Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for public buildings of the General Government.

APPROXIMATE area of the piece of land permitted to be taken: 9·6 perches.

Being part Section 535, City of Wellington, and being the whole of the land comprised and described in Certificate of Title, Volume 110, folio 140 (Wellington Land Registry).

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the additional land described in the Schedule hereto being taken, together with and subject to the mutual grant of party-wall easements created by Memorandum of Transfer No. 75659, Wellington Land Registry, for public buildings of the General Government.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the purpose for which it was acquired.

Amending an Order in Council authorizing the Tararua Electric-power Board to construct, maintain, and use Electric Lines

At the Government House at Wellington, this 24th day of July, 1946

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Electric-power Boards Act, 1925, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the Order in Council dated the thirteenth day of July, one thousand nine hundred and thirty-eight, and published in the New Zealand Gazette of the fourteenth day of the same month, at page 1647, authorizing the Tararua Electric-power Board to construct, maintain, and use electric lines, by deleting the word “three” where it appears in clause five of the conditions and substituting therefor the word “eleven.”

Validating Proceedings in Connection with Banks Peninsula Electric-power Board’s Loan of £5,000

ORDER IN COUNCIL

At the Government House at Wellington, this 24th day of July, 1946

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the Banks Peninsula Electric-power Board lately proceeded by way of special order to raise a loan of five thousand pounds (£5,000), to be known as Development Loan, 1945 (hereinafter called the said loan):

And whereas the proceedings in connection with the said loan were irregular or defective in that public notice of the resolution to make the special order authorizing the raising of the loan, although given four times, was not given once in each of the four weeks immediately preceding the day on which the meeting was held for the purpose of confirming that resolution, as required by paragraph (c) of subsection one of section forty-five of the Electric-power Boards Act, 1925:

And whereas it appears that the ratepayers of the district have not been misled by such irregularity as aforesaid, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and twenty-two of the Local Bodies’ Loans Act, 1926, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings in connection with the said loan shall be valid to all intents and purposes as though the said public notice had been correctly given, and that the validity of the proceedings in connection with the said loan or of the security for the said loan shall not be called in question by reason only of the irregularity aforesaid.

Varying the Determinations in respect of the Taranaki Electric-power Board’s Loan of £15,000

ORDER IN COUNCIL

At the Government House at Wellington, this 24th day of July, 1946

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the fifteenth day of May, one thousand nine hundred and forty-six (hereinafter referred to as the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Taranaki Electric-power Board (hereinafter referred to as the said local authority) of a loan of fifteen thousand pounds (£15,000), to be known as Reticulation Extension Loan, 1945 (hereinafter referred to as the said loan):

And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary the determinations aforesaid in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing as follows:—

(1) In lieu of a rate of interest not exceeding three pounds ten shillings (£3 10s.) per centum per annum, as specified in clause two of the said Order in Council, the rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds five shillings (£3 5s.) per centum per annum.

(2) In lieu of repayment by equal aggregate annual or half-yearly instalments of principal and interest, as specified in clause three of the said Order in Council, the said loan or any part thereof shall be repaid by equal half-yearly instalments of principal extending over the term of the loan as determined in clause one of the said Order in Council.
