nine hundred and forty-five, the portion of road affected by such resolution being more particularly described in the Schedule hereto, viz. :—

“The Marlborough County Council, being the local authority having control of the roads in the County of Marlborough, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the northern portion of Hunter’s Road fronting subdivision of part Section 45, District of Wairau, Block VII, Cloudy Bay Survey District, and contained in the Certificate of Title, Volume 33, folio 5 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Hunter’s Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE

THE northern side of all that portion of road situated in the Marlborough Land District, County of Marlborough, known as Hunter’s Road, fronting part Section 45, District of Wairau, Block VII, Cloudy Bay Survey District. As the said portion of road is more particularly delineated on the plan marked P.W.D. 121359, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by an Order in Council dated the ninth day of November, one thousand nine hundred and fourteen, and published in Gazette of the twelfth day of that month, the Puhoi Domain Board was constituted and appointed to control the Puhoi Domain, in pursuance of section forty-seven of the Public Reserves and Domains Act, 1908 :

And whereas it is desired to change the name of the said Puhoi Domain to Puhoi Pioneers’ Memorial Park Domain :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred upon him by the Public Reserves, Domains, and National Parks Act, 1928, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the land described in the Schedule hereto shall, from and after the date hereof, be known as the Puhoi Pioneers’ Memorial Park Domain ; and, with the like advice and consent as aforesaid, doth hereby revoke the Order in Council dated the ninth day of November, one thousand nine hundred and fourteen, hereinbefore referred to, and doth hereby appoint

Herbert Russek,
Joseph Victor Schischka,
Leslie Joseph Schollum,
William John Schollum,
Lawrence Thomas Straka, and
John Joseph Wenzlick,

to be the Puhoi Pioneers’ Memorial Park Domain Board, having control of the land described in the Schedule hereto for the purposes of and subject to the provisions of the last-mentioned Act.

The first meeting of the said Board shall be held on Saturday, the thirtieth day of June, one thousand nine hundred and forty-five, at eight o’clock p.m., in the Puhoi Public Library, Puhoi.

NORTH AUCKLAND LAND DISTRICT.—PUHOI PIONEERS’ MEMORIAL PARK DOMAIN

ALL that area in the Rodney County, situated in Block XV, Mahurangi Survey District, containing by admeasurement 10 acres 1 rood 17 perches, more or less, being Lots 1 and 2 on D.P. 25246, and being part of Okahu Block and part Allotment 116, Puhoi Parish, and being the whole of the lands comprised and described in Certificates of Title, Volume 667, folio 188, and Volume 668, folio 39 (Auckland Land Registry). As the same is more particularly delineated on the plan marked L. and S. 1/547B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the land described in the First Schedule hereto is portion of a reserve duly set apart for an endowment in aid of the borough funds for the benefit of the Borough of Alexandra : And whereas it is expedient that the said land should be exchanged for the land described in the Second Schedule hereto, which the Governor-General deems of equal value and more suitable for the purposes of the reserve :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section eight of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that the land described in the First Schedule hereto may be exchanged for the land described in the Second Schedule hereto.

DESCRIPTION OF PORTION OF RESERVE AUTHORIZED TO BE EXCHANGED

Otago Land District

ALL that area containing 1 rood and 23·57 perches, more or less, being Lot 2, D.P. 5916 (Otago Registry), and being part of Section 12, Block XIV, Town of Alexandra. Bounded towards the west by Tarbert Street, 157·46 links ; towards the north by Lot 1, 262·32 links ; towards the south-east and east by Lot 5, D.P. 4328 (Otago Registry), 22·7 links and 137·41 links respectively ; and towards the south by Skird Street, 251·68 links : be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 16/2960, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured sepia.

DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR

Otago Land District

ALL that area containing 1 acre, more or less, being Sections 10 and 11, Block XXVI, Town of Alexandra. Bounded towards the north-west by Brandon Street, 300 links ; towards the north-east by railway reserve, 332·85 links ; towards the south-east by Section 12, 300 links ; and towards the south-west by a public street, 337·5 links : be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 16/2960, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured yellow.
