Constituting the Dipton Rabbit District.—(Notice No. Ag. 4360)

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 4th day of December, 1946

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS by section thirty of the Rabbit Nuisance Act, 1928, it is enacted that the Governor-General may, by Order in Council, on petition in that behalf signed by a majority of the persons qualified to be enrolled on the ratepayers’ list for any proposed district, constitute and declare any area of land of not less than one thousand acres a rabbit district under and for the purposes of Part II of the said Act :

And whereas, in pursuance of the provisions of the said section thirty of the said Act, a petition has been received praying that the area of land described in the Schedule hereto be constituted and declared a rabbit district under and for the purposes of Part II of the said Act :

And whereas the said petition is signed by a majority of the persons in the said area of land qualified to be enrolled on the ratepayers’ list for the said proposed district, and it is deemed expedient to give effect to the prayer of the petitioners accordingly :

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby constitute by the specific name of the “Dipton Rabbit District” and declare that area of land defined in the Schedule hereto to be a rabbit district under and for the purpose of Part II of the said Act ; and doth hereby further declare that the basis on which the Board to be established for the said district shall first levy its general rate shall be on the basis of the acreage of the rateable property in the said district.

SCHEDULE

BOUNDARIES OF THE DIPTON RABBIT DISTRICT

ALL that parcel of land delineated on the plan attached hereto in the Hokonui Survey District of Southland County, Southland Land District, containing by admeasurement 26,700 acres, more or less, and bounded as follows : Commencing at a point on the left bank of the Oreti River in line with the south-western side of a public road forming the south-western boundary of Section 221, Block VIII, Hokonui Survey District ; thence in a south-easterly direction across a river-bank road, to and across the Josephville to Lumsden Road ; thence in a north-easterly direction along the south-eastern side of the said Josephville to Lumsden Road to the westernmost corner of Lot 5, L.T.P. 573, Block VIII, Hokonui Survey District ; thence in a south-easterly direction along the south-western boundary of the said Lot 5 to the southernmost corner thereof ; thence in a north-easterly direction along the south-eastern boundary of the said Lot 5 and Lot 6, L.T.P. 573 aforesaid, to Dryridge Road ; thence in a southerly direction along the said Dryridge Road and a public road forming the western boundaries of Lots 1 and 2, L.T.P. 418, Block XIII, Hokonui Survey District, to and across the Josephville to Glenure Road ; thence in a south-easterly direction along the said Josephville to Glenure Road to the easternmost corner of Section 232, Block XXVI, Hokonui Survey District ; thence in a southerly direction along the public road passing through the eastern corner of Section 92, Block XXVI, Hokonui Survey District, to the north-western boundary of Section 108, Block XXVI, Hokonui Survey District ; thence in a south-westerly and south-easterly direction along the north-western and south-western boundaries respectively of the said Section 108 to the southernmost corner of Section 939, Block XXVI, Hokonui Survey District ; thence in a north-westerly direction along the south-western boundary of the said Section 939 to and across a public road ; thence in a south-westerly direction along the north-western side of the said public road passing through Section 354, Block XXVI, Hokonui Survey District, Sections 670 and 405, and forming the north-western boundary of Section 143, Block XXV, Hokonui Survey District, intersecting Section 484 forming the north-western boundary of Section 795, passing through the western corner of the said Section 795 and through the northern part of Section 334, Block XXXV, Hokonui Survey District, to the right bank of the Winton Creek ; thence in a south-westerly direction generally along the right bank of the said Winton Creek to Matthew’s Road ; thence in a south-westerly, westerly, and north-westerly direction along the said Matthew’s Road to the main Invercargill–Kingston Road ; thence in a north-easterly direction along the said main Invercargill–Kingston Road to a point in line with the north-eastern side of a public road forming the south-western boundary of Lot 75, L.T.P. 35, Block XXXIII, Hokonui Survey District ; thence in a north-westerly direction across the said main Invercargill–Kingston Road, to and along the aforesaid public road, and that line produced to the left bank of the Oreti River ; thence in a northerly direction generally along the left bank of the said Oreti River to the point of commencement.

Consenting to Land being taken for a Dwellinghouse and Depot in Block VI, Ongo Survey District

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for a dwellinghouse and depot.

SCHEDULE

APPROXIMATE area of the piece of land permitted to be taken : 1 rood 23 perches.

Being Lot 66, D.P. 297, being part Hapopo Block, and being the whole of the land comprised and described in Certificate of Title, Volume 54, folio 202 (Wellington Land Registry).

Directing Application of Moneys received in respect of the Howell’s Point Domain, Southland Land District, for the Purposes of the Riverton Domain

IN pursuance and exercise of the powers and authorities conferred by section sixty-one of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct that from the moneys received in respect of the Howell’s Point Domain, described in the First Schedule hereto, and at the date hereof lying to the credit of the said domain, a sum not exceeding twenty pounds shall be applied in managing, administering, and improving the Riverton Domain described in the Second Schedule hereto.

FIRST SCHEDULE

SOUTHLAND LAND DISTRICT.—HOWELL’S POINT DOMAIN

SECTION 20, Block II, Jacobs River Hundred : Area, 35 acres 3 roods 30 perches, more or less.

Also all that area being portion of Sections 22, 23, 24, 25, 26, 27, 28, Block II, and Sections 46, 47, 48, Block I, Jacobs River Hundred, containing by admeasurement 70 acres, more or less, and bounded as follows : Commencing at a point on the south-eastern boundary of Section 49 of said Block I three chains from high-water mark ; thence towards the north by a right line to a point on the south-eastern boundary of said Section 47 three chains from high-water mark ; thence by a right line to a point on the south-eastern boundary of said Section 28 three chains from high-water mark ; thence by a right line to a point on the south-eastern boundary of said Section 26 three chains from high-water mark ; and thence by a right line to a point on a road forming the north-eastern boundary of said Section 22 eight chains from high-water mark ; thence towards the north-east by the aforesaid road to high-water mark ; towards the south by the high-water mark of Foveaux Strait ; and towards the west by Section 49 aforesaid to the starting-point.

SOUTHLAND LAND DISTRICT.—RIVERTON DOMAIN

SECTIONS 16A, 18, 19, 21, 22, 23, and 24, Block XXV, Jacobs River Hundred : Area, 11 acres 3 roods 14 perches, more or less.

WHEREAS a notice of intention to issue an Order in Council declaring that the reservation for recreation purposes over the land described in the Schedule hereto shall be changed to a reserve for county purposes was published in the Gazette of the nineteenth day of September, one thousand nine hundred and forty-six :

And whereas such notice of intention was duly laid before both Houses of Parliament in accordance with the provisions of subsection two of section seven of the Public Reserves, Domains, and National Parks Act, 1928 :
