[No. 1]

The Servicemen's Settlement and Land Sales Act, 1943.-Notice
declaring Land taken for the Settlement of Discharged Servicemen.

WHEREAS, pursuant to section 24 of the Servicemen's
Settlement and Land Sales Act, 1943, notice was given
of the intention of the Minister of Lands to take under Part II
of the said Act the lands described in the First Schedule hereto,
and a copy of the said notice was published in the Gazette on the
31st day of May, 1945, at page 618:

And whereas an objection was lodged by the owners in the
manner prescribed by the said Act to the taking of the said lands:

And whereas the Minister of Lands at the request of the owners
agreed to a variation of the area to be taken by the exclusion of
part of the said lands:

And whereas the owners withdrew their objection to the taking
of the said lands:

Now, therefore, the Minister of Lands, acting in pursuance of
section 27 of the said Act, doth hereby declare that the lands
described in the Second Schedule hereto are taken for the settlement
of discharged servicemen, and hereby specifies the 28th day
of June, 1946, as the date on which the said lands shall be deemed
to be vested in His Majesty the King.

FIRST SCHEDULE

AUCKLAND LAND DISTRICT

ALL that area in the Auckland Land District, Whakatane County,
containing by admeasurement 500 acres, more or less, being
Allotment 77, Rangitaiki Parish, comprised in certificate of title,
Vol. 274, folio 178.

Also all that area containing by admeasurement 496 acres
1 rood 18 perches, more or less, being part Allotment 80, Rangitaiki
Parish, comprised in certificate of title, Vol. 208, folio 195.

Also all that area containing by admeasurement 454 acres
1 rood 34.3 perches, more or less, being part Allotment 81 and
part Allotment 118, Rangitaiki Parish, comprised in certificate of
title, Vol. 714, folio 394.

Also all that area containing by admeasurement 80 acres
3 roods 3 perches, more or less, being Allotments 1A No. 1,
1A No. 2, part 1A No. 3, and part 1A No. 4, Rangitaiki Parish,
comprised in certificate of title, Vol. 298, folio 247.

Also all those areas containing by admeasurement 1 rood
29.3 perches and 17 acres 2 roods 32 perches, more or less, being
respectively Allotments 116 and 117, Rangitaiki Parish, comprised
in certificate of title, Vol. 639, folio 254 (Auckland Registry).

SECOND SCHEDULE

AUCKLAND LAND DISTRICT

ALL that area in the Auckland Land District, Whakatane County,
containing by admeasurement 498 acres 3 roods 30 perches, more
or less, being part Allotment 77, Rangitaiki Parish, being portion
of the land comprised in certificate of title, Vol. 274, folio 178.

Also all those areas containing by admeasurement 331 acres
2 roods 10 perches, 47 acres 3 roods 33 perches, 15 acres 3 roods
5 perches, and 5 perches, more or less, being parts Allotment 80,
Rangitaiki Parish, being portions of the land comprised in certificate
of title, Vol. 208, folio 195.

Also all those areas containing by admeasurement 333 acres
1 rood 30 perches, more or less, being part Allotment 81 and
23 perches, more or less, being part Allotment 118, Rangitaiki
Parish, being portions of the land comprised in certificate of title,
Vol. 714, folio 394.

Also all that area containing by admeasurement 80 acres
3 roods 3 perches, more or less, being Allotments 1A No. 1,
1A No. 2, part 1A No. 3, and part 1A No. 4, Rangitaiki Parish,
comprised in certificate of title, Vol. 298, folio 247.

Also all those areas containing by admeasurement 1 rood
29.3 perches, more or less, being Allotment 116, and 17 acres
2 roods 32 perches, more or less, being Allotment 117, Rangitaiki
Parish, comprised in certificate of title, Vol. 639, folio 254
(Auckland Registry).

As the same are more particularly delineated on plan marked
L. & S. No. 2948, deposited in Head Office of the Lands and Survey
Department, at Wellington, and thereon edged red.

The Servicemen's Settlement and Land Sales Act, 1943.-Notice
declaring Land taken for the Settlement of Discharged
Servicemen

WHEREAS an application has been made for the consent of
the Land Sales Court to a transaction which relates to the
land described in the Schedule hereto and to which Part III of the
Servicemen's Settlement and Land Sales Act, 1943, applies:

And whereas the Land Sales Committee to which the application
has been referred is of opinion that the land to which the application
relates is farm land suitable or adaptable for the settlement of
discharged servicemen:

And whereas the said committee, not being satisfied that the
Crown had decided not to acquire or arrange for the acquisition
of the land, did on the 14th day of September, 1945, make an order
determining the basic value of the land:

And whereas an appeal against the said order was made within
the time prescribed by the said Act:

And whereas the said appeal was dismissed by the Court;

And whereas the said land is not the land of any serviceman
who is for the time being serving outside New Zealand in any of
His Majesty's Forces or in any British ship:

Now, therefore, the Minister of Lands, acting in pursuance of
section 51 of the said Act, doth hereby declare that the said land
is taken for the settlement of discharged servicemen, and hereby
specifies the 21st day of January, 1946, as the date on which the
said land shall be deemed to be vested in His Majesty the King.

SCHEDULE

SOUTHLAND LAND DISTRICT

PART Section 140, Block XI, Hokonui Survey District, containing
one hundred and eight (108) acres one (1) rood five (5) perches,
being all the land in certificate of title, Vol. 137, folio 116.

Part Section 352, Block XVI, Hokonui Survey District, containing
five hundred and twenty-nine (529) acres, and being all the
land in certificate of title, Vol. 59, folio 205.

Part Section 3 of 406A, Block XVI, Hokonui Survey District,
containing two hundred and thirty-six (236) acres three (3) roods
sixteen (16) perches, and being all the land in certificate of title,
Vol. 49, folio 212.

Part Section 2 of 406A, Block XVI, Hokonui Survey District,
containing two hundred and forty-five (245) acres one (1) rood
eighteen (18) perches, and being all the land in certificate of title,
Vol. 35, folio 247.

Part Section 528, Block XVII, Hokonui Survey District, containing
fifty (50) acres, and being all the land in certificate of title,
Vol. 48, folio 258.

Lot 1 on D.P. 2713, being part Section 140, Block XI, Hokonui
Survey District, containing one hundred and ten (110) acres, and
being all the land in certificate of title, Vol. 133, folio 44 (Southland
Registry).

The Servicemen's Settlement and Land Sales Act, 1943.-Notice of
Intention to take Land

THE Minister of Lands, acting in pursuance of section 24 of the
Servicemen's Settlement and Land Sales Act, 1943, hereby
gives notice of his intention to take the lands described in the Schedule
hereto under Part II of the said Act, and specifies the 1st day of
June, 1946, as the date on which possession of the land is required,
and the 1st day of March, 1946, as the date on or before which
objections may be made under section 25 of the said Act.

SCHEDULE

GISBORNE LAND DISTRICT

ALL those parcels of land containing four thousand four hundred and
seventy-four (4,474) acres three (3) roods twenty-six (26) perches,
more or less, situated in Blocks V, VI, IX, and X, Waikohu Survey
District, being Lots 3, 4, 7, 22, 23, and part 12, Deposited Plan 2761,
Lot 2, Deposited Plan 2762, and Lots 8 and 9, Deposited Plan 2272,
all being parts of Lot 3, Deposited Plan 1558, of part Subdivision 1
of Okahuatiu 1D Block, parts Okahuatiu 1 and 1D 2A Blocks, and
part Tangihanga 1c Block, and being the balance of the Land comprised
in certificate of title, Vol. 45, folio 193 (Gisborne Registry).

Also all that parcel of land containing (5) acres one (1) rood
fifteen (15) perches, more or less, situated in Block VI, Waikohu
Survey District, being Lots 1 and 2, Deposited Plan 2271, part
Okahuatiu No. 1c Block, and being all the land comprised in certificate
of title, Vol. 59, folio 160 (Gisborne Registry).

Also all that parcel of land containing one (1) acre three (3)
roods two (2) perches, more or less, situated in Block VI, Waikohu
Survey District, being Section 7x (closed road), part Tangihanga
No. 1c Block (S.O. 1236), and being all the land comprised in certificate
of title, Vol. 60, folio 180 (Gisborne Registry).

Authorizing the Laying-off of a Road of less Width than 66 ft.

WHEREAS in the opinion of the Minister of Lands it is
inexpedient, by reason of the fact that the land shown upon
the plan of Town of Stoke Extension No. 12, affecting part Section 52,
Suburban South, Block VII, Waimea Survey District, Nelson Land
District, is intended to be used wholly for residential purposes, that
the road shown as Lot 19 thereon should be of the width of 66 ft. :

Now, therefore, in pursuance of the power conferred upon him
by section 17, subsection (1), of the Land Act, 1924, and of every
other power him thereunto enabling, the Minister of Lands doth
hereby authorize the laying-off of the road shown as Lot 19 of a
width of not less than 50 ft.: Provided always that it shall not be
lawful for any person to erect or cause to be erected any building at a
less distance than 33 ft. from the middle of such road.

Given under the hand of the Minister of Lands, this 18th day of
December, 1945.
