The South-western Side of Portion of Brownville Crescent and the North-western Side of Portion of Highgate, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to Conditions as to the Building-lines

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 15th day of November, 1944

Present:

THE HON. W. NASH PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the nineteenth day of June, one thousand nine hundred and forty-four, viz.:

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz.:

“ (a) The south-western side of the portion of Brownville Crescent adjoining part Lot 10, Block I, D.P. 67 (McLennan’s Subdivision), being part Section 14, Block I, and part Section 8, Block II, Upper Kaikorai District ;

“ (b) The north-western side of the portion of Highgate adjoining part Lots 9 and 10, Block I, D.P. 67 (McLennan’s Subdivision), being part Section 14, Block I, and part Section 8, Block II, Upper Kaikorai District ;

such land being comprised and described in Certificates of Title 21/168 and 43/292A ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Brownville Crescent (described in the Schedule hereto) within a distance of twenty-five feet from the centre-line of the said portion of street and that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Highgate (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

The south-western side of all that portion of street in the Otago Land District, City of Dunedin, known as Brownville Crescent, adjoining part Lot 10, Block I, D.P. 67, being part Section 14, Block I, and part Section 8, Block II, Upper Kaikorai District.

Also the north-western side of all that portion of street in the said land district and city, known as Highgate, adjoining parts Lots 9 and 10, Block I, D.P. 67, being part Section 14, Block I, and part Section 8, Block II, Upper Kaikorai District.

As the same are more particularly delineated on the plan marked P.W.D. 120035, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Regulations under the Naval Defence Act, 1913, amended

IN pursuance and exercise of the powers and authorities conferred on him by section twenty-five of the Naval Defence Act, 1913, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, with the advice of the Executive Council, doth hereby amend and supplement the regulations referred to in the Schedule hereto as shown therein.

APPENDIX I.—RATES OF PAY: OFFICERS

THE following shall be the daily rates of pay of the officers indicated (with effect from 1st November, 1941):

PURSUANT to section two hundred and sixty-eight of the Native Land Act, 1931, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that Ernest Richard Hudson, Building Supervisor, Gisborne, being an officer in the service of the Crown, is authorized to attest, in accordance with the provisions of the said section two hundred and sixty-eight, the signatures of Natives to instruments of alienation of Native land.

As witness the hand of His Excellency the Governor-General, this 2nd day of November, 1944.

Officer authorized to attest Signatures of Natives to Instruments under Chattels Transfer Act, 1924

PURSUANT to section five hundred and forty-seven of the Native Land Act, 1931, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that Ernest Richard Hudson, Building Supervisor, Gisborne, being an officer in the service of the Crown, is authorized to attest, in accordance with the provisions of the said section five hundred and forty-seven, the signatures of Natives to instruments by way of security within the meaning of the Chattels Transfer Act, 1924.

As witness the hand of His Excellency the Governor-General, this 2nd day of November, 1944.

Trustees of Frasertown Cemetery appointed

PURSUANT to section fifty-five of the Cemeteries Act, 1908, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby appoint the Wairoa County Council to be the trustees of the Frasertown Cemetery, as described in the Schedule hereto, and to have the control and management of the said cemetery.

SECTION 151, Town of Frasertown: Area, 6 acres 2 roods, more or less.
