NOTICE is hereby given in pursuance of the Regulations Act, 1936, of the making of regulations and orders as under:—

Price Order No. 438 (Amending Price Order No. 367) (Toys)
PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following amending Price Order:—

This Order may be cited as Price Order No. 438, and shall be read together with and deemed part of Price Order No. 367† (hereinafter referred to as the principal Order).

This Order shall come into force on the 6th day of September, 1945.

The principal Order is hereby amended as follows:—
(a) By inserting in clause 2, before the definition of the word “Toys”, the following definition:—
“‘Net invoice cost’ means the cost of any article after deduction has been made of all cash discounts.”
(b) By adding to paragraph (a) of subclause (1) of clause 4 after the word “thereof” the following words: “where the terms of sale are ‘net’, or increased by an amount equal to 12·75 per cent. thereof where the terms of sale allow for a cash discount of not less than 2½ per cent. of the invoice cost.”
(c) By adding to paragraph (b) of subclause (1) of clause 4 after the word “thereof” the following words: “where the terms of sale are ‘net’, or increased by an amount equal to 28·2 per cent. thereof where the terms of sale allow for a cash discount of not less than 2½ per cent. of the invoice cost.”
(d) By inserting in subclause (1) of clause 5 before the word “invoice” the word “net.”
(e) By inserting in subclause (2) of clause 5 before the word “invoice” the word “net.”

Price Order No. 437 (Fish) (Oamaru)
PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:—

This Order may be cited as Price Order No. 437, and shall come into force on the 7th day of September, 1945.

(1) Price Orders No. 374† and 402‡ are hereby revoked.
(2) The revocation of the said Orders will not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.
- In this Order—
“Fillet”, in relation to any fish, means the descaled flesh of a fish from which the head and backbone have been removed:
“Licensed”, in relation to any fisherman, means licensed pursuant to the Industrial Efficiency Act, 1936.
APPLICATION OF THIS ORDER
- (1) This Order applies only with respect to fish taken by a licensed fisherman and acquired by a fish-wholesaler for the purposes of a business carried on by him within the Borough of Oamaru or acquired by a fish-retailer from a fish-wholesaler carrying on business as aforesaid, whether the business of the retailer is carried on within the Borough of Oamaru or elsewhere.
(2) Subject to the last preceding subclause, this Order applies with respect to—
(a) Sales by a licensed fisherman to a fish-wholesaler of any fish of a kind and in the state of preparation described or referred to in the First Schedule hereto:
(b) Sales by a fish-wholesaler to a fish-retailer or to any other person of any fish of a kind and in the state of preparation described or referred to in the Second Schedule hereto:
(c) Sales by a fish-retailer for consumption off the premises of the retailer of any fish of a kind and in the state of preparation described or referred to in the Third Schedule hereto.

The prices fixed by this Order apply with respect to sales by auction as well as to other sales.

The provisions of this Order shall apply notwithstanding that any fish to which this Order applies is sold otherwise than by weight.
FIXING MAXIMUM PRICES FOR FISH TO WHICH THIS ORDER APPLIES
Fishermen’s Prices
- (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any licensed fisherman for any fish to which this Order applies when sold to a fish-wholesaler shall be the appropriate maximum price specified in the First Schedule hereto.
(2) The several maximum prices fixed in the First Schedule hereto are fixed as for delivery within the Borough of Oamaru.
(3) Where delivery of any fish to which this Order applies is effected by a licensed fisherman elsewhere than within the Borough of Oamaru, the several maximum prices fixed in the First Schedule hereto shall be reduced by an amount equal to the difference between the cost (if any) incurred by him in effecting delivery and the cost that would have been incurred by him had delivery been effected at the premises of the fish-wholesaler within the Borough of Oamaru.
Wholesalers’ Prices
- (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any fish-wholesaler for any fish to which this Order applies, when sold to a fish-retailer or to any other person for delivery within the Borough of Oamaru, shall be the appropriate maximum price specified in the Second Schedule hereto.
(2) With respect to sales made by a fish-wholesaler to a fish-retailer or to any other person for delivery outside the Borough of Oamaru, the several maximum prices fixed in the Second Schedule hereto may be increased as follows:—
(a) By an amount not exceeding ½d. per pound where the wholesaler prepares and packs the fish for transport; and
(b) By the amount of the actual freight charges incurred by the wholesaler in effecting delivery to the retailer or to any other person, but not exceeding in any case the charges that would have been incurred by him if delivery had been effected by a common carrier at current freight rates.
- Except with the prior consent of the Tribunal, no additional charge for any fish shall be made by a fish-wholesaler on account of any preparation other than that described or referred to in the Second Schedule hereto.
Retailers’ Prices
- (1) Subject to the following provisions of this clause, the maximum prices that may be charged or received by any fish-retailer for any fish to which this Order applies shall be the appropriate maximum price specified in the Third Schedule hereto.
(2) The several maximum retail prices fixed in the Third Schedule hereto are fixed as for fish sold by a retailer whose place of business is situate within the Borough of Oamaru.
(3) Subject to the provisions of the next succeeding subclause where packing or freight charges are paid or payable by a retailer whose place of business is situate outside the Borough of Oamaru in obtaining delivery of any fish to his premises, the several maximum prices fixed in the Third Schedule hereto may be increased by a proportionate part of those charges.
