Revoking Part of a Proclamation altering a Proclamation defining the Middle-line of a Portion of the Wellington – New Plymouth Railway (Wellington – Tawa Flat Deviation)

A PROCLAMATION
IN pursuance and exercise of the powers and authorities vested in me by the Public Works Act, 1928, and of every other power and authority in anywise enabling me in this behalf, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby revoke the Proclamation dated the twenty-sixth day of May, one thousand nine hundred and twenty-seven, and published in the New Zealand Gazette No. 38 of the second day of June of the same year, altering a Proclamation defining the middle-line of a portion of the Wellington – New Plymouth Railway (Wellington – Tawa Flat Deviation), in so far as it affects Lot 8, D.P. 1975, being part of Section 44, Porirua Survey District, comprised and described in Certificate of Title, Volume 204, folio 118 (Wellington Registry).
Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 9th day of December, 1944.

Constituting the Waimairi Electric-power District

A PROCLAMATION
IN pursuance and exercise of the powers conferred by section three of the Electric-power Boards Act, 1925, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby proclaim the district as described in the Schedule hereto to be an electric-power district, and I hereby assign to such district the name of the Waimairi Electric-power District.
SCHEDULE
ALL that area in the County of Waimairi, Canterbury Land District, bounded by a line commencing at a point on the intersection of the north-eastern boundary of Rural Section 128 with the north-western side of Lincoln Road, being a point at the junction of the boundary of the City of Christchurch and the boundary of the Borough of Riccarton; thence proceeding generally north-westerly and easterly along the boundary of the said Riccarton Borough, as described in Gazette, 1932, page 554, to a point on the intersection of the centre-line of Deans Avenue with the right bank of the River Avon, the said point being on the boundary of the City of Christchurch; thence proceeding generally north-easterly, north-westerly, and south-easterly along the boundary of the City of Christchurch aforesaid, as described in Gazette, 1942, pages 24–25, to a point on the intersection of the centre-line of North Parade with the production westward of the southern side of New Brighton Road; thence proceeding easterly, southerly, again easterly and southerly; thence westerly along that portion of the boundary of the City of Christchurch, described in Gazette, 1942, page 3173, to a point on the intersection of the centre-line of Banks Avenue with the production westward of the northern side of Cooper’s Road; thence continuing generally south-easterly and north-easterly along the boundary of the City of Christchurch, as described in Gazette, 1942, pages 24–25, to a point at the mean high-water mark of the sea; thence in a northerly direction along the said mean high-water mark of the sea and up the middle of the Waimakariri River, the same being the eastern boundary of the County of Waimairi, as described in Gazette, 1942, pages 24–25, to a point in line with the eastern boundary of Rural Section 14216; thence southerly by a right line to the intersection of the said eastern boundary of that rural section with the right bank of the Waimakariri River, being a point on the boundary of the North Canterbury Electric-power District, described in Gazette, 1934, page 2; thence generally southerly, westerly, south-westerly, and again westerly along that boundary to the intersection of the production westward of the southern boundary of Rural Section 539 with the north-western boundary of the County of Waimairi aforesaid at the middle of the Waimakariri River; thence proceeding in a south-westerly direction up the middle of that river following the said north-western boundary of the County of Waimairi to its junction with the north-eastern corner of the Springs-Ellesmere Electric-power District, described in Gazette, 1930, page 1413; thence continuing generally south-westerly and south-easterly along the said boundary of the County of Waimairi to the boundary of the City of Christchurch aforesaid; thence north-easterly along that boundary to the point of commencement. As the same is more particularly delineated on the plan marked P.W.D. 120617, deposited in the office of the Minister of Works at Wellington, and thereon edged red.
Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 9th day of December, 1944.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the assignment to Michael William Carroll, of Totara, Ross, Farmer, by Walter John Wallace, formerly of Totara, Ross, Farmer, of his rights, powers, and privileges under an Order in Council dated the second day of November, one thousand nine hundred and thirty-eight, and published in the New Zealand Gazette No. 79 of the third day of the same month, at page 2302, authorizing the said Walter John Wallace, formerly of Totara, Ross, Farmer, to use water for the purpose of generating electricity and to erect certain electric lines.

Consenting to the Raising of a Loan of £26,500 by the Nelson Hospital Board and prescribing the Conditions thereof

At the Government Buildings at Wellington, this 29th day of November, 1944

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
WHEREAS the Nelson Hospital Board (hereinafter called “the said local authority”), being desirous of raising a loan of twenty-six thousand five hundred pounds (£26,500), to be known as “Nelson Hospital Extensions Loan (No. 3) 1944” (hereinafter called “the said loan”), for the purpose of completing the erection and equipping of a new boiler-house, laundry, and allied departments block, and a new ward block at the Nelson Hospital, has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loan:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of twenty-six thousand five hundred pounds (£26,500), and in giving such consent doth hereby determine as follows:—
(1) The term for which the said loan or any part thereof may be raised shall not exceed twenty-five (25) years.
(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding three pounds seven shillings and sixpence (£3 7s. 6d.) per centum per annum.
(3) The said loan, together with interest thereon, shall be repaid by half-yearly instalments on the dates set out in the first column of the Schedule hereunder of the amounts set opposite each date in the second column of the said Schedule. Each such half-yearly instalment includes a repayment of principal amounting to five hundred and thirty pounds (£530) and a half-year’s interest calculated at the rate of three pounds seven shillings and sixpence (£3 7s. 6d.) per centum per annum, as determined in clause two above, on the amount of principal outstanding immediately prior to the date of payment of such instalment.
