The Northern Side of Portion of Heberden Avenue, in the Borough
of Sumner, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the
Building-line

At the Government Buildings at Wellington, this 26th day of
March, 1945
Present:
THE HON. W. NASH PRESIDING IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of every other power in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Sumner Borough Council
on the twenty-fourth day of October, one thousand nine hundred
and forty-four, viz. :—
“That the Sumner Borough Council, being the local
authority having control of the streets in the Borough of Sumner,
by resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not apply
to the northern side of Heberden Avenue, adjoining the land
comprised in C.T. 311/246, being Lot 6, D.P. 2824, part R.S. 144,
Borough of Sumner ”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the northern side of
the portion of Heberden Avenue (described in the Schedule hereto)
within a distance of thirty-three feet from the centre-line of the said
portion of street.
SCHEDULE
THE northern side of all that portion of street situated in the Canter-
bury Land District, Borough of Sumner, known as Heberden Avenue,
fronting Lot 6, D.P. 2824, and being part R.S. 144, Borough of
Sumner. As the said portion of street is more particularly delineated
on the plan marked P.W.D. 121178, deposited in the office of the
Minister of Works at Wellington, and thereon coloured red.

to the western side of the portion of the Dargaville-Tikinui
Main Highway adjoining parts of Mangawhare Block, and Lot 4,
D.P. 8710, being part of Mangawhare Block, and being the land
in Certificates of Title, Volume 178, folio 65, Volume 764,
flio 162, and Volume 213, folio 23 (Auckland Registry) ”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the western side of
portion of Dargaville-Tikinui Main Highway (described in the
Schedule hereto) within a distance of thirty-three feet from the
centre-line of the said portion of street.
SCHEDULE
THE western side of that portion of the Dargaville-Tikinui Main
Highway, situate in the North Auckland Land District, Borough of
Dargaville, known as the main Dargaville-Aratapu Road, fronting
Lot 4, D.P. 8710, being part of the block situated in the Maungakawa
Survey District called Mangawhare, portion of block situated in the
Kaihu Survey District called Mangawhare, being all the land on
D.P. 6898, and part of Mangawhare Block in the Borough of Darga-
vile. As the same is more particularly delineated on the plan marked
P.W.D. 120136, deposited in the office of the Minister of Works at
Wellington, and thereon coloured red.

Trustees of Te Aroha Public Cemetery appointed

PURSUANT to section fifty-five of the Cemeteries Act, 1908,
I, Cyril Louis Norton Newall, the Governor-General of the
Dominion of New Zealand, do hereby appoint the Te Aroha Borough
Council to be the trustees of the cemetery, within the meaning of the
said Act, known as the Te Aroha Public Cemetery, being the land
described in the Schedule hereto, and to have the control and
management thereof.

TE AROHA PUBLIC CEMETERY.—AUCKLAND LAND DISTRICT
SECTION 8A, Block XI, Aroha Survey District: Area, 10 acres
1 rood, more or less.
