The Southern Side of Portion of Harman’s Road and the Northern
Side of Portion of Dalley’s Lane, in the Borough of Lyttelton,
exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to Conditions as to the Building-lines

At the Government House at Wellington, this 14th day of
March, 1945
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
approve of the following resolution passed by the Lyttelton Borough
Council on the eleventh day of December, one thousand nine
hundred and forty-four, the sides and portions of streets affected by
the resolution being more particularly described in the Schedule
hereto, viz. :—

“ The Lyttelton Borough Council, being the local authority
having control of the roads in the Borough of Lyttelton, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the southern side of portion of Harman’s Road or to
the northern side of portion of Dalley’s Lane adjoining C.T.
186/1 (Lot 3, D.P. 1503, part R.S. 247, part R.S. 266, part
T.S. 264, part T.S. 265, part T.S. 266, and part T.S. 267,
Borough of Lyttelton) ” ;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the southern side of
portion of Harman’s Road or the northern side of portion of Dalley’s
Lane (described in the Schedule hereto) within a distance of thirty-
three feet from the centre-lines of the said portions of streets.

SCHEDULE

THE southern side generally of all that portion of street in the
Canterbury Land District, Borough of Lyttelton, known as Harman’s
Road, fronting parts of Town Sections 264, 265, 266, and 267, and
part of Rural Sections 247 and 266, and being Lot 3 on D.P. 1503.

Also the northern side generally of all that portion of street in
the said land district and borough, known as Dalley’s Lane, fronting
parts of Town Sections 264, 265, 266, and 267, and part of Rural
Sections 247 and 266, and being Lot 3 on D.P. 1503.

As the same are more particularly delineated on the plan
marked P.W.D. 120715, deposited in the office of the Minister of
Works at Wellington, and thereon coloured red.

IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Southland County Council
on the eighth day of September, one thousand nine hundred and
forty-four, the sides and portions of roads affected by the resolu-
tion being more particularly described in the Schedule hereto,
viz. :—

“ The Southland County Council, being the local
authority having control of the roads in the County of South-
land, by resolution declares that the provisions of section
one hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to the eastern and northern, western and
southern sides of the portion of road adjoining Sections 64 and
65 and Lot 1, D.P. 305, being part Section 42, Block IV, and
comprised in Certificates of Title, Volume 4, folio 17, 34/156,
and 128/228, and to the eastern side of the portion of road
adjoining D.P. 278, being part Section 93, Section 98, Lot 4,
D.P. 305, being parts Sections 45, 63, 100, and 101R, Block IV
(C’s/T. 144/40 and 128/228), and to the northern and southern
sides of the portion of road adjoining Sections 76, 77, 78, 94, 95,
and 96, Block IV (C/T. 144/40), and to the northern side of the
portion of road adjoining Sections 71, 72, 73, 74, and 75, Block IV
(C’s/T. 29/118, 29/106, 29/150, and 60/247), and to the southern
side of the portion of road adjoining Sections 71, 72, 73, and 74,
Block IV, Sections 72 and 73, and D.P. 401, being part Section 73,
Block III (C’s/T. 29/118, 29/106, 29/150, 60/247, 60/170,
and 144/40), and to the eastern and western sides of the
portion of road adjoining Section 73 and D.P. 401, being part
Section 73, Block III (C’s/T. 60/170 and 144/40), and to
the southern and eastern sides of the portion of road adjoining
Sections 29, 60, and closed road, Block III (C’s/T. 39/216
and 39/214), Tuturau Survey District ” ;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the sides and the portions
of roads (described in the Schedule hereto) within a distance of
thirty-three feet from the centre-lines of the said portions of roads.

SCHEDULE

ALL those portions of road in the Southland Land District, County
of Southland, passing through Sections 64 and 65 and Lot 1,
D.P. 305, being part Section 42, Block IV, Tuturau Survey District.

Also the eastern side of all that portion of road in the said
land district and county adjoining Section 98 and part Sections
93, 100, 45, 63, and 101R, Block IV, Tuturau Survey District.

Also all that portion of road in the said land district and county
adjoining or passing through Sections 76, 77, 78, 94, 95, and 96,
Block IV, Tuturau Survey District.

Also the northern side of all that portion of road in the said
land district and county adjoining or passing through Sections
71, 72, 73, 74, and 75, Block IV, Tuturau Survey District.

Also the southern side of all that portion of road in the said
land district and county adjoining or passing through Sections
71, 72, 73, and 74, Block IV, Tuturau Survey District, Sections
72 and 73, Block III, Tuturau Survey District.

Also all that portion of road in the said land district and county
adjoining or passing through Section 73, Block III, Tuturau Survey
District.

Also the southern side generally of all that portion of road in
the said land district and county adjoining or passing through
Sections 29 and 60 and closed road, Block III, Tuturau Survey
District.

As the same are more particularly delineated on the plan
marked P.W.D. 120251, deposited in the office of the Minister of
Works at Wellington, and thereon coloured red.

Provisions of Section 128 of the Public Works Act, 1928, subject
to a Condition as to the Building-line

IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Nelson City Council on the
eighth day of February, one thousand nine hundred and forty-five,
viz. :—

“ That the Nelson City Council, being the local authority
having control of the streets in the City of Nelson, by resolution
declares that the provisions of section one hundred and twenty-
eight of the Public Works Act, 1928, shall not apply to the
portion of the unnamed street lying between and adjoining
Section 392A and part of Section 392B, City of Nelson, as shown
on the plan annexed to this resolution in the Council’s
minute-book ” ;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the said portion of
street (described in the Schedule hereto) within a distance of
thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

ALL that portion of an unnamed street in the Nelson Land District,
City of Nelson, fronting Section 392A and part Section 392B, City
of Nelson. As the same is more particularly delineated on the plan
marked P.W.D. 120995, deposited in the office of the Minister of
Works at Wellington, and thereon coloured red.
