Notice respecting Proposed Constitution of Borough of Kaitaia

Department of Internal Affairs,
Wellington, 30th April, 1945.

IT is hereby notified that a petition has been presented to His Excellency the Governor-General, under the Municipal Corporations Act, 1933, praying that the area described in the Schedule hereto may be constituted as the Borough of Kaitaia.

All persons affected are hereby called upon to lodge any written objections to or petitions against the proposed constitution of such borough which they desire to lodge within one month from the first publication of this notice, such objections or petitions to be addressed to the Minister of Internal Affairs, Wellington.

SCHEDULE

AREA PROPOSED TO BE CONSTITUTED AS THE BOROUGH OF KAITAIA

ALL that area in the North Auckland Land District of approximately 1,300 acres, bounded by a line commencing at the easternmost corner of part Lot 4B on D.P. 24412, and running south-easterly along the south-western side of the Great North Road to its intersection with a right line, being the production westward of the northern boundary of Lot 1, on Deeds Plan 678; thence easterly along the said right line, across the said Great North Road, to and along the north boundary of Lots 1 and 4 on the said Deeds Plan 678, parts of Lot 6 comprised in Certificates of Title, Volume 756, folios 96 and 95, and along the northern boundary of Lot 5 on the said Deeds Plan 678; thence southerly along the eastern boundary of the said Lot 5 and a right line, being the production of the said eastern boundary, across Donald’s Road to its southern side, the aforesaid lots being part of Old Land Claim 214; thence easterly along the southern side of the aforesaid road to the north-western corner of Lot 2 on D.P. 9413, being part of Allotment 23, Awanui Parish; thence again generally southerly along the western boundary of the said Lot 2, the western, south-western, and south-eastern boundaries of part Lot 23 on D.P. 405, and the south-western boundary of Lot 4 on D.P. 15252 to the south-eastern corner of Lot 6 on the said D.P. 15252; thence along a right line across a public road to the angle opposite and along the western side of that road to the point in line with the eastern boundary of Lot 2 on D.P. 393, along a right line across the said road, to and along the generally south-western boundary of Lot 4 on D.P. 15252 aforesaid to the angle in Church Road on the southern boundary of Lot 7 on D.P. 393; thence along a right line across Church Road aforesaid to the angle opposite and along the western side of the aforesaid road to and along the northern boundary of Lot 24 on D.P. 405, and a right line being its production across the Awanui River and along its left bank to the north-western boundary of Lot 28 on the said D.P. 405; thence along the north-western boundary of the said Lot 28, across a public road, to and along the north-western boundary of Lot 30 on the said D.P. 405 to a public road; thence north-westerly along the north-eastern side of that road to the westernmost corner of Lot 29 on the said D.P. 405, the aforesaid lots being part of Old Land Claim 242; thence generally southerly and westerly along a right line across the said public road, to and along the north-western and northern boundaries of Allotment 60, Ahipara Parish, to the westernmost corner of Allotment 81 of the said parish; thence along a right line being the production of the last-mentioned boundary, across another public road, and along a right line bearing 295° 29' distant 1046·1 links; thence northerly generally along another right line bearing 14° 22' 30" distant 1753·1 links to the westernmost corner of Section 17, Block V, Takahue Survey District; thence along the north-western boundary of the said Section 17, and along a right line from its northern corner to the intersection of the left bank of Tarawhaturua Stream with the north-eastern boundary of part Old Land Claim 7 as shown on D.P. 11562; thence along the said north-eastern boundary crossing the said Tarawhaturua Stream and a public road, and along the north-eastern boundary of another part of Old Land Claim 7, as shown on D.P. 13320, to its northern corner; thence along a right line bearing 38° 30' along the south-eastern boundary of Lot 1, D.P. 19912, and passing through Lots 3, 4, and 2 on D.P. 29054, to and across the Awanui River, and along its right bank to the southern corner of part Lot 4B on D.P. 24412, being part of Old Land Claim 214; thence along the south-eastern boundary of the said Lot 4B to the point of commencement.

The foregoing notice supersedes the notice published in Gazette No. 20 of 22nd March, 1945, at page 314, purporting to be a notice in the same terms as the foregoing, and the purported copy so published is therefore to be treated as cancelled.

Notice of Intention to take Additional Land in the Township of Fitzherbert for the Massey Agricultural College

NOTICE is hereby given that it is proposed, under the provisions of the Public Works Act, 1928, to take the additional land described in the Schedule hereto for the Massey Agricultural College: And notice is hereby further given that the plan of the land so required to be taken is deposited in the post-office at Palmerston North and is there open for inspection; and that all persons affected by the taking of the said land should, if they have any well-grounded objections to the taking of such land, set forth the same in writing, and send such writing, within forty days from the first publication of this notice, to the Minister of Works at Wellington.

The Tobacco Factories’ Employees’ Labour Legislation Suspension Order 1945

IN pursuance of the Labour Legislation Emergency Regulations 1940, and of the Industrial Man-power Emergency Regulations 1944, the Minister of Labour doth hereby order as follows:—

  1. This Order may be cited as the Tobacco Factories’ Employees’ Labour Legislation Suspension Order 1945.

  2. This Order applies to W. D. and H. O. Wills (N.Z.), Limited, and to Godfrey Phillips (N.Z.), Limited, and to the workers who are employed in the Wellington Industrial District by those companies and whose employment is subject to the provisions of the Northern, Wellington, and Nelson Tobacco Workers’ award dated the 23rd day of June, 1944, and recorded in 44 Book of Awards 332.

  3. The provisions of all Acts and regulations thereunder and of the said award are hereby suspended in so far as any such provisions operate to prevent the workers referred to in clause 2 hereof from being employed on the terms and conditions herein set forth.

  4. The weekly hours of work shall be forty-five, and the daily hours shall be as mutually agreed upon in respect of each factory between the management and the workers’ union, the starting time on each day to be not earlier than 7.45 a.m.

  5. All time worked in excess of eight hours on any one day shall be paid for at the rate of time and a half for the first four hours and double time thereafter.

  6. Hours of work in excess of those herein prescribed may be worked by agreement between the management and the workers, payment for such hours being made in accordance with the provisions of the award.

  7. On the application of any female worker the management may, subject to the approval of the Man-power Officer, grant such exemption from the hours of work hereinbefore prescribed as the circumstances of such worker may warrant, having regard to the domestic responsibilities of such worker.

  8. In all other respects the provisions of the said award shall apply.

  9. This Order shall come into effect on the day of the date hereof, and shall continue in force until the 21st day of December, 1945.
