approve of the following resolution passed by the Main Highways
Board on the twentieth day of February, one thousand nine hundred
and forty-six, viz. :-
"The Main Highways Board, being the local authority
having control of the Richmond-Collingwood Main Highway,
by resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the south-eastern side of the portion of the said main
highway fronting part Section 60, Waimea West, Block V,
Waimea Survey District, being the land comprised in Certificate
of Title, Volume 63, folio 161 (Nelson Registry)";
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the south-eastern side
of the portion of Richmond-Collingwood Main Highway (described
in the Schedule hereto) within a distance of thirty-five feet from the
centre-line of the said portion of road.
SCHEDULE
THE south-eastern side of all that portion of road situated in the
Nelson Land District, County of Waimea, known as Richmond-
Collingwood Main Highway, fronting part Section 60, Waimea West,
Block V, Waimea Survey District. As the same is more particularly
delineated on the plan marked P.W.D. 122929, deposited in the
office of the Minister of Works at Wellington, and thereon coloured
red.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of all other powers in anyway enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
approve of the following resolution passed by the Dunedin City
Council on the twenty-eighth day of January, one thousand nine
hundred and forty-six, viz. :-
"That the Dunedin City Council, being the local authority
having control of the streets in the City of Dunedin, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the undermentioned portions of streets, viz. :-
"(a) The south-western side of Balmoral Street adjoining
Lots 22 and 30, Block II, D.P. 26, Township of
Opoho, being part Section 50, Block IX, North
Harbour and Blueskin District;
"(b) The north-western side of the portion of Signal Hill
Road adjoining part Lot 22, Block II, D.P. 26,
Township of Opoho, being part Section 50, Block IX,
North Harbour and Blueskin District ;
such land being comprised and described in Certificate of
Title 19/142";
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the south-western side
of the portion of Balmoral Street or the north-western side of the
portion of Signal Hill Road (described in the Schedule hereto)
within a distance of thirty-three feet from the centre-lines of the
said portions of streets.
SCHEDULE

Otago Land District, City of Dunedin, known as Balmoral Street,
fronting Lots 22 and 30, Block II, D.P. 26, Township of Opoho,

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
PURSUANT to section three of the Judicature Amendment
Act, 1930, His Excellency the Governor-General, acting with
the advice and consent of the Executive Council, and with the
concurrence of the Right Honourable the Chief Justice and four
of the other members of the Rules Committee constituted under
the Judicature Amendment Act, 1930 (all of such other members
being Judges of the Supreme Court), doth hereby make the following
rules amending the Code of Civil Procedure.
RULES

  1. THESE rules may be cited as the Supreme Court Emergency
    Revocation Rules, 1946.
  2. Rule 531DD of the Code of Civil Procedure set forth in the
    Second Schedule to the Judicature Act, 1908, as enacted by the
    Supreme Court Emergency Rules, 1939, and amended by the
    Supreme Court Emergency Rules, 1940, and Rule 531EE of the said
    Code as enacted by the Supreme Court Emergency Rules, 1939, are
    revoked.
  3. The Supreme Court Emergency Rules, 1939, and the Supreme
    Court Emergency Rules, 1940, are consequentially revoked.

    WHEREAS by Order in Council dated the fourth day of
    November, one thousand nine hundred and thirty-six, and
    published in the Gazette of the twelfth day of the same month at
    page 2190, Charles Staniland West (hereinafter called the licensee)
    was licensed to occupy a part of the foreshore and land below low-
    water mark at Helensville, Kaipara Harbour, in order to erect
    dolphins thereon :
    And whereas the licensee has applied to have the hereinbefore-
    recited Order in Council revoked, and it is desirable to revoke same :
    Now, therefore, His Excellency the Governor-General of the
    Dominion of New Zealand, in pursuance and exercise of the power
    and authority vested in him by the Harbours Act, 1923, and of
    all other powers and authorities enabling him in that behalf, and
    acting by and with the advice and consent of the Executive Council
    of the said Dominion, doth hereby revoke the hereinbefore-recited
    Order in Council of the fourth day of November, one thousand
    nine hundred and thirty-six, as from the first day of September,
    one thousand nine hundred and forty-five.
