The Northern Side of Portion of Mason’s Road, in the County of Clutha, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Clutha County Council on the twenty-eighth day of August, one thousand nine hundred and forty-five, viz.:

“ The Clutha County Council, being the local authority having control of the roads in the County of Clutha, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the northern side of the portion of Mason’s Road adjoining that part of part Section 13, Block VIII, Glenomaru, lying south-west of the Owaka-Purekireki Highway, being part of the land comprised in Certificate of Title, Volume 109, folio 213 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Mason’s Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE

THE northern side of all that portion of Mason’s Road situated in the Otago Land District, County of Clutha, fronting part Section 13, Block VIII, Glenomaru District. As the same is more particularly delineated on the plan marked P.W.D. 122351, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Varying a Condition as to setting back the Building-line of Portion of a Street known as Wade Street, in the City of Wellington, imposed by Order in Council under Section 117 of the Public Works Act, 1908

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the Order in Council dated the twenty-sixth day of March, one thousand nine hundred and seventeen, and published in the New Zealand Gazette No. 56 of the twenty-ninth day of the same month, at page 1122, and deposited in the Land Registry Office at Wellington as No. 759, exempting from the provisions of section one hundred and seventeen of the Public Works Act, 1908, inter alia, portion of Wade Street in the City of Wellington, by varying the condition with regard to the building-line imposed by the said Order in Council so that no building or part of a building shall at any time be erected on part Lot 1, D.P. 1198, being the land comprised and described in Certificate of Title, Volume 400, folio 137 (Wellington Land Registry), within a distance of twenty-five feet from the centre-line of the portion of Wade Street fronting the said part Lot 1, D.P. 1198.

Officers authorized to take and receive Statutory Declarations

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.

Notice of Intention to issue an Order in Council revoking the Reservation for Recreation Purposes over Reserves in Block XII, Christchurch Survey District, Canterbury Land District

WHEREAS by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928 (hereinafter referred to as “the said Act”), it is provided that the Governor-General may, from time to time, by Order in Council, revoke the reservation over any public reserve or part thereof, and thereupon the land comprised therein shall, if vested in the Crown or in any local authority, or trustees deriving title from the Crown, become Crown land available for disposal under the Land Act, 1924:

And whereas the lands described in the Schedule hereto are reserves duly set apart for recreation purposes, but are not required for that purpose, and it is expedient to revoke the reservation over the said lands:

Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby give notice, pursuant to subsection two of section seven of the said Act, that it is my intention to issue an Order in Council under the provisions of subsection one (b) of section seven of the said Act declaring that the reservation for recreation purposes over the lands described in the Schedule hereto shall be revoked.

CANTERBURY LAND DISTRICT

RESERVE 4470, Block XII, Christchurch Survey District: Area, 2 roods 6·8 perches, more or less.

Also Reserve 4471, Block XII, Christchurch Survey District: Area, 1 rood 30 perches, more or less.

Notice of Intention to issue an Order in Council revoking the Reservation for Recreation Purposes over Reserves in the City of Christchurch, Canterbury Land District

WHEREAS by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928 (hereinafter referred to as “the said Act”), it is provided that the Governor-General may, from time to time, by Order in Council, revoke the reservation over any public reserve or part thereof, and thereupon the land comprised therein shall, if vested in the Crown or in any local authority or trustees deriving title from the Crown, become Crown land available for disposal under the Land Act, 1924, and in any other case may, subject to the provisions of subsection five of the said section seven of the said Act, be disposed of in such manner and for such purposes as may be stated in such Order in Council:

And whereas the lands described in the Schedule hereto are recreation reserves which on the subdivision of private property for residential purposes were vested, in trust, for recreation purposes in the body corporate called the Mayor, Councillors, and Citizens of the City of Christchurch:

And whereas the reserves are not required for recreation purposes, and it is expedient that the reservation over the said lands be revoked:

And whereas the said body corporate has passed a resolution consenting to such revocation, and has in all respects complied with the provisions of subsections three and four of the said section seven of the said Act:

Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby give notice, pursuant to subsection two of section seven of the said Act, that it is my intention to issue an Order in Council under the provisions of subsection one (b) of the said section seven revoking the reservation for recreation purposes over the lands described in the Schedule hereto, and declaring that the said lands may be disposed of by the said body corporate by way of sale by public auction or private contract at such price and on such terms and conditions as the said body corporate shall determine, but so that the proceeds of any such sale shall be used and applied in or towards the purchase of other land for recreation purposes.

Lot 1, D.P. 6802, being part Rural Section 135, situated in the City of Christchurch: Area, 1 rood 4·4 perches, more or less.
