ALL that area containing by admeasurement 30·6 perches, more or less, and being Lot 5 on plan deposited in the Land Registry Office at Christchurch as No. 9426, situated in the City of Christchurch, and being part Rural Section 71. As the same is more particularly delineated on the plan marked L. and S. 1/975s, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
Also all that area containing by admeasurement 1 rood, more or less, and being Lot 10 on plan deposited in the Land Registry Office at Christchurch as No. 8608, situated in the City of Christchurch, and being part Rural Section 76. As the same is more particularly delineated on the plan marked L. and S. 1/975r, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Revoking the Reservation for Recreation Purposes over a Reserve in the City of Christchurch, Canterbury Land District

ORDER IN COUNCIL
At the Government House at Wellington, this 10th day of April, 1946
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS a notice of intention to issue an Order in Council declaring that the reservation for recreation purposes over the land described in the Schedule hereto shall be revoked was published in the Gazette of the sixth day of September, one thousand nine hundred and forty-five:
And whereas such notice of intention was duly laid before both Houses of Parliament in accordance with the provisions of subsection two of section seven of the Public Reserves, Domains, and National Parks Act, 1928:
And whereas the Legislative Council and the House of Representatives, by resolutions dated respectively the fourth and the sixth days of December, one thousand nine hundred and forty-five, approved the proposed revocation as aforesaid:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for recreation purposes over the land described in the Schedule hereto, and doth hereby declare that the said land, being vested in the body corporate called the Mayor, Councillors, and Citizens of the City of Christchurch, may be disposed of by the said body corporate by way of sale by public auction or private contract at such price and on such terms and conditions as the said body corporate shall determine, but so that the proceeds of any such sale shall be used and applied in or towards the purchase of other land for recreation purposes.
SCHEDULE

At the Government Buildings at Wellington, this 3rd day of April, 1946

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the thirtieth day of April, one thousand nine hundred and forty-two, in so far as it affects the side and portion of street described in the Schedule hereto, viz.:
“ The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Lichfield Road adjoining Lots 42, 43, 43A, 44, and 45 of Allotments 18, 19, and 21, Section 2, Suburbs of Auckland ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Lichfield Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE
THE western side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Lichfield Road, fronting Lots 42, 43, 43A, 44, and 45, Deeds Plan No. 35 (blue), Section 2, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 113433, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Onehunga Borough Council on the twenty-fifth day of February, one thousand nine hundred and forty-six, viz.:
“ The Onehunga Borough Council, being the local authority having control of the streets in the Borough of Onehunga, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the northern side of portion of Jackson Street fronting Lot 33 of Lot 31, Section 38, Village of Onehunga, or to the eastern side of portion of Catherine Street fronting parts Allotments 5 and 6, Section 22, Village of Onehunga ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Jackson Street or the eastern side of the portion of Catherine Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
SCHEDULE
THE northern side of all that portion of street in the North Auckland Land District, Borough of Onehunga, known as Jackson Street, fronting Lot 33, D.P. 18182, being part Allotment 31 of Section 38, Village of Onehunga. As the same is more particularly delineated on the plan marked P.W.D. 123160, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
Also the eastern side of all that portion of street in the said land district and borough, known as Catherine Street, fronting part Allotments 5 and 6 of Section 22, Village of Onehunga. As the same is more particularly delineated on the plan marked P.W.D. 123161, deposited as aforesaid, and thereon coloured red.

PURSUANT to section five of the Native Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Native freehold land described in the Schedule hereto as a Native reservation for the common use of the Maori people of Rawhiti for the purpose of a meeting-house site.
