The Servicemen’s Settlement and Land Sales Act, 1943.—Notice declaring Land taken for the Settlement of a Discharged Serviceman

WHEREAS an application has been made for the consent of the Land Sales Court to a transaction which relates to the land described in the Schedule hereto and to which Part III of the Servicemen’s Settlement and Land Sales Act, 1943, applies:

And whereas the Land Sales Committee to which the application has been referred is of opinion that the land to which the application relates is farm land suitable for the settlement of a discharged serviceman:

And whereas the said Committee, not being satisfied that the Crown had decided not to acquire or arrange for the acquisition of the land, did on the 12th day of June, 1946, make an order determining the basic value of the land:

And whereas appeals were lodged against such order:

And whereas the Land Sales Court has dismissed such appeals:

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship:

Now, therefore, the Minister of Lands, acting in pursuance of section 51 of the said Act, doth hereby declare that the said land is taken for the settlement of a discharged serviceman, and hereby specifies the 31st day of January, 1947, as the date on which the said land shall be deemed to be vested in His Majesty the King.

SCHEDULE

HAWKE’S BAY LAND DISTRICT

ALL that area containing approximately eight hundred and fifty-two (852) acres, situate in Blocks I, II, IV, and V, Kidnapper Survey District, being part Lot 6 on Deeds Plan 485, deposited in the Deeds Registry Office at Napier, being part Block I, Kidnapper Crown Grant District, and being also part of the land comprised in certificate of title, Vol. 73, folio 47 (Hawke’s Bay Registry), together with right-of-way over Lot 1 on Deeds Plan 6093, and the water-pipe easement over Lots 1 and 3 on the said plan (H.B. 73/23) reserved in and by Transfer No. 61432, bounded as follows: Commencing at the point of intersection of the right bank of the Tuki Tuki River with the southern boundary of Lot 5 on Deeds Plan 485, deposited in the Deeds Registry Office at Napier; thence generally easterly along the southern and eastern boundaries of the said Lot 5 and the southern boundary of Lot 4 on the aforesaid Deeds Plan 485 to a point distant approximately 30 chains from the easternmost corner of the said Lot 4; thence generally south-westerly, passing through Lot 6 on the aforesaid Deeds Plan 485, and following a fence-line to the northern boundary of Lot 1 on a plan numbered 7287, about to be deposited in the office of the District Land Registrar at Napier; thence generally westerly along the northern boundary of the said Lot 1 and the east and north boundaries of Lot 2 on the said plan numbered 7287 to the Tuki Tuki River; thence down the right bank of that river to the point of commencement. As the same is more particularly shown on plan lodged in the office of the Surveyor-General at Wellington, numbered 2958, and thereon edged green, but excepting thereout a one-chain strip containing approximately nine (9) acres two (2) roods, coloured pink on the said plan.

And whereas the said committee, not being satisfied that the Crown had decided not to acquire or arrange for the acquisition of the land, did on the 23rd day of July, 1946, make an order determining the basic value of the land and no appeal from the said order was made within the time prescribed by the said Act or within any further time allowed by the Court:

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship:

Now, therefore, the Minister of Lands, acting in pursuance of section 51 of the said Act, doth hereby declare that the said land is taken for the settlement of a discharged serviceman, and hereby specifies the 18th day of September, 1946, as the date on which the said land shall be deemed to be vested in His Majesty the King.

SCHEDULE

CANTERBURY LAND DISTRICT

ALL that area containing by admeasurement two hundred and fifty (250) acres two (2) roods twenty-five decimal eight (25·8) perches, more or less, situated in Block X, Arowhenua Survey District, and being part of Lot 1, Deposited Plan 9476, being all of Rural Section 8823 and parts of Rural Sections 6296, 6859, 8258, and 8259, and being all the land comprised and described in certificate of title, Vol. 464, folio 77 (Canterbury Registry), subject to pipe-line and other easements over parts of the above-described land created by Transfer 192703, and together with rights created by the same transfer, and together with right-of-way created by Transfer 211587 over Lots 6 and 7, Deposited Plan 4426, being part of the land comprised and described in certificate of title, Vol. 436, folio 216 (Canterbury Registry).

The Servicemen’s Settlement and Land Sales Act, 1943.—Notice declaring Land taken for the Settlement of Discharged Servicemen

WHEREAS, pursuant to section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, notice was given of the intention of the Minister of Lands to take under Part II of the said Act the lands described in the Schedule hereto, and a copy of the said notice was published in the New Zealand Gazette on the 20th day of June, 1946, at page 844:

And whereas no objection was made in manner prescribed by the said Act to the taking of the lands specified in the said notice:

And whereas the said lands are not the lands of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship:

Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the said lands are taken for the settlement of discharged servicemen, and hereby specifies the 28th day of February, 1947, as the date on which the said lands shall be deemed to be vested in His Majesty the King,

SOUTHLAND LAND DISTRICT

ALL that parcel of land containing by admeasurement one thousand three hundred and nineteen (1,319) acres and thirty-seven decimal seven (37·7) perches, more or less, being Section 9B, Block II, and part Lot 2, Deposited Plan 1952, being part Sections 7, 9, and 16, Block II, and part Section 13, Block III, Toetoes Survey District, being all the land contained in certificate of title, Vol. 122, folio 272 (Southland Registry).

Notice to Persons affected by Applications for Licenses under Part III of the Industrial Efficiency Act, 1936

Manufacture for Sale of Footwear

C. O. Thompson, 21 Normanby Street, Musselburgh, Dunedin, has applied for a license to manufacture children’s footwear.

Gadabouts Limited, 410 Broadway, Newmarket, Auckland, has applied for an extension of its existing license so as to permit the manufacture of children’s footwear.

Radio-manufacturing Industry

G. W. Vicary, Radio and Electrical Dealer, Otorohanga, has applied for a license to manufacture 200 portable radio receivers per annum.

Retail Sale and Distribution of Motor-spirit

F. Wilson, Rakaia, has applied for a license to resell motor-spirit otherwise than through pumps from the Christchurch depot of the Associated Motorists Petrol Co., Ltd.

Redstone Motors, Ltd., Gisborne, has applied for amendment of their existing motor-spirit reseller’s license to cover (1) change of retail-selling point from 72 Grey Street, Gisborne, to new premises at 66 Read’s Quay, Gisborne, and (2) the operation of two additional pumps already installed on the new premises at 66 Read’s Quay.

Wairarapa Seed Co., Masterton, has applied for a license to resell motor-spirit otherwise than through pumps from the depot of the Associated Motorists Petrol Co., Ltd., at Waiwhetu.

J. F. Kelly, P.O. Box 81, Greymouth, has applied for a license to resell motor-spirit from one pump already installed outside store premises in Buccleugh Street, Greymouth.

H. C. Sandford, Mangawai, has applied for a license to resell motor-spirit from two pumps to be installed outside garage premises at the junction of Wellsford and Kaiwaka Roads, such pumps to be transferred from the store premises of Mr. A. Wood, 100 yards distant.

R. P. James, Seddon Street, Kumara, has applied for a license to resell motor-spirit from one pump to be installed at the front of premises known as the “Kumara Garage,” Seddon Street, Kumara.

Applicants and other persons considering themselves to be materially affected by the decisions of the Bureau of Industry on these applications should, not later than the 29th day of August, 1946, submit any written evidence and representations they may desire to tender. All communications should be addressed to the Secretary, Bureau of Industry, C.P.O. Box 3025, Wellington.
