at any time be erected on the land fronting the south-western side
of portion of District Road (described in the Schedule hereto) within
a distance of thirty-three feet from the centre-line of the said

SCHEDULE
THE south-western side of all that portion of street situated in the
Otago Land District, City of Dunedin, known as District Road,
fronting Lot D, D.P. 1014, being part Section 12, Block X, North
Harbour and Blueskin District. As the same is more particularly
delineated on the plan marked P.W.D. 120590, deposited in the
office of the Minister of Works at Wellington, and thereon coloured
red.

ORDER IN COUNCIL
At the Government House at Wellington, this 20th day of
December, 1944
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Harbours Act, 1923, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby license and permit the
Dunedin City Council, of Dunedin (hereinafter called “the Council,”
which term shall include its successors or assigns, unless the context
requires a different construction), to use and occupy a part of the
foreshore at Forbury Point, St. Clair, as shown on approved plans
marked M.D. 867 and 1528, and deposited in the office of the Marine
Department at Wellington, for the purpose of maintaining thereon
baths as shown on the said plans, such license to be held and enjoyed
by the Council upon and subject to the terms and conditions set
forth in the Schedule hereto.

SCHEDULE
CONDITIONS
-
THIS license is subject to the Foreshore License Regulations
1940, and the provisions of these regulations shall, so far as applicable,
apply hereto. -
The term of the license shall be fourteen years from the
1st day of December, 1944. -
In consideration of the concessions and privileges granted
by this Order in Council the Council shall pay to the Minister an
annual rental of one shilling (1s.), payable on demand. -
The Council shall leave and maintain a portion of the natural
rock, of a width not less than 20 ft., on the seaward side of the baths,
and any material removed in the construction of the baths shall be
thrown up as a wave-break, and the foreshore and tidal land
included in this license shall be used solely for bathing purposes. -
The concessions and privileges conferred by this Order in
Council shall extend and apply only to the parts of the foreshore and
of the land below low-water mark required for the construction of
the baths and bathhouses and any enclosure or fence necessary for
the protection or privacy of the same, as shown and delineated on
the said plan (marked M.D. 1528). -
The foreshore and tidal land included in this license shall
be used solely for bathing purposes. -
The Council shall, during the subsistence of this Order in
Council, provide and maintain proper and sufficient baths, with all
necessary appliances and conveniences thereto as will enable the
public to use and enjoy the same, and all other advantages hereby
conferred in respect of the use and occupation of the foreshore and
land below low-water mark. -
A printed copy of the by-laws affecting the use of the said
baths and bathhouses, and advantages as aforesaid, shall be put up
by the Council in very such bathhouse.

January, 1945
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred upon him by
the Soil Conservation and Rivers Control Act, 1941, His
Excellency the Governor-General of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby appoint the seventeenth day of
March, one thousand nine hundred and forty-five, as the date on
which shall be held the first election of representatives of the con-
stituent districts in the Poverty Bay Catchment District, being a
catchment district duly constituted by Order in Council dated the
fifteenth day of November, one thousand nine hundred and forty-
four, and published in the New Zealand Gazette No. 89 of the sixteenth
day of the same month.

At the Government House at Wellington, this 20th day of

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by an Order in Council dated the twenty-second
day of March, one thousand nine hundred and forty-four,
and published in the Gazette of the thirtieth day of that month, the
control of Lot I, D.P. 3407, being part of Section 3, Block X, Wai-
kawa Survey District, in the Southland Land District, a reserve
for a site for a public hall, was vested in certain persons therein
named, who were by the said Order in Council constituted a special
Board, by the name of the Haldane Public Hall Board, in pursuance
of section seventeen of the Public Reserves, Domains, and National
Parks Act, 1928 :
And whereas it is desirable that Arthur William Ericson, of
Haldane, should be appointed a member of the said Board in place
of William Thomas Connor (jun.), resigned :
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in pur-
suance and exercise of the powers conferred on him by section
seventeen of the Public Reserves, Domains, and National Parks
Act, 1928, doth hereby appoint the said
Arthur William Ericson
to be a member of the Haldane Public Hall Board, constituted
by the Order in Council dated the twenty-second day of March,
one thousand nine hundred and forty-four, hereinbefore referred to,
in place of the said William Thomas Connor (jun.), resigned.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the lands described in the Schedule hereto are
reserves duly set apart for plantation purposes : And whereas
it is expedient that the purpose of the reservation over such lands
shall be changed to reserves for access purposes :
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
exercise of the powers and authorities conferred upon him by
subsection one (a) of section seven of the Public Reserves, Domains,
and National Parks Act, 1928, doth hereby declare that the purpose
of the reserves described in the Schedule hereto is hereby changed
from reserves for plantation purposes to reserves for access purposes.

ALL that area in the Waitemata County, situated in Block III,
Waitakerei Survey District, containing by admeasurement 2 acres
2 roods 32·7 perches, more or less, being Lots 71 and 72, D.P. 31270,
and Lot 77, D.P. 31268, being parts of Piha Block, and being portions
of the land comprised and described in Certificate of Title, Volume
642, folio 56 (Auckland Registry). As the same is more particularly
delineated on the plan marked L. and S. 1/1102B, deposited in the
Head Office, Department of Lands and Survey, at Wellington, and
thereon edged red.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the land described in the Schedule hereto is a
reserve for gravel purposes and is vested in the Chairman,
Councillors, and Inhabitants of the Southland County :
And whereas it is expedient that the vesting of the said land as
hereinbefore referred to should be cancelled, and the Southland
County Council has duly consented to such cancellation :
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in pursuance and
exercise of the powers and authorities conferred upon him by sub-
section one of section ten of the Public Reserves, Domains, and
National Parks Act, 1928, doth hereby cancel the vesting in the
Chairman, Councillors, and Inhabitants of the Southland County
of the land described in the Schedule hereto.
