Notice by the Public Trustee under Part III of the Public Trust Office Act, 1908, and its Amendments

WHEREAS John McLeod, of Te Maire, near Taumarunui, Farmer, is the owner of the property described in the Schedule hereto: And whereas it is not known where the said John McLeod is or whether he is alive or dead: And whereas by an order made by the Supreme Court of New Zealand at Wellington on the 20th day of April, 1945, pursuant to the provisions of section 87 of the Public Trust Office Act, 1908, and its amendments, the Public Trustee was authorized to take possession of the said property and to exercise in respect thereof all or any of the powers set out in clauses (b), (e), (f), and (g) of subsection (1) of section 87 of the Public Trust Office Act, 1908: And whereas by the said order the Public Trustee was also authorized to complete and carry out in such manner as he might think fit a certain agreement for sale and purchase bearing date the 10th day of November, 1944, made between the said John McLeod, as vendor, of the one part, and Constance Beavis Dorothea Treacy, of Kaitieke, Married Woman, as purchaser, of the other part, being a valid subsisting contract affecting the said property, and to discharge any obligation attaching to the said property at the time the said property should come under the jurisdiction of the Public Trustee, and to execute in his own name and on behalf of the said John McLeod all deeds and other instruments which might be necessary for any of the purposes aforesaid, and to pay out of the moneys received by the Public Trustee in the exercise of any of the foregoing powers any debts that might be owing by the said John McLeod, including any debts incurred by the said John McLeod of and incidental to the said agreement for sale and purchase: And whereas it is provided by section 89 of the Public Trust Office Act, 1908, that on taking possession of any property under Part III of the said Act, the Public Trustee shall publish in the Gazette and in some newspaper circulating in the district where the property is situated a notice of his intention to exercise the powers conferred upon him by virtue of Part III of the said Act: Now, the Public Trustee gives notice of his intention to exercise the powers conferred upon him by the said order of the Supreme Court of New Zealand,

LAND

(1) All that piece of freehold land containing 235 acres 2 roods and 16·5 perches, more or less, situate in Block II, Owatua Survey District, and known as Waimarino C D No. 3A, and being the residue of the land comprised and described in certificate of title, Vol. 230, folio 75 (Wellington Land Registry), subject to the provisions of Part XIII of the Land Act, 1908, and to Memorandum of Mortgage Registered No. 128013 to the Bank of New Zealand.

(2) All that piece of freehold land containing 199 acres 3 roods and 23 perches, more or less, situate in Block II, Owatua Survey District, and known as Waimarino C D No. 3B 1, and being the whole of the land comprised and described in certificate of title, Vol. 231, folio 109 (Wellington Land Registry), subject to the provisions of Part XIII of the Land Act, 1908, and to Memorandum of Mortgage Registered No. 128013 to the Bank of New Zealand.

(3) All that piece of freehold land containing 50 acres, more or less, situate in Block II, Owatua Survey District, and known as Waimarino C D 3B No. 2A, and being the whole of the land comprised and described in certificate of title, Vol. 241, folio 275 (Wellington Land Registry), subject to the restrictions imposed by Part XIII of the Land Act, 1908, and section 74 of the Native Land Amendment Act, 1913, and to Memorandum of Mortgage No. 128013 to the Bank of New Zealand.

(4) All that piece of freehold land containing 74 acres 2 roods and 5 perches, more or less, situate in Block II, Owatua Survey District, being part Waimarino C D 3B 2B and Lot 2 on Deposited Plan No. 3952 (subject to the lands taken or affected by Proclamations Registered Nos. 1068, 2045, and 2046), and being the residue of the land comprised and described in certificate of title, Vol. 253, folio 259 (Wellington Land Registry), subject to the restrictions imposed by Part XIII of the Land Act, 1908, and section 74 of the Native Land Amendment Act, 1913, and to Memorandum of Mortgage Registered No. 128013 to the Bank of New Zealand.

(5) All that piece of freehold land containing 2 acres 3 roods and 9·7 perches, more or less, situate in Block II, Owatua Survey District, and known as Waimarino C D 3B 2B (subject to the land
