Authorizing the Laying-off of a Street (Oakwood Avenue) in the City of Dunedin; of a Width less than 66 ft., but not less than 40 ft.

At the Government Buildings at Wellington, this 14th day of February, 1945

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Dunedin City Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet but not less than forty feet:

Provided that no building or part of a building shall at any time be erected on the land shown as Lots 15 and 16 on plan marked P.W.D. 120083 within a distance of thirty-five feet of the centre-line of the adjoining portion of the said street or on the land shown as Lots 17 and 27 on the said plan marked P.W.D. 120083 within a distance of forty-three feet from the centre-line of the adjoining portion of the said street or on the land shown as Lots 1 to 14 (inclusive) and Lots 18 to 26 (inclusive) on the said plan P.W.D. 120083 within a distance of forty-eight feet from the centre-line of the adjoining portion of the said street.

SCHEDULE

THAT proposed street in the Otago Land District, City of Dunedin, containing by admeasurement 3 roods 30 perches, being parts of Lots 1 and 2, D.P. 3260, part Lot 4, D.P. 3819, and part Lots 2 and 1, D.P. 5835, being parts of Sections 63 and 64, Block VI, Town District. As the same is more particularly delineated on the plan marked P.W.D. 120083, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Northern Side of Portion of Vivian Street, in the Borough of New Plymouth, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 14th day of February, 1945

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the eighteenth day of December, one thousand nine hundred and forty-four, viz.:

“The New Plymouth Borough Council, being the local authority having control of the streets in the Borough of New Plymouth, by resolution declares that the provisions of section one hundred and twenty-eight, subsection one, of the Public Works Act, 1928, shall not apply to the northern side of the portion of Vivian Street adjoining parts Sections 721 and 722, Town of New Plymouth, Certificate of Title, Volume 125, folio 96 (Taranaki Registry)”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of portion of Vivian Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

THE northern side of all that portion of street situated in the Taranaki Land District, Borough of New Plymouth, known as Vivian Street, fronting part Sections 721 and 722, Town of New Plymouth. As the same is more particularly delineated on the plan marked P.W.D. 120794, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

As the said portion of street is more particularly delineated on the plan marked P.W.D. 120675, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Southern Side of Portion of Ward Street, in the County of Marlborough, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 14th day of February, 1945

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Marlborough County Council on the twentieth day of October, one thousand nine hundred and forty-four, viz.:

“The Marlborough County Council, being the local authority having control of the roads in the County of Marlborough, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern portion of Ward Street fronting subdivision part Lots 39 and 40 (Deeds plan 18), part Section 53, Omaka, Block XV, Cloudy Bay Survey District, and contained in the Certificate of Title, Volume 28, folio 263”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Ward Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

THE southern side of all that portion of road in the Marlborough Land District, Marlborough County, known as Ward Street, fronting part Lots 39 and 40, Deeds Plan 18, part of Section 53, District of Omaka, Block XV, Cloudy Bay Survey District. As the said portion of road is more particularly delineated on the plan marked P.W.D. 120451, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
