Extending the Open Season for the taking or killing of Opossums, Nelson Acclimatization District

ORDER IN COUNCIL

At the Government House at Wellington, this 29th day of August, 1945

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance of the powers conferred on him by the Animals Protection and Game Act, 1921–22, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby amend the Order in Council made under the said Act dated the first day of May, one thousand nine hundred and forty-five, and appearing in the New Zealand Gazette of the eleventh idem at page 479, by deleting the words “31st August” appearing under the heading “Nelson Acclimatization District” in the Schedule to such Order in Council, and contained in Condition Number One under the said heading, and by inserting in lieu thereof the words “15th September”:

And all licenses and permits issued to take or kill opossums in the Nelson Acclimatization District under the authority of the said Order in Council are hereby extended until noon on the said fifteenth day of September, one thousand nine hundred and forty-five.

The Eastern Side of Portion of Awahohonu Road, in the County of Horowhenua, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government House at Wellington, this 29th day of August, 1945

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Horowhenua County Council on the thirteenth day of July, one thousand nine hundred and forty-five, viz. :

“ That the Horowhenua County Council, being the local authority having control of the roads in the County of Horowhenua, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of Awahohonu Road fronting subdivision of Lots 7 and 8, D.P. 584, being part Awahohonu A 3 No. 2 and Awahohonu A 3 No. 3B, Block IX, Waitohu Survey District, and being the land comprised in Certificate of Title, Volume 80, folio 290 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of portion of Awahohonu Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.


SCHEDULE

THE eastern side of all that portion of road situated in the Wellington Land District, County of Horowhenua, known as Awahohonu Road, fronting Lots 7 and 8, D.P. 584, being part Awahohonu A 3 No. 2 and part Awahohonu A 3 No. 3 Blocks, Block IX, Waitohu Survey District. As the same is more particularly delineated on the plan marked P.W.D. 122067, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Gibraltar Crescent, in the City of Auckland, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the nineteenth day of July, one thousand nine hundred and forty-five, the side and portion of street affected by such resolution being more particularly described in the Schedule hereto, viz. :

“ The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Gibraltar Crescent, Parnell, fronting subdivision of part Allotment 3, Section 95, Suburbs of Auckland ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.


SCHEDULE

THE south-eastern side of all that portion of street in the North Auckland Land District, City of Auckland, known as Gibraltar Crescent, adjoining Lot 2 on D.P. 13842, being portion of Allotment 3, Section 95, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 122041, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section one hundred and sixty-seven of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vary an Order in Council made on the fourth day of April, one thousand nine hundred and thirty-two, and published in the Gazette on the seventh day of April, one thousand nine hundred and thirty-two, at page 735, and affecting Hauturu East B 2 Section 2A 1A and other blocks by excluding therefrom the lands described in the Schedule hereto.

WHEREAS the land described in the Schedule hereto was by Warrant published in Gazette of the thirty-first day of March, one thousand nine hundred and ten, permanently reserved for a site for a public hall and library : And whereas it is expedient that the control of the said reserve should be vested in a special Board as hereinafter provided :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the reserve described
