Declaring Lands in the Canterbury Land District to be subject to the Provisions of Section 23 of the Reserves and other Lands Disposal Act, 1939

A PROCLAMATION
WHEREAS by section twenty-three of the Reserves and other Lands Disposal Act, 1939, it is enacted that the Governor-General may by Proclamation declare any lands of the Crown to be subject to the provisions of that section to enable certain readjustment of leases and licenses to be carried into effect:
And whereas it is deemed expedient that the lands described in the Schedule hereto should be subject to the provisions of the said section:
Now, therefore, in pursuance and exercise of the powers and authorities so conferred upon me by subsection one of the aforesaid section twenty-three, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that, from and after the date of the gazetting hereof, the lands described in the Schedule hereto shall be subject to the provisions of the said section twenty-three of the Reserves and other Lands Disposal Act, 1939.

Land set apart as Provisional State Forest declared to be subject to the Land Act, 1924

A PROCLAMATION
IN pursuance and exercise of the powers and authorities conferred upon me by section twenty of the Forests Act, 1921-22, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, acting on the recommendation of the Minister of Lands, do hereby proclaim and declare that the land described in the Schedule hereto, being portion of Provisional State Forest Reserve No. 53, set apart by Proclamation dated the second day of December, one thousand nine hundred and thirty-five, and gazetted on the fifth day of that month, is required for settlement purposes; and, in accordance with the provisions of the said Act, such land shall, from and after the day of the gazetting hereof, cease to be provisional State forest, and shall become subject to the provisions of the Land Act, 1924.
SCHEDULE
SOUTHLAND LAND DISTRICT
ALL that area containing by admeasurement 358 acres 3 roods 27 perches, more or less, being part of Section 23, Block I, Lillburn Survey District, and bounded generally as follows: Towards the north-west by Domain Road; towards the east by Sections 21 and 22, Block I, Lillburn Survey District; towards the south by Section 11, Block I, Lillburn Survey District; and towards the south-west by Section 12, Block III, Lillburn Survey District. As the same is more particularly delineated on plan marked L. and S. 22/4343, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.
Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 28th day of November, 1946.

Appointing Trustee for the Control of Part of the Foreshore at Ohawe

At the Government Buildings at Wellington, this 20th day of November, 1946
Present:
THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
WHEREAS by Order in Council dated the twenty-first day of October, one thousand nine hundred and thirty-five, and published in the Gazette on the twenty-fourth day of the same month, at page 2948, Arthur Malcolm Brown, Raymond Roberts Henderson, John Bryson Murdoch, and Mounu Ripene were appointed trustees (for the inhabitants of the district) for the control of the foreshore at Ohawe:
And whereas the said Mounu Ripene has died, and it is desirable to appoint some person in his place to act with the trustees already appointed:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint
Rangi Jack Phillips
to act with the said Arthur Malcolm Brown, Raymond Roberts Henderson, and John Bryson Murdoch as trustees for the inhabitants of the district for the control of the said foreshore at Ohawe.

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 20th day of November, 1946
Present:
THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit Fish Distributors, Limited, of Otakou (hereinafter called the company, which term shall include its successors or assigns, unless the context requires a different construction), to use and occupy a part of the foreshore and land below low-water mark at the Kaik, Otago Harbour, as shown on plan marked M.D. 8560 and deposited in the office of the Marine Department at Wellington, for the purpose of construction of a fish-landing ramp thereon as shown on the said plan, such license to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.
SCHEDULE
CONDITIONS

This license is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall, as far as applicable, apply hereto.

The premium payable by the company shall be two pounds ten shillings (£2 10s.), and the annual sum so payable by the company shall be one pound.

The term of the license shall be fourteen years from the 1st day of November, 1946.
