(4) If in respect of any lot of potatoes sold by a retailer the maximum price, calculated in accordance with the foregoing provisions of this clause, is not an exact number of half-pence (in the case of a lot of less than 5 lb.) or is not an exact number of pence (in the case of a lot of 5 lb. or more), the maximum price of the lot shall be the next highest halfpenny or the next highest penny, as the case may be. The provisions of this subclause shall apply notwithstanding that in any case the retailer purports to sell any potatoes otherwise than by weight.

(5) For the purposes of this clause the price paid or payable by a retailer for any lot of potatoes and the transport and other charges paid or payable by him in respect of the same lot shall be apportioned evenly over the whole lot, and the price and charges paid or payable by the retailer for each pound of potatoes included in the lot shall be determined accordingly.

Special Prices where Extraordinary Charges incurred

  1. Notwithstanding anything in the foregoing provisions of this Order and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by the grower or by any wholesaler or retailer, may authorize special maximum prices in respect of any potatoes to which this Order applies where for any reason extraordinary charges (freight or otherwise) are incurred by the grower or by the wholesaler or retailer. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of potatoes or may relate generally to all potatoes to which this Order applies sold by the grower or by the wholesaler or retailer while the approval remains in force.

Duties Imposed on Retailers

  1. Every retailer who offers or exposes for sale any potatoes to which this Order applies shall keep for a period of not less than two months a record showing with respect to every purchase of such potatoes made by him by way of wholesale the following particulars :—

(a) The date of purchase :
(b) The name and address of the wholesaler from whom they were purchased :
(c) The trade description of the potatoes purchased :
(d) The quantity purchased :
(e) The price paid.

  1. Every retailer who offers or exposes any potatoes to which this Order applies for sale in any shop shall keep in a prominent position in such proximity to the potatoes to which it relates as to be obviously descriptive thereof a ticket, placard, or label on which shall be stated in legible and prominent characters the retail price per pound of the potatoes.

Prohibition of Sale (Control of Prices) Notice 1946, No. 1

PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939, Amendment No. 3,* the Price Tribunal doth hereby give notice as follows :—

  1. This notice may be cited as the Prohibition of Sale (Control of Prices) Notice 1946, No. 1.

  2. This notice shall come into force on the 19th day of September, 1946.

GOODS TO WHICH THIS NOTICE APPLIES

  1. (1) This notice shall not apply with respect to any goods in any case where, prior to the date of the coming into force of this notice, the Tribunal has, by approval or authority given or applicable to the person concerned, approved or authorized a specified selling-price or a maximum selling-price for such goods.

(2) Except as provided in subclause (1) hereof, this notice applies with respect to all goods specified in the Schedule hereto, being goods that have been declared under the Declared Goods (Control of Prices) Notice 1944, No. 1†, or the Declared Goods (Control of Prices) Notice 1945, No. 3‡.

PROHIBITION OF SALE

  1. Subject to the provisions of clause 5 hereof, the sale by any person whomsoever of any goods to which this notice applies is hereby prohibited.

PROVISION FOR WITHDRAWAL OF PROHIBITION

  1. The prohibition of the sale by any person of any goods in accordance with this notice shall be deemed to be withdrawn with respect to those goods—

(a) If and when a Price Order issued by the Tribunal comes into force with respect to the goods ; or

(b) If and when the Tribunal, by approval or authority given or applicable to the person concerned, approves or authorizes a special selling-price or a maximum selling-price for the goods.


SCHEDULE

KINDS OF GOODS THE SALE OF WHICH IS PROHIBITED BY THIS NOTICE

New goods of the following kinds :—

  1. Corsetry.
  2. Girls’ school hats.
  3. Aprons.
  4. Radios, electric washing-machines, electric vacuum-cleaners, refrigerators, electric radiators, electric jugs, electric kettles, electric irons (hand and power), electric toasters, water-heating elements, thermostats and covers, water-heating systems, and immersion heaters.
  5. Farm tractors, commercial tractors, motor-cars, motor-trucks complete with cab and body, motor-trucks (chassis only), winches, bulldozer blades and power shovels suitable for attachment to farm tractors or commercial tractors.
  6. Farm implements and machinery.
  7. Spare parts, accessories, or components of any of the goods mentioned in paragraphs 4, 5, and 6.

Declared Goods (Control of Prices) Notice 1946, No. 1

PURSUANT to the powers conferred on it by clause 9 (1) of the Control of Prices Emergency Regulations 1939, Amendment No. 3,* the Price Tribunal hereby gives the following notice :—

NOTICE AS TO DECLARED GOODS

  1. This notice may be cited as the Declared Goods (Control of Prices) Notice, 1946, No. 1.

  2. All new goods of any of the kinds or classes specified in the Schedule hereto are hereby declared to be goods to which the provisions of clause 9 of the Control of Prices Emergency Regulations 1939, Amendment No. 3,* are applicable.


SCHEDULE

KINDS OR CLASSES OF GOODS DECLARED TO BE SUBJECT TO CLAUSE 9 OF THE CONTROL OF PRICES EMERGENCY REGULATIONS 1939, AMENDMENT NO. 3

  1. Furs, fur coats, fur capes, and all skins used in the manufacture thereof.
  2. Piece-goods of wool, cotton, silk, artificial silk, rayon, linen, synthetic, or any mixture thereof.
  3. Ties and scarves.
  4. Underwear of all kinds.
  5. Knitted fabrics of wool, cotton, rayon, art silk, synthetic, or any mixture thereof.
  6. Haberdashery.
  7. Braces and garters.
  8. Fancy-goods, whether manufactured of wood, metal, leather, felt, parchment, glass, plastic, fabric, or any combination thereof.
  9. Egg-beaters and cake-beaters.
  10. Electrical goods as follows :—

Egg-beaters, food-mixers, urns for heating liquids, copper boilers, cooking-ranges, cooking-stovettes, cooking-grillers, bed-warmers, wringers, ironing-mangles, cupboard-heaters, dishwashers, table and reading lamps, soldering-irons, pokerwork machines, elements for jugs, kettles, urns, toasters, irons, stoves, stovettes, and radiators.

  1. Goods of the following kinds, irrespective of the material used in manufacture thereof :—

Portmanteaux, wardrobe trunks, cabin trunks, suitcases, bags, overnight bags, attaché cases, ladies’ handbags, wallets, and compacts.

  1. All sport requisites (excluding any article of wearing apparel or footwear) used in any of the following games or pastimes :—

Archery, badminton, baseball, basketball (excluding goalposts), billiards (excluding tables), bowls, indoor bowls, boxing (excluding ring fittings), cricket, croquet, fishing, rugby football (excluding goalposts), association football (excluding goalposts), league football (excluding goalposts), golf, hockey (excluding goalposts), skiing, snooker (excluding tables), softball, squash racquets, tennis (including tennis gut), table tennis (excluding tables).
