Vesting the Control of a Reserve in the Wellington Free Kindergarten Association (Incorp.)

At the Government House at Wellington, this 5th day of September, 1945
Present:
His Excellency the Governor-General in Council
WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for a site for a kindergarten:
And whereas it is expedient that the control of the said reserve should be vested in the Wellington Free Kindergarten Association (Incorp.):
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the said reserve in the Wellington Free Kindergarten Association (Incorp.).

SCHEDULE
WELLINGTON LAND DISTRICT
All that area in the City of Wellington, containing by admeasurement 1 rood 7·38 perches, more or less, being part of Town Belt adjoining Town of Wellington, bounded commencing at a point bearing 103° 14' 20" and distant 45·45 links from the southernmost corner of Section 758, Town of Wellington; thence along a right line bearing 13° 16' 40" distance 145·46 links; along an arc of radius 18·18 links turning in a north-easterly direction for 28·56 links;
along a right line bearing 103° 16' 40" distance 145·46 links; along an arc of radius 18·18 links turning in a south-easterly direction for 28·56 links; and along right lines bearing 193° 16' 40" distance 145·46 links and bearing 283° 16' 40" distance 181·82 links to the point of commencement. As the same is more particularly delineated on the plan marked L. and S. 6/1/167L, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

John Lowrie,
Edward William Hunt,
Edward Harry Dalkie,
William Edwin Terry,

to be the Ohai Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Friday, the twenty-eighth day of September, one thousand nine hundred and forty-five, at seven-thirty o'clock p.m., as the time when, and the Dressing-rooms, Ohai Domain, as the place where, the first meeting of the Board shall be held.

All that area containing by admeasurement 2 acres 2 roods 7·5 perches, more or less, being part of Lot 1 on plan deposited in the Land Registry Office at Invercargill as No. 2657, being also part of Section 94, Block III, Wairio District, and being all the land comprised in Certificate of Title, Volume 138, folio 294 (Invercargill Registry).

Also all that area containing by admeasurement 5 acres 2 roods 24 perches, more or less, being Lot 50 on plan deposited in the Land Registry Office at Invercargill as No. 2656, and Lot 1 on plan deposited in the said office as No. 2858, being also part of Section 94, Block III, Wairio District, and being all the land comprised in Certificate of Title, Volume 138, folio 258 (Invercargill Registry).

PURSUANT to the provisions of subsection three of section seventeen of the Servicemen's Settlement and Land Sales Act, 1943, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby appoint—
Warrington McCarter Taylor, Esquire, of Dunedin, Solicitor, the deputy of the Chairman of the Otago Land Sales Committee, to be also the deputy of Donald James Ross, Esquire, a member of that Committee.

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.

Notice of Intention to issue an Order in Council revoking the Reservation for Recreation Purposes over a Reserve in the City of Christchurch, Canterbury Land District
C. L. N. NEWALL, Governor-General
WHEREAS by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928 (hereinafter referred to as “the said Act”), it is provided that the Governor-General may, from time to time, by Order in Council, revoke the reservation over any public reserve or part thereof, and thereupon the land comprised therein shall, if vested in the Crown or in any local authority or trustees deriving title from the Crown, become Crown land available for disposal under the Land Act, 1924, and in any other case may, subject to the provisions of subsection five of the said section seven of the said Act, be disposed of in such manner and for such purposes as may be stated in such Order in Council:
And whereas the land described in the Schedule hereto is a recreation reserve which on the subdivision of private property for residential purposes was vested, in trust, for recreation purposes in the body corporate called the Mayor, Councillors, and Citizens of the City of Christchurch :
And whereas the reserve is not required for recreation purposes, and it is expedient that the reservation over the said land be revoked :
And whereas the said body corporate has passed a resolution consenting to such revocation, and has in all respects complied with the provisions of subsections three and four of the said section seven of the said Act :
Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby give notice, pursuant to subsection two of section seven of the said Act, that it is my intention to issue an Order in Council under the provisions of subsection one (b) of the said section seven revoking the reservation for recreation purposes over the land described in the Schedule hereto, and declaring that the said land may be disposed of by the said body corporate by way of sale by public auction or private contract at such price and on such terms and conditions as the said body corporate shall determine, but so that the proceeds of any such sale shall be used and applied in or towards the purchase of other land for recreation purposes.

CANTERBURY LAND DISTRICT
All that area containing by admeasurement 39 perches, more or less, being Lot 10, D.P. 10527, part Rural Section 302, situated in the City of Christchurch. As the same is more particularly delineated on the plan marked L. and S. 1/975R, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
