MAR, 28] THE NEW ZEALAND GAZETTE 383 forty-six (in so far as it affects the side and portion of street described in the Schedule hereto), viz.:-
“The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Sackville Street adjoining part of Allotment 43 of Section 8, Suburbs of Auckland”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Sackville Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE
THE south-eastern side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Sackville Street, fronting Lot 45 on Deeds Plan No. 55 (blue), being portion of Allotment 43, Section 8, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 123190, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Oxford Street, in the Borough of Richmond, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Richmond Borough Council on the eleventh day of December, one thousand nine hundred and forty-five, viz.:-
“The Richmond Borough Council, being the local authority having control of the roads in the Borough of Richmond, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of portion of Oxford Street fronting subdivision of part Section 27 (D.P. 1342), Waimea East, Block VII, Waimea Survey District, and contained in the Certificate of Title, Volume 50, folio 290”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Oxford Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE
THE south-eastern side of all that portion of street situated in the Nelson Land District, Borough of Richmond, known as Oxford Street, fronting part Section 27, D.P. 1342, Waimea East, Block VII, Waimea Survey District. As the same is more particularly delineated on the plan marked P.W.D. 122926, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

approve of the following resolution passed by the Dunedin City Council on the nineteenth day of November, one thousand nine hundred and forty-five, viz.:-
“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of the portion of Brownville Crescent adjoining Lot 5, Block II, D.P. 67, Maclennan’s Subdivision, being part Section 8, Block II, Upper Kaikorai Survey District, such land being comprised and described in Certificate of Title 53/189”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Brownville Crescent (described in the Schedule hereto) within a distance of thirty three feet from the centre-line of the said portion of street.
SCHEDULE
THE south-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Brownville Crescent, fronting Lot 5, Block II, D.P. 67, Upper Kaikorai District. IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Peninsula County Council on the fifteenth day of November, one thousand nine hundred and forty-five, in so far as it affects the side and portion of road described in the Schedule hereto, viz.:-
“That the Peninsula County Council, being the local authority having control of the roads in the Peninsula County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the District Road fronting part Section Fourteen (14), Block One (I), Portobello Survey District”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of District Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE
