Appointment of Members of the Tuwharetoa Trust Board

At the Government House at Wellington, this 5th day of June, 1946

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

IN pursuance of the provisions of section fifty-five of the Native Purposes Act, 1931, and of the regulations made thereunder in respect of the Tuwharetoa Trust Board, and any other powers him enabling, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, doth hereby appoint the persons whose names are set out in the Schedule hereto to be members of the said Tuwharetoa Trust Board constituted under the said section fifty-five.

Altering and Redefining the Boundaries of the Redwood Rabbit District.—(Notice No. Ag. 4295)

ORDER IN COUNCIL

At the Government House at Wellington, this 12th day of June, 1946

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

WHEREAS by section thirty-one of the Rabbit Nuisance Act, 1928, it is enacted that the Governor-General, at the request of the Board of any rabbit district, may, by Order in Council, alter and redefine the boundaries of its district:

And whereas the district known as the Redwood Rabbit District has been constituted under and for the purposes of the said Act:

And whereas the Board of the said district has, pursuant to the said section thirty-one of the said Act, requested that the boundaries of its district be altered and redefined by including an additional area therein:

And whereas the consent of the occupier of such additional area qualified to be enrolled on the ratepayers’ list for the said district has been given to the inclusion of such additional area in the said district:

And whereas it is deemed expedient to alter and redefine the boundaries of the said district accordingly:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, doth hereby—

(1) Alter and redefine the boundaries of the said district so constituted as aforesaid;

(2) Declare that the boundaries of the said district shall be those set forth in the Schedule hereto; and, further,

(3) Declare that this Order in Council shall come into force on the day following publication hereof in the Gazette.

SCHEDULE

BOUNDARIES OF THE REDWOOD RABBIT DISTRICT

ALL that parcel of land in the Marlborough Land District, containing 59,975 acres, more or less, bounded as follows: Commencing at the junction of the Blairich River and the Awatere River at Section 12 of Square 39, Awatere, in Block XVII, Taylor Pass Survey District; thence generally in a westerly direction by the northern bank of the Blairich River to its junction with Boundary Creek; thence generally in a northerly direction by that creek to its source, and by the north-west boundary of a public road to the Saddle; thence generally in a north-easterly direction by the western bank of the Taylor River to the point where it meets the Taylor Pass Road at the western corner of Section 52 of Square 39, Awatere, Block XIII, Taylor Pass Survey District; thence by the crossing of that road and by the eastern boundary of the Taylor Pass Road to the point where the Taylor River crosses the said road at Section 1, Block VIII, Taylor Pass Survey District; thence along the western bank of the Taylor River to the south-eastern corner of Section 9, Block III, Taylor Pass Survey District, and along the western boundary of the said Section 9 to the Taylor River; again along the western bank of the Taylor River to the south-western corner of Section 2 of 28, Block III, Taylor Pass Survey District; thence along the western boundary of the said Section 2 of 28 to the New Renwick Road; thence in an easterly direction along the southern side of the New Renwick Road to the north-eastern corner of Section 2, Block III, Taylor Pass Survey District; thence in a southerly direction along the eastern boundary of the said Section 2 to the north-east corner of Section 1 of 28, Block III, Taylor Pass Survey District; thence easterly across that road; thence northerly to the intersection of Taylor Pass and Hospital Roads; thence easterly along the south side of Hospital Road to Howick Road; thence southerly by the west side of Howick Road to Wither Road; thence westerly by the north side of Wither Road to a point in line with Section 30, Block III aforesaid; thence southerly across that road and by the east boundary of Section 30, Wither Settlement, to the northern boundary of Section 8, Wither Settlement; thence generally in an easterly direction by the northern boundary of Sections 8 and 9, Wither Settlement, to the boundary of Section 42, Block IV, Taylor Pass Survey District, and by a right line to a point on a public road approximately 6 chains north of the south-east corner of Section 34, Block IV aforesaid, and again by a right line to the intersection of the South Island Main Trunk Railway-line with the boundary of Section 2 of Block 2 in Block IV aforesaid, and along the said railway-line to the State highway; thence generally in a westerly direction by the State highway to the south-western corner of the Section 33, Block XVII, Cloudy Bay Survey District; thence in a northerly direction by the western boundary of Section 33 aforesaid; thence generally in an easterly direction by the Opawa and Wairau Rivers to the north-east corner of part Section 8, Block I, Clifford Bay Survey District; thence southerly by the eastern boundaries of Sections 8, 7, and 9, Block I aforesaid, to Morgan’s Creek; thence westerly by that creek to Section 22, Block I aforesaid; thence southerly by the eastern boundaries of Sections 22 and 21, Block I, and Section 20, Block II, Clifford Bay Survey District, to Section 18, Block II aforesaid; thence generally in an easterly direction by the northern boundary of Section 18 aforesaid to Chandler’s Lagoon, and by the shores of that lagoon and the northern boundaries of Sections 13, Block II aforesaid, 7 of Block I, 9 of Block 2, 8 of Block I, and 10 of Block 2, all in Block III, Clifford Bay Survey District, to the sea; thence in a southerly direction along the sea-coast to the Awatere River, and in a south-westerly direction along the northern bank of the Awatere River to the point of commencement.

The South-western Side of Portion of Penlington Street and the South-eastern Side of Portion of Rue Charbonnier, in the Borough of Akaroa, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government House at Wellington, this 12th day of June, 1946

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Akaroa Borough Council on the twenty-first day of November, one thousand nine hundred and forty-five, viz.:—

“The Akaroa Borough Council, being the local authority having control of the streets in the Borough of Akaroa, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of portion of Penlington Street and the eastern side of the Rue Charbonnier adjoining the land comprised in part C.T. 400/291, T.S. 21, Borough of Akaroa”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Penlington Street or the south-eastern side of the portion of Rue Charbonnier (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE

THE south-western side of all that portion of street situated in the Canterbury Land District, Borough of Akaroa, known as Penlington Street, fronting part Town Section 21, Akaroa.

Also the south-eastern side of all that portion of street situated in the said land district and borough, known as the Rue Charbonnier, fronting part Town Section 21, Akaroa.

As the same are more particularly delineated on the plan marked P.W.D. 123435, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
