eastern boundary of the said Section 28, along a right line
across a public road, to and along the eastern and northern
boundaries generally of Section 3, the northern boundary of
Section 2, both of Block IX, Omapere Survey District, to
and along the north-eastern side of the road forming the
south-western boundary of Section 21, Block V, of the said
Omapere Survey District, along the eastern boundaries of
Sections 20 and 17, Block V aforesaid, a right line across a
public road, being the production of the eastern boundary
of the last-mentioned section, along the north-eastern side
of that road, to and along the eastern and north-eastern
boundaries of Sections 12 and part 10 of the said Block V,
a right line across another public road, to and along the
north-eastern boundary of another part Section 10 afore-
said, and the north-western boundaries of Sections 6 and 4,
Block V aforesaid, to and along the eastern side of a
public road forming part of the eastern boundary of Sec-
tion 2, Block V aforesaid, along the south-eastern and
north-eastern boundaries of part of the said Section 2, a
right line across a public road, to and along the north-
eastern boundary of another part of the said Section 2,
along a right line across railway land, and again along
the north-eastern boundary of another part of Section 2
aforesaid, and the abutment of a road, and a right line
being the production of the line of the abutment, to the
middle of the Whakanekeke River; thence down the
middle of that river and up the middle of the Waipapa
River and easterly generally up the middle of the Pukaea
Stream to the western boundary of Section 9, Block XIV,
Kaeo Survey District; thence generally along the southern
boundary of State forest (Gazette, 1933, page 3403),
crossing an intervening road to the Manginangina Trig.
Station; thence along the southern boundaries of Mangi-
nangina or Motukauri Block, the southern and south-eastern
boundaries of Section 4, Block XV, Kaeo Survey District,
and the south-western and eastern boundaries of Section 35,
Block XII, Kaeo Survey District; thence along the
generally western side of the road forming the eastern
boundaries of Sections 35 and 3 of the said Block XII,
Section 4, Block XI, and 31, Block XII aforesaid, along a
right line, being the production of the northern end of the
western side of the said road, across another public road,

THIRD SCHEDULE
RUSSELL RIDING, BAY OF ISLANDS COUNTY

ALL that area in the North Auckland Land District,
bounded by a line commencing in Block XV, Russell Survey
District, on the boundary of the Bay of Islands County, and
being the most westerly point on the western boundary of
Punaruku No. 2 Block, and running north-westerly
generally along the south-western boundaries of Waikare
and the south-western and southern boundaries of part
Karetu Blocks, to and along the southern side of the road
forming the northern boundary of Allotment 94, Ruapeka-
peka Parish, to its north-western corner; thence along a
right line across the said public road, to and along the
western boundary of another part of the said Karetu Block,
along a right line across another public road, to and again
along another part of the said western boundary to the
middle of the Karetu River; thence down the middle of
the said river and the middle of the Kawakawa River to
a point due east of the southern corner of Awahe Block;
thence along a right line to the said southern corner, and
along the south-western boundary of the said Awahe Block,
the south-western boundary of Allotment 204, Kawakawa
Parish, part of the southern boundary of Ngamokooneone
No. 2 Block, a right line across a public road, to and along

another part of the said southern boundary, a right line
across the said public road, to and along another part of
the said southern boundary, along the southern and north-
western boundaries of Waimangaro Block, along the south-
western and north-western boundaries of Allotment 195,
Kawakawa Parish, and the last-mentioned boundary pro-
duced across a public road to the shore of the Bay of
Islands, along the said shore to the south-western boundary
of a foreshore reserve, along the said south-western boundary,
the south-western boundaries of Section 13, Block VIII,
Kawakawa Survey District, and part Lot 15 on D.P.
14689, being part of Old Land Claim 251, and along a
right line from the western corner of the said part Lot 15
to the northern corner of Allotment 138, Kawakawa Parish;
thence along the northern boundary of that Allotment, the
eastern and northern boundaries of Allotment 137 of the
said parish and the northern boundary of Section 15, Block VII,
Kawakawa Survey District, to and along part of the
north-eastern boundary of the part Old Land Claim 245,
containing 220 acres, a right line across a public road, to
and along another part of the said portion of the old land
claim, and that boundary produced across the Waitangi
River to its northern bank; thence generally north-easterly,
along the said northern bank and the northern shores of
Waitangi Bay to the point opposite to Ti Point, along a
line across the Bay of Islands (excluding Moturoa Island)
to Howe Point, and along the shore of the said Bay of
Islands to Cape Wiwiki, a point on the county boundary as
described in the Second Schedule; thence easterly and
southerly along the said county boundary to the point of
commencement, and including therein all outlying islands
situated between the mouth of the Waitangi River and the
Whangarei County boundary.

issued under the Seal of that Dominion, this 30th

Authorizing the Borrowing by the Dargaville Borough Council by Way
of Hypothecation of Debentures issued in respect of a Loan of
£5,000

ORDER IN COUNCIL

At the Government House at Wellington, this 23rd day of
May, 1945

Present:

His Excellency the Governor-General in Council

WHEREAS by Order in Council made on the twenty-third
day of May, one thousand nine hundred and forty-five,
consent was given to the raising in New Zealand by the Dargaville
Borough Council (hereinafter called “the said local authority”)
of a loan of five thousand pounds (£5,000), to be known as “Sewerage
Assistance Loan, 1942” (hereinafter called “the said loan”), such
consent being given subject to the determinations as to borrowing
and repayment therein set out, including, inter alia, the provision
that the rate of interest that might be paid in respect of the said loan
or any part thereof should be such as should not produce to the
lender or lenders a rate or rates exceeding three pounds ten shillings
(£3 10s.) per centum per annum :

And whereas the said local authority, pending the raising of the
said loan in accordance with the said determinations, is desirous of
borrowing the said amount of five thousand pounds (£5,000), or
part thereof by hypothecation or mortgage pursuant to section
thirty-four of the Local Bodies’ Loans Act, 1926, of the debentures
authorized to be issued in respect of the said loan :

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, and in pursuance
and exercise of the powers and authorities conferred on him by
section seven of the Local Authorities Interest Reduction and Loans
Conversion Act, 1932–33, and by section eight of the Local
Authorities Interest Reduction and Loans Conversion Amendment
Act, 1933, and of all other powers and authorities enabling him in
this behalf, doth hereby consent to the said local authority, pending
the raising of the said loan in accordance with the said determinations,
borrowing the said amount of five thousand pounds (£5,000), or
any part thereof by the hypothecation or mortgage, of the said
debentures at a rate of interest not exceeding four pounds (£4) per
centum per annum, and hereby prescribes that the said local authority
shall, before the said amount or any portion thereof is borrowed by
way of hypothecation pursuant to the authority of this Order in
Council, establish a sinking fund, and shall thereafter make payments
to such sinking fund in accordance with clause three of the aforesaid
Order in Council of the twenty-third day of May, one thousand nine
hundred and forty-five, and in all respects as if such borrowing of
the said amount or part thereof by way of hypothecation were the
raising of a loan within the meaning of that clause.
