor.

3. SYSTEM OF SUPPLY

Bulk supply at a nominal pressure of 11,000 volts between phases shall be received from the State Hydro-electric Department's substations located near Kaikohe and Kaitaia respectively, or from such other additional point or points of supply as may be mutually arranged between the Minister in Charge of the State Hydro-electric Department and the Board.

The system of supply shall be as described in paragraphs (a), (c), (d), (e), and (f) of clause 21–01 of the Electrical Supply Regulations 1935. The primary-distribution voltage shall be 11,000 volts between phases in the case of the three-phase system of supply and 11,000 volts between conductors in the case of the two-wire system of supply. The secondary-distribution voltage shall be 400 volts between phases and 230 volts between any phase and neutral in the case of the three-phase four-wire system of supply, and 460 volts between outer conductors and 230 volts between each outer conductor and the middle conductor in the case of the three-wire system of supply, and 230 volts between conductors in the case of the two-wire system of supply.

4. DURATION OF LICENSE

Unless sooner determined, this license shall continue in force until the 31st day of March, 1979.

5. CHARGES FOR ELECTRICAL ENERGY

The charges for electrical energy shall not exceed 1s. per unit for lighting purposes and 6d. per unit for all other purposes: Provided that “lighting purposes” shall include electrical energy used for such purposes directly or indirectly from the source of supply except where used to charge a secondary battery for standby emergency lighting only; and, provided further, that if accounts are paid within fourteen days of due date the charges shall not exceed 10d. per unit for lighting purposes and 4½d. per unit for such other purposes.

In the case of wholesale supply, the charge shall not exceed £16 per kilovolt-ampere of half-hourly maximum demand per annum, plus ½d. per unit. “Wholesale supply” for this purpose shall be held to be a supply in respect of which the consumer shall guarantee to pay not less than £180 per annum.

The licensee may in the case of any supply make such minimum charge as may be authorized by regulation.

6. TIME FOR COMPLETION OF WORKS

The period for completion of the works hereby authorized shall be three years from the date of this license.

SECOND SCHEDULE

LINES adapted for the supply of electrical energy by the system of supply hereinbefore described within the following areas:—

(a) The areas added to the Bay of Islands Electric-power District by Proclamation dated the 15th day of December, 1941, and published in the Gazette of the 18th day of the same month at page 3937, such areas comprising the whole of the counties of Whangaroa and Hokianga;

(b) The area added to the Bay of Islands Electric-power District by Proclamation dated the 5th April, 1945, and published in the Gazette of the 12th day of the same month at page 383, such area comprising portion of the Mangonui County;

the electric lines now proposed to be erected being shown on plan marked P.W.D. 122016, deposited in the office of the Minister of Works at Wellington.

THIRD SCHEDULE

SYSTEM OF SUPPLY

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and with the consent of the licensee, doth hereby revoke the Orders in Council dated the fourteenth day of December, one thousand nine hundred and thirty-four, and published in the New Zealand Gazette No. 94 of the twentieth day of the same month at page 4295, and dated the sixth day of October, one thousand nine hundred and thirty-eight, and published in the New Zealand Gazette No. 76 of the thirteenth day of the same month at page 2206, authorizing George Kellow, of Reefton, Linesman, to use water for the purpose of generating electricity.
