Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section one hundred and sixty-two of the Land Act, 1924, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of the kauri-gum reserve, as described in the Schedule hereto, shall, from the sixteenth day of December, one thousand nine hundred and forty-six, cease to be subject to the Kauri-gum Industry Act, 1908.

SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL those areas in the Whangarei County, situated in Block XVI, Whangarei Survey District, containing by admeasurement a total area of 755 acres 3 roods 35 perches, more or less, being Allotments 4, S.W. 36, S.E. 38, S.E. 42, N.W. 43, N.W. 44, N.W. 45, E. 46, 48, and W. 66, Waikare Parish, and Allotments 47 and 50, Manaia Parish. As the same are more particularly delineated on the plan marked L. and S. 9/3382, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Motueka Borough Council on the eighth day of October, one thousand nine hundred and forty-six, viz.:—

"That the Motueka Borough Council, being the local authority having control of the streets in the Borough of Motueka, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of portion of Michael Myers Street fronting Lots 3 and 4, D.P. 3266, being part Section 160 (Reserve F), District of Motueka, Block IV, Motueka Survey District (Certificate of Title 95/15)";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Michael Myers Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE eastern side of all that portion of street situated in the Nelson Land District, Borough of Motueka, known as Michael Myers Street, fronting Lots 3 and 4, D.P. 3266, being part Section 160 (Reserve F), District of Motueka. As the same is more particularly delineated on the plan marked P.W.D. 123724, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

"The Masterton Borough Council, being the local authority having control of the streets in the Borough of Masterton, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of the portion of Chapel Street in the said borough, adjoining Lots 2 and 3 on Deposited Plan No. 10488, as shown in plan P.W.D. 123211, being part of the land included in Certificate of Title, Volume 439, folio 92";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Chapel Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE south-eastern side of all that portion of street situated in the Wellington Land District, Borough of Masterton, known as Chapel Street, fronting Lots 2 and 3, D.P. 10488, being part Section 87, Town of Masterton, and part Block B, Masterton Small Farm Settlement, Block I, Otahoua Survey District. As the same is more particularly delineated on the plan marked P.W.D. 123211, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the fifth day of August, one thousand nine hundred and forty-six, viz.:—

"That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz.:-

"(a) The north-eastern side of the portion of Craigleith Street adjoining Lots 42 and 43, Township of Calton, being part Section 10, North-east Valley Survey District ;

"(b) The south-western side of the portion of Frame Street adjoining Lots 52 and 53, Township of Calton, being part Section 10, North-east Valley Survey District ;

such land being comprised and described in Certificates of Title 16/294 and 61/205";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Craigleith Street or the south-western side of the portion of Frame Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE

THE north-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Craigleith Street, fronting Lots 42 and 43, D.P. 43, Township of Calton.

Also the south-western side of all that portion of street in the said land district and city, known as Frame Street, fronting Lots 52 and 53, D.P. 43, Township of Calton.

As the same are more particularly delineated on the plan marked P.W.D. 124097, deposited in the office of the Minister of Works at Wellington, and thereon edged red.

REGULATIONS

  1. These regulations may be cited as the Samoa Aleisa Council Regulations 1946.

  2. These regulations shall come into force on the 20th day of November, 1946.
