The South-eastern Side of Portion of Rosewarne Street, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government House at Wellington, this 7th day of November, 1945

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the seventh day of May, one thousand nine hundred and forty-five, viz. :—

“ The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the south-east side of Rosewarne Street adjoining Lots 32 and 33, D.P. 219, being the land contained in Certificate of Title, Volume 64, folio 287 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Rosewarne Street (described in the Schedule hereto) within a distance of forty-eight feet from the centre-line of the said portion of street.

SCHEDULE

THE south-eastern side of all that portion of street situated in the Canterbury Land District, City of Christchurch, known as Rosewarne Street, fronting Lots 32 and 33, D.P. 219, being part Rural Section 154. As the same is more particularly delineated on the plan marked P.W.D. 121738, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the sixteenth day of April, one thousand nine hundred and forty-five, viz. :—

“ The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the south-eastern side of Halton Street adjoining the land contained in Lot 1, D.P. 702, Certificate of Title, Volume 156, folio 189 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Halton Street (described in the Schedule hereto) within a distance of forty-eight feet from the centre-line of the said portion of street.

SCHEDULE

THE south-eastern side of all that portion of street situated in the Canterbury Land District, City of Christchurch, known as Halton Street, fronting Lot 1, D.P. 702, part Rural Section 135. As the same is more particularly delineated on the plan marked P.W.D. 122027, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Southern Side of Portions of Green Lane, in the Borough of Motueka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 7th day of November, 1945

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Motueka Borough Council on the twelfth day of June, one thousand nine hundred and forty-five, viz. :—

“ The Motueka Borough Council, being the local authority having control of the roads in the Borough of Motueka, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of Green Lane fronting Lot 19, D.P. 1512, being part Sections 181 N.R. and 182 N.R., Motueka District, Block III, Motueka Survey District ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portions of Green Lane (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portions of street.

SCHEDULE

THE southern side of all those portions of street situated in the Nelson Land District, Borough of Motueka, known as Green Lane, fronting Lot 19, D.P. 1512, being part Sections 181 and 182, Motueka Original. As the same are more particularly delineated on the plan marked P.W.D. 122350, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Portions of Roads, in the County of Waitaki, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waitaki County Council on the twenty-seventh day of April, one thousand nine hundred and forty-five, viz. :—

“ The Waitaki County Council, being the local authority having control of the roads in the Waitaki County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of the road abutting on the northern boundary of that part of Allotment 68 on plan of part of the Totara Estate, deposited in the Land Registry Office at Dunedin as No. 323, owned by one George McDonald, of Kai Ora, Farmer, nor to both sides of the road intersecting said part of Allotment 68, nor to the northern side of the road abutting on the southern boundary of that part of Allotment 66, said plan, owned by the said George McDonald ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side generally of the portion of road first described in the Schedule hereto, both sides of the portion of road secondly described in the Schedule hereto, and the northern side generally of the portion of road thirdly described in the Schedule hereto, within a distance of thirty-three feet from the centre-lines of the said portions of roads.

SCHEDULE

THE southern side generally of all that portion of road, in the Otago Land District, County of Waitaki, fronting part Lot 68, D.P. 323, Totara Estate.

All that portion of road, in the said land district and county, passing through part Lot 68, D.P. 323, Totara Estate.

The northern side generally of all that portion of road, in the said land district and county, fronting part Lot 66, D.P. 323, Totara Estate.

As the same are more particularly delineated on the plan marked P.W.D. 122265, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
