Electric-power Board's Loan of £14,000 and prescribing the Conditions thereof

WHEREAS by Order in Council made on the eleventh day of August, one thousand nine hundred and thirty-eight, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Wairere Electric-power Board (hereinafter called "the said local authority") of the sum of fourteen thousand pounds (£14,000), to be known as "Reticulation Loan, 1938" (hereinafter called "the said loan"); And whereas the authority conferred by the said Order in Council has not been exercised to the extent of one thousand pounds (£1,000): And whereas the authority has lapsed in accordance with the provisions of clause six of the said Order in Council, and it is not now lawful or competent for the said local authority to raise this amount or any portion thereof except in accordance with the provisions of a further Order in Council that may be issued pursuant to section eleven of the Local Government Loans Board Act, 1926 (hereinafter called "the said Act"):
And whereas the said local authority is desirous of raising the balance amounting to one thousand pounds (£1,000) (hereinafter called "the said sum"), and it is expedient to authorize the said local authority to raise the said sum on the conditions hereinafter set out:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said sum up to the amount of one thousand pounds (£1,000) for the purpose for which the said loan was authorized, and in giving such consent doth hereby determine as follows:—
(1) The term for which the said sum or any part thereof may be borrowed shall not exceed twenty (20) years.
(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds seven shillings and sixpence (£3 7s. 6d.) per centum per annum.
(3) The said sum or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the term as determined in (1) above.
(4) The payment of such instalments shall be made in New Zealand, and no such instalments shall be paid out of loan-moneys.
(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the borrowing of the said sum or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.
(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Pursuant to the provisions of section eight of the Waitangi Endowment Act, 1932–33, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby direct that the lands described in the Schedule hereto, being lands which are vested in the Crown and which adjoin the lands described in the Schedule to that Act, shall hereafter be subject to that Act.
SCHEDULE
ALL that area in the Bay of Islands County, North Auckland Land District, containing by admeasurement 84 acres 14 perches, more or less, being Section 7, Block III, Kawakawa Survey District, and being all the land comprised in Certificate of Title, Volume 285, folio 270 (Auckland Registry).

Vesting the Control of a Reserve in the Tasman Public Hall Board

ORDER IN COUNCIL

Present:
THE HON. W. NASH PRESIDING IN COUNCIL
WHEREAS the land described in the Schedule hereto is a reserve duly set apart for a hall-site: And whereas it is expedient that the control of the said reserve should be vested in a special Board as hereinafter provided:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the reserve described in the Schedule hereto for the period of five years from the date hereof (unless previously amended or revoked under the said Act) in the undermentioned persons, namely:—
Thomas Blundell,
William Boult Easton,
Leonard James Hayward,
John McLauchlan, and
Arthur Rowling,
who are hereby constituted for that purpose a special Board by the name of the Tasman Public Hall Board (hereinafter referred to as "the Board"), with the powers and subject to the conditions hereinafter contained, that is to say:—
- The Board shall meet for the transaction of business on the first day in each quarter, at eight o'clock p.m., at the Rifle Club Hall, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Tuesday, the tenth day of April, one thousand nine hundred and forty-five.
- The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.
- Special meetings may be convened by the Chairman, provided that two days' notice of any such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.
- Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.
- If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman of such meeting.
- If by resignation, death, incapacity, or otherwise the seat of any member shall be or become vacant, or if any member absents himself without reasonable cause from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.
- All questions shall be determined by the majority of votes of the members of the Board present at a meeting.
- The Board shall have prepared and submitted at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.
- The Board shall control the said reserve and any building erected thereon for the purposes of a public hall, and shall also afford settlers and residents of Tasman and the surrounding district such facilities for meeting within the said hall as may from time to time be determined by the Board: Provided that the Board shall have power to fix reasonable charges for the use of the said hall.
