Exempting certain Native Lands in Kiwitea County from Payment of Rates

At the Government Buildings at Wellington, this 29th day of November, 1944
Present :
THE RIGHT HON. P FRASER PRESIDING IN COUNCIL
Pursuant to section one hundred and four of the Rating Act, 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby exempt the Native Land described in the Schedule hereto from all rates made or levied by the Kiwitea County Council under the said Rating Act, 1925.
SCHEDULE
The following lands situated in the County of Kiwitea :—

The North-western Side of Portion of Long Street, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
In pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the eleventh day of September, one thousand nine hundred and forty-four, viz.:-
“The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western side of portion of Long Street adjoining Lot 14, D.P. 99, being all the land contained in Certificate of Title, Volume 178, folio 183 (Canterbury Registry), and being part of Rural Section 31”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Long Street (described in the Schedule hereto) within a distance of forty-eight feet from the centre-line of the said portion of street.
SCHEDULE
The north-western side of all that portion of street situated in the Canterbury Land District, City of Christchurch, known as Long Street, fronting Lot 14, D.P. 99, being part of Rural Section 31. As the same is more particularly delineated on the plan marked P.W.D. 120119, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The South-western Side of Portion of Public Road, in the County of Tauranga, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government House at Wellington, this 6th day of December, 1944

His Excellency the Governor-General in Council
In pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Tauranga County Council on the thirteenth day of August, one thousand nine hundred and forty-three, in so far as it affects the side and portion of road more particularly described in the Schedule hereto, viz. :-
“That the Tauranga County Council, being the local authority having control of the roads and streets in the Tauranga County within which the lands comprised in the Schedule hereto are situate, hereby resolves that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the road lying on the northern boundary of the said lands and between such northern boundary and the Tauranga Harbour.
“THE SCHEDULE
“All those pieces or parcels of land situated in the Provincial District of Auckland, containing together sixteen acres two roods twenty-seven decimal nine perches (16 acres 2 roods 27.9 perches), more or less, being, firstly, all that piece or parcel of land situated as aforesaid containing thirteen acres two roods (13 acres 2 roods), more or less, being Allotments 104, 104A, and 367, Parish of Te Papa, and being all the land in Certificate of Title, Volume 22, folio 94 (Auckland Land Registry), and, secondly, all that piece or parcel of land situated as aforesaid containing three acres twenty-seven decimal nine perches (3 acres 0 roods 27.9 perches), more or less, being Section 2, Parish of Te Papa, and being all the land in Certificate of Title, Volume 215, folio 260 (Auckland Land Registry), the said pieces of land being the lands described as Lots 1 and 2 on a plan proposed to be deposited in the Land Registry Office at Auckland under Number 30212”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of portion of public road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of public road.
SCHEDULE
The south-western side of all that portion of public road situated in the Auckland Land District, Tauranga County, fronting Section 2 of the Parish of Te Papa, and Allotments 104, 104A, and 367 of the Parish of Te Papa, Block X, Tauranga Survey District. As the same is more particularly delineated on the plan marked P.W.D. 120303, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Pursuant to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.
