PURSUANT to section one hundred and sixty-seven of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vary the Order in Council made on the seventh day of May, one thousand nine hundred and thirty-seven, and published in the Gazette on the twentieth day of May, one thousand nine hundred and thirty-seven, at page 1162, and affecting Kinohaku East E 1b 2 and other blocks, by excluding therefrom the land described in the Schedule hereto.

ORDER IN COUNCIL

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS in pursuance of section one hundred and thirty-six of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area of land be excluded from the County of Taieri and included in the Borough of Green Island:
And whereas it is deemed expedient to make such alteration of boundaries:
Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the said Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and forty-five, the area described in the Schedule hereto shall be excluded from the County of Taieri and included in the Borough of Green Island.

SCHEDULE

AREA EXCLUDED FROM THE COUNTY OF TAIERI AND INCLUDED IN THE BOROUGH OF GREEN ISLAND

ALL that area containing 1 acre 3 roods 31 poles, more or less, being Lots 1 to 5, Township of Abbotsford Extension No. 2, parts of Section 60, Block VII, Dunedin and East Taieri Survey District, and part of the North Taieri Road. Bounded towards the north-east by North Taieri Road to a point in line with the north-western boundary of Lot 15, Township of Abbotsford Extension, 442·2 links and 105 links; across that road and towards the north-east by Lots 15, 14, 13, 12, 11, and Part 10 to a point in line with the south-eastern boundary of Lot 5, Township of Abbotsford Extension No. 2, 425 links; across the said North Taieri Road and towards the south-east by Lots 1 and 3, D.P. 634, 216·13 links; towards the south-west by the Fernhill Branch Railway, 62·0 links and 626·8 links; and towards the north-west by said railway, 385·4 links: be all the aforesaid linkages more or less.

Declaring Crown Land in the Otago Land District to be subject to the Land for Settlements Act, 1925

WHEREAS the land described in the Schedule hereto (hereinafter referred to as the “said land”) is Crown land not acquired under the Land for Settlements Act, 1925, but is adjacent to certain land acquired under the said Act, and known as the Maerewhenua Settlement and can conveniently be disposed of therewith:
Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, acting in pursuance and exercise of the powers and authorities conferred upon me by section one hundred and five of the said Act, and on the recommendation of the Land Settlement Board, and after considering the report of the Otago District Land Board,*do hereby declare the said land to be subject to the said Act, to the intent that it shall hereupon be deemed to be portion of the said Maerewhenua Settlement and may be disposed of accordingly.

Appointment in the Royal New Zealand Navy

HIS Excellency the Governor-General has been pleased to approve the following appointment in the Royal New Zealand Navy, which amends the appointment dated 14th December, 1944 (New Zealand Gazette No. 1, 11th January, 1945):-

Lieutenant-Commander Alexander Cochrane Swanson, V.D., R.N.Z.N.V.R., placed on the Retired List of Officers of the Royal New Zealand Naval Volunteer Reserve (age), in the rank of Commander, with permission to wear the prescribed uniform, to date 9th December, 1944.
