At the Government Buildings at Wellington, this 28th day of November, 1945

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to section five of the Native Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Native freehold land described in the Schedule hereto as a Native reservation for the common use of the owners of the Kekerione Block as a burial-ground.

Boundaries of Borough of Tauranga and County of Tauranga altered

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 28th day of November, 1945

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS in pursuance of section one hundred and thirty-six of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area of land be excluded from the County of Tauranga and included in the Borough of Tauranga :

And whereas it is deemed expedient to make such alteration of boundaries :

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the said Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and forty-six, the area described in the Schedule hereto shall be excluded from the County of Tauranga and included in the Borough of Tauranga.


AREA EXCLUDED FROM THE COUNTY OF TAURANGA AND INCLUDED IN THE BOROUGH OF TAURANGA

ALL that area in the Auckland Land District, bounded by a line commencing at a point being the northern corner of Allotment 61, Suburbs of Tauranga, and running south-easterly generally along the south-western side of Hospital Street, being the south-western boundary of the Borough of Tauranga, as described in New Zealand Gazette, 1882, page 295, and crossing intersecting public roads to the shores of the Tauranga Harbour; thence south-westerly generally along the said shores to the north-eastern corner of part Lot 3 on D.P. 3066, being part Allotment 20, Te Papa Parish, and being the north-eastern corner of the land comprised and described in Certificate of Title, Volume 809, folio 129 (Auckland Land Registry); thence north-westerly generally along the north-eastern boundary of the said part Lot 3, to and along the south-western side of Courtney Street and the south-eastern side of Cameron Road to a point being the production south-easterly of the north-eastern boundary of Allotment 37, Suburbs of Tauranga aforesaid; thence along a right line across the said Cameron Road, to and along the said north-eastern boundary, being the south-western side of Sellars Street, and a right line across Cook Street, to and along its south-western and western sides and the south-western side of Faulkner Street to a point being the production south-westerly of the south-eastern boundary of Allotment 49, Suburbs of Tauranga aforesaid; thence north-easterly along a right line across the said Faulkner Street, to and along the said south-eastern boundary and the south-eastern boundary of Allotment 523, Te Papa Parish, to the point of commencement.

Altering and Redefining the Boundaries of the Waikato Central Rabbit District.—(Notice No. Ag. 4238)

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS by section thirty-one of the Rabbit Nuisance Act, 1928, it is enacted that the Governor-General, at the request of the Board of any rabbit district, may, by Order in Council, alter and redefine the boundaries of its district :

And whereas the district known as the Waikato Central Rabbit District has been constituted under and for the purposes of the said Act :

And whereas the Board of the said district has, pursuant to the said section thirty-one of the said Act, requested that the boundaries of its district be altered and redefined by including an additional area therein :

And whereas the consent of a majority of the persons in such additional area qualified to be enrolled on the ratepayers’ list for the said district has been given to the inclusion of such additional area in the said district :

And whereas it is deemed expedient to alter and redefine the boundaries of the said district accordingly :

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby—

(1) Alter and redefine the boundaries of the said district so constituted as aforesaid ;

(2) Declare that the boundaries of the said district shall be those set forth in the Schedule hereto ; and, further,

(3) Declare that this Order in Council shall come into force on the day following publication hereof in the Gazette.


SCHEDULE

BOUNDARIES OF THE WAIKATO CENTRAL RABBIT DISTRICT

ALL that area in the Auckland Land District, in the Waipa and Matamata Counties, bounded by a line commencing at a point in Block IX, Cambridge Survey District, where the Cambridge–Te Awamutu Main Highway intersects the western boundary of the Leamington Town District; thence running southerly, easterly, and northerly along the boundaries of the said town district to the Waikato River; thence south-easterly and southerly up that river to the Mangare Stream, and westerly up that stream to a point in line with the south-western boundary of Section 7A, Tautari Settlement, in Block XV, Maungatautari Survey District; thence along a right line and the south-western boundary of Section 7A aforesaid to the south-eastern corner of Section 26, Tautari Settlement; thence in a northerly direction generally along the south-eastern boundary of Section 26 aforesaid, to and across a public road, and along the south-western boundary of Section 10A, Tautari Settlement, to the Waiteti Stream; thence down the Waiteti Stream to the Matamata County boundary; thence along the Matamata County boundary to the Maungatautari Trig. Station; thence in a south-westerly direction along a right line to the north-eastern corner of the Maungatautari No. 4G Block; thence along the south-eastern boundary of Maungatautari No. 4G and the south-eastern and south-western boundaries of Maungatautari No. 4G 2 Blocks; thence in a north-westerly direction generally along the south-western and north-western boundaries of Maungatautari No. 4H No. 8 Block and the north-eastern boundaries generally of Sections 10s, 5s, 4s, 2s, and 1s, all of Puahue Settlement, to the Mangapiko Stream; thence down the Mangapiko Stream to the Cambridge–Te Awamutu Main Highway; thence in a north-easterly direction along the Cambridge–Te Awamutu Main Highway to the point of commencement.

Authorizing the Laying-off of a Street (Kirkcaldie Street), in the City of Wellington, of a Width less than 66 ft. but not less than 50 ft., subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 5th day of December, 1945

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Wellington City Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet but not less than fifty feet, subject to the condition that no building or part of a building shall at any time be erected on parts Section 37, Karori District, being the land comprised and described in Certificates of Title, Volume 302, folio 267, Volume 127, folio 136, and Volume 185, folio 242 (Wellington Land Registry), fronting the said street within a distance of forty-eight feet from the centre-line of the said street.


SCHEDULE

THE proposed street in the Wellington Land District, City of Wellington, containing by admeasurement 3 roods 8·3 perches, more or less, being parts Section 37, Karori District, Block VI, Port Nicholson Survey District. As the same is more particularly delineated on the plan marked P.W.D. 122517, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
