A PROCLAMATION

In pursuance and exercise of the powers and authorities vested in me by the Public Works Act, 1928, and of every other power and authority in anywise enabling me in this behalf, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the Crown land described in the Schedule hereto is hereby set apart for aerodrome; and I do also declare that this Proclamation shall take effect on and after the twenty-first day of December, one thousand nine hundred and forty-four.

Amending a Proclamation setting apart Crown Land in Otago Land District for the Purposes of Part I of the Housing Act, 1919

A PROCLAMATION

WHEREAS by a Proclamation dated the twentieth day of June, one thousand nine hundred and forty-four, and published in the Gazette of the twenty-second day of that month (hereinafter referred to as "the said Proclamation"), an area of one acre of Crown land in the Otago Land District was set apart for the purposes of Part I of the Housing Act, 1919, in terms of section nine of the said Act:

And whereas an error was made in the description of the land in the Schedule to the said Proclamation, and it is expedient that the error should be rectified:

Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the Housing Act, 1919, do hereby amend the said Proclamation by substituting the description of the land set forth in the Schedule hereto for the description of the land set forth in the Schedule to the said Proclamation.

SCHEDULE

OTAGO LAND DISTRICT

LOTS 64 to 67 (inclusive), Block VII, Deeds Plan 6, being part Section 134, Block XVII, Tokomairiro Survey District: Area, 1 acre.

Authorizing the Purchase by the Otago Central Electric-power Board of the Electrical Works of the Mayor, Councillors, and Burgesses of the Borough of Queenstown

ORDER IN COUNCIL

At the Government House at Wellington, this 20th day of December, 1944

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

In pursuance and exercise of the powers conferred by section seventy-six of the Electric-power Boards Act, 1925, and of all other powers in anywise enabling me in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion doth, subject to the conditions set forth in the Schedule hereto, hereby authorize the purchase by the Otago Central Electric-power Board (hereinafter referred to as "the Board") of the electric works, the property of the Mayor, Councillors, and Burgesses of the Borough of Queenstown (hereinafter referred to as "the Borough"), as described in a certain agreement (hereinafter referred to as "the agreement") bearing date the twelfth day of December, one thousand nine hundred and forty-four; and made between the Board of the one part and the Borough of the other part, of which agreement a copy has been deposited in the office of the Minister of Works.

SCHEDULE

The conditions hereinbefore referred to are:-

(1) That the Board shall bind itself that, if and when as required by the Governor-General in Council, it shall consent to the revocation or amendment of each existing license and authority held by the Borough authorizing the use of water for the purpose of generating electricity, whether granted pursuant to the Public Works Act, 1928, the Mining Act, 1926, or any other authority (hereinafter referred to as "the existing licenses"), in so far as the same may be incompatible with the license issued under sections 318 and 319 of the Public Works Act, 1928, collateral with this Order in Council, authorizing the Board to use water for the purpose of generating electricity and to erect certain electric lines.

(2) That the terms of such purchase shall be those set forth in the agreement so far as the same relate to the purchase of electrical works.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, and the Electric-power Boards Act, 1925, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth, subject to the terms and conditions set forth in the First Schedule hereto, hereby grant to the Otago Central Electric-power Board (hereinafter referred to as "the licensee") a license to obstruct, impound, and divert the waters of the One-mile Creek (hereinafter referred to as "the said stream"), near Queenstown, in the Lake County, Otago Land District, and to take and use therefrom for the purpose hereinafter set forth, a stream of water not exceeding two and a half cubic feet per second at any one time; and, further doth, subject to the said terms and conditions in the First Schedule hereto, authorize the licensee to lay, construct, put up, place, and use the electric lines described in the Second Schedule hereto; and, further, for the purposes of section seventy-six of the Electric-power Boards Act, 1925, doth hereby authorize the licensee to construct, maintain, and use the said electrical works; and, further, with the consent of the licensee, doth hereby revoke the Orders in Council described in the Third Schedule hereto as from the day on which this Order in Council becomes effective.

FIRST SCHEDULE

  1. IMPLIED CONDITIONS

The conditions directed to be implied in all licenses by the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1935, and by Regulation 6 of the Water-power Regulations 1934, shall be incorporated in and shall form part of this license except in so far as the same may be inconsistent with the provisions hereof.

  1. LICENSE SUBJECT TO REGULATIONS

This license is issued under the Water-power Regulations 1934, and the Electrical Supply Regulations 1935, and the Electrical Wiring Regulations 1935, and is subject thereto and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor: Provided that the licensee shall not...
