April, 1945

Present:

THE HON. W. NASH PRESIDING IN COUNCIL

Pursuant to section five of the Native Purposes Act, 1937,
His Excellency the Governor-General, acting by and with
the advice and consent of the Executive Council, doth hereby set
apart and reserve the Native freehold land described in the Schedule
hereto as a Native reservation for the common use of the owners
thereof for the purpose of an urupa and a place of historical interest.

Pursuant to section five of the Native Purposes Act, 1937,
His Excellency the Governor-General, acting by and with
the advice and consent of the Executive Council, doth hereby set
apart and reserve the Native freehold land described in the Schedule
hereto as a Native reservation for the common use of the Ngati-Tu
hapu of the Nga-Ruahine Tribe as a fishing reserve and landing-place.

SCHEDULE

All that parcel of land situate in the Taranaki Land District,
containing 20 acres 1 rood, more or less, known as Waiohata (Grant
3670), being Section 69, Block VI, Waitmate Survey District.

The Samoa Land for Defence Purposes Order 1945

At the Government House at Wellington, this 18th day of
April, 1945

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

In pursuance of the Samoa Act, 1921, and the Samoa Land
Emergency Regulations 1944, His Excellency the Governor-
General, acting by and with the advice and consent of the
Executive Council, doth hereby make the following Order.

ORDER

  1. This Order may be cited as the Samoa Land for Defence
    Purposes Order 1945.

  2. This Order shall come into force on the day following the
    date of its publication in the Western Samoa Gazette.

  3. (1) The Native land in Samoa described in the First
    Schedule hereto shall be and the same is hereby taken for defence
    purposes and vested in His Majesty as from the date of the coming
    into force of this Order free from all estates, rights, and interests
    of other persons therein.

(2) The agreements described in the Second Schedule hereto
shall be deemed to be agreements between the persons entitled to
compensation and the Administrator within the meaning of sub-
clause (3) of Regulation 4 of the Samoa Land Emergency Regulations
1944.

  1. The Crown land in Samoa described in the Third Schedule
    hereto is hereby set aside as a reserve for defence purposes.

  2. The European land in Samoa described in the Fourth
    Schedule hereto shall be and the same is hereby taken for defence
    purposes and vested in His Majesty as from the date of the coming
    into force of this Order free from all estates, rights, and interests
    of any other person therein.

FIRST SCHEDULE

All that piece or parcel of land containing an area of 1,387 acres,
more or less, situated at Satuimalufilufi and Satapuala, in the
District of A'ana, described as part Parcel 97, Flur XV, Upolu, and
more particularly shown bordered green on Plan 25 U/XVL,
lodged in the office of the Chief Surveyor at Apia.

SECOND SCHEDULE

(a) Agreement made the 25th day of May, 1942, between the
Administrator of Western Samoa for and on behalf of His Majesty
the King of the one part and the Samoan inhabitants of the villages

of Satapuala of the other part regarding land taken for defence
purposes and land to be given in exchange therefor, a copy whereof
is deposited in the office of the Secretary of Native Affairs in Samoa.

(b) Agreement made the 13th day of May, 1942, between
the Administrator of Western Samoa for and on behalf of His
Majesty the King of the one part and the Samoan inhabitants of
the villages of Satuimalufilufi of the other part regarding land taken
for defence purposes and land to be given in exchange therefor, a
copy whereof is deposited in the office of the Secretary of Native
Affairs in Samoa.

THIRD SCHEDULE

(a) All that piece or parcel of land containing an area of 49 acres
2 roods 7 perches, more or less, situated at Toloa, in the District
of A'ana, described as part of Parcel 97, Flur XV, Upolu, being all
the land in Court Grant No. 1013, now registered in Vol. 4, folio
236, of the Land Register of Western Samoa, and shown on Plan
20 U/XVL, lodged in the office of the Chief Surveyor at Apia.

(b) All that piece or parcel of land containing an area of
2 acres 2 roods 22 perches, more or less, situated at Tifitifi, in the
District of A'ana, described as part of Parcel 97, Flur XV, Upolu,
being all the land in Court Grant No. 898, now registered in Vol. 4,
folio 179, of the Land Register of Western Samoa, and shown on
Plan 21 U/XVL, lodged in the office of the Chief Surveyor at Apia.

(c) All that piece or parcel of land containing an area of
6 acres 3 roods 20 perches, more or less, situated at Fa'eleolo, in the
District of A'ana, described as part of Parcel 97, Flur XV, Upolu,
being all the land in Court Grant No. 905, now registered in Vol. 2,
folio 106, of the Land Register of Western Samoa, and shown on
Plan 21 U/XVL, lodged in the office of the Chief Surveyor at Apia.

(d) All that piece or parcel of land containing an area of
4 acres 3 roods, more or less, situated at Fa'eleolo, in the District of
A'ana, described as part of Parcel 97, Flur XV, Upolu, being all
the land in Court Grant No. 1022, now registered in Vol. 4, folio 241,
of the Land Register of Western Samoa, and shown on Plan 21
U/XVL, lodged in the office of the Chief Surveyor at Apia.

(e) All that piece or parcel of land containing an area of
13 acres 2 roods 20 perches, more or less, situated at Fa'eleolo, in the
District of A'ana, described as part of Parcel 97, Flur XV, Upolu,
being all the land in Court Grant No. 913, now registered in Vol. 4,
folio 183, of the Land Register of Western Samoa, and shown on
Plan 21 U/XVL, lodged in the office of the Chief Surveyor at Apia.

(f) All that piece or parcel of land containing an area of
22 acres 3 roods 10 perches, more or less, situated at Fa'eleolo, in the
District of A'ana, described as part of Parcel 97, Flur XV, Upolu,
being all the land in Court Grant No. 1023, now registered in Vol. 4,
folio 242, of the Land Register of Western Samoa, and shown on
Plan 21 U/XVL, lodged in the office of the Chief Surveyor at Apia.

(g) All that piece or parcel of land containing an area of
20 perches, more or less, situated at Satapuala, in the District of
A'ana, described as part of Parcel 97, Flur XV, Upolu, being all the
land in Court Grant No. 665, now registered in Vol. 4, folio 44, of
the Land Register of Western Samoa, and shown on Plan 22
U/XVL, lodged in the office of the Chief Surveyor at Apia.

(h) All that piece or parcel of land containing an area of
3 acres 2 roods, more or less, situated at Fa'eleolo, in the District of
A'ana, described as part of Parcel 97, Flur XV, Upolu, being all the
land in Court Grant No. 622, now registered in Vol. 4, folio 13, of
the Land Register of Western Samoa, and shown on Plan 21 U/XVL,
lodged in the office of the Chief Surveyor at Apia.

(i) All that piece or parcel of land containing an area of
11 acres 2 roods 30 perches, more or less, situated at Fa'eleolo, in the
District of A'ana, described as part of Parcel 97, Flur XV, Upolu,
being all the land in Court Grant No. 788, now registered in Vol. 4,
folio 135, of the Land Register of Western Samoa, and shown on
Plan 21 U/XVL, lodged in the office of the Chief Surveyor at Apia.

(j) All that piece or parcel of land containing an area of 3 acres
0 roods 10 perches, more or less, situated at Fa'eleolo, in the District
of A'ana, described as part of Parcel 97, Flur XV, Upolu, being all
the land in Court Grant No. 163, now registered in Vol. 2, folio 296,
of the Land Register of Western Samoa, and shown on Plan 21
U/XVL, lodged in the office of the Chief Surveyor at Apia.

(k) All that piece or parcel of land containing an area of
7 acres 2 roods 30 perches, more or less, situated at Fa'eleolo, in the
District of A'ana, described as part of Parcel 97, Flur XV, Upolu,
being all the land in Court Grant No. 1015, now registered in Vol. 1,
folio 30, of the Land Register of Western Samoa, and shown on
Plan 21 U/XVL, lodged in the office of the Chief Surveyor at Apia.

FOURTH SCHEDULE

(a) All that piece or parcel of land containing an area of 130 acres
2 roods 13 perches, more or less, situated at Magia, in the District of
A'ana, described as Court Grant No. 861, Flur XV, Upolu, being all
the land now registered in Vol. 4, folio 166, of the Land Register of
Western Samoa, and shown on Plans 22 U/XVL and 24 U/XVL,
lodged in the office of the Chief Surveyor at Apia.

(b) All that piece or parcel of land containing an area of
235 acres 0 roods 8 perches, more or less, situated at Magia, in the
District of A'ana, described as Court Grant No. 894, Flur XV, Upolu,
being all the land now registered in Vol. 4, folio 178, of the Land
Register of Western Samoa, and shown on Plans 23 U/XVL and
24 U/XVL, lodged in the office of the Chief Surveyor at Apia.

(c) All that piece or parcel of land containing an area of
31 acres 0 roods 10 perches, more or less, situated at Fa'eleolo, in the
District of A'ana, described as Court Grant No. 893, Flur XV,
Upolu, being all the land now registered in Vol. 4, folio 177, of
the Land Register of Western Samoa, and shown on Plan 21
U/XVL, lodged in the office of the Chief Surveyor at Apia.
