Amending Order in Council dated 22nd September, 1943,
licensing the Orapiu Road Board to occupy Foreshore
as a Site for a Wharf at Orapiu Bay, Waiheke Island

URSUANT to the Harbours Act, 1923, His Excellency
the Governor-General, acting by and with the advice
and consent of the Executive Council, doth hereby amend
the Order in Council dated the twenty-second day of September,
one thousand nine hundred and forty-three, and
published in the Gazette of the twenty-ninth day of the same
month at page 1152, licensing the Orapiu Road Board to
occupy a part of the foreshore at Orapiu Bay, Waiheke
Island, as a site for a wharf, by revoking clause one in
the First Schedule to the Order in Council, and substituting
the following clause:—
“1. This license is subject to the Foreshore License
Regulations 1940, with the exception of clause 21 of the
said regulations, which for the purpose of this Order in
Council is hereby excluded, and the provisions of the said
regulations shall, so far as applicable, apply hereto.”

URSUANT to the Harbours Act, 1923, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby license and permit the Rawene
Motors, Limited, of Rawene (hereinafter called “the company,”
which term shall include its successors or assigns, unless the context
requires a different construction), to use and occupy a part of the
foreshore at Rawene, Hokianga Harbour, as shown on Section No. 2
on plans marked M.D. 4462 and 4678 and deposited in the office of
the Marine Department at Wellington, for the purpose of maintaining thereon a shop as shown on the said plans, such license to be
held and enjoyed by the company upon and subject to the terms
and conditions set forth in the Schedule hereto.

SCHEDULE
CONDITIONS

  1. This license is subject to the Foreshore License Regulations 1940,
    and the provisions of those regulations shall, so far as applicable,
    apply hereto.
  2. The premium payable by the company shall be one pound
    (£1) and the annual sum so payable five pounds (£5).
  3. The term of the license shall be fourteen years from the 9th
    day of October, 1944.

Amending Order in Council delegating Powers under the
Cemeteries Act, 1908

URSUANT to the Cemeteries Act, 1908, His Excellency
the Governor-General, acting by and with the advice
and consent of the Executive Council, doth hereby revoke,
in so far as it relates to the Frasertown Cemetery, the
Order in Council delegating powers under the said Act made
on the eighteenth day of September, one thousand nine
hundred and thirty-three, and published in the Gazette on
the twenty-first day of the same month at page 2429.

Authorizing the Acquisition of Land notwithstanding the Provisions
as to Limitation of Area

URSUANT to section two hundred and forty-six of the Native
Land Act, 1931, His Excellency the Governor-General, acting
by and with the advice and consent of the Executive Council, doth
hereby authorize the disposition to and the acquisition by the
Farmers’ Co-operative Auctioneering Company, Limited, the New
Zealand Loan and Mercantile Agency Company, Limited, and
Abraham and Williams, Limited, of the land described in the
Schedule hereto, notwithstanding the provisions of Part XII of
the said Act.

SCHEDULE
ALL that parcel of land containing 10 acres 2 roods 10·2 perches,
more or less, known as Orahiri Block I, Section 13B, and being all
the land comprised in Certificate of Title, Volume 201, folio 224
(Auckland Registry).

Altering and Redefining the Boundaries of the Pukeatua Rabbit
District.—(Notice No. Ag. 4149)

HEREAS by section thirty-one of the Rabbit Nuisance Act,
1928, it is enacted that the Governor-General, at the request
of the Board of any Rabbit District, may, by Order in Council,
alter and redefine the boundaries of its district:
And whereas the district known as the Pukeatua Rabbit
District has been constituted under and for the purposes of the
said Act:
And whereas the Board of the said district has, pursuant to the
said section thirty-one of the said Act, requested that the boundaries
of its district be altered and redefined by including an additional
area therein:
And whereas the consent of a majority of the persons in such
additional area qualified to be enrolled on the ratepayers’ list for
the said district has been given to the inclusion of such additional
area in the said district:
And whereas it is deemed expedient to alter and redefine the
boundaries of the said district accordingly:
Now, therefore, in pursuance and exercise of the powers and
authorities conferred upon him by the said Act, His Excellency
the Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby—
(1) Alter and redefine the boundaries of the said district so
constituted as aforesaid;
(2) Declare that the boundaries of the said district shall be those
set forth in the Schedule hereto; and, further,
(3) Declare that this Order in Council shall come into force
on the day following publication hereof in the Gazette.

SCHEDULE
BOUNDARIES OF THE PUKEATUA RABBIT DISTRICT
ALL that area in the Auckland Land District, in the counties of
Waipa and Otorohanga, bounded as follows: Commencing at
the south-western corner of Maungatautari No. 4H 8 Block, situated
in Block V, Maungatautari Survey District; thence in an easterly
direction generally following the boundary of the Waikato Central
Rabbit District (Gazette, 1932, page 2133), along the southern
boundaries of Maungatautari No. 4H 8 and No. 4G 2 Blocks, the
eastern boundaries of Maungatautari No. 4G 2 and No. 4G Blocks,
and a right line to the Maungatautari Trig. Station; thence in a
south-easterly direction along the Matamata County boundary to
the Waiteti Stream; thence in a southerly direction generally up
the Waiteti Stream, along the western boundaries of Sections 10A
and 7A, Tautari Settlement, the south-western boundary of Section 7A aforesaid and its production to the Mangare Stream; thence
down the Mangare Stream and up the Waikato River to the northern
boundary of Section 10, Block IV, Wharepapa Survey District;
thence in a south-westerly direction generally along the Otorohanga
County boundary to the Whatauri Trig. Station at the northernmost corner of Section 2, Block VI, Wharepapa Survey District;
thence along the north-western boundary of Section 2 aforesaid to
the Waipari River; thence in a south-easterly direction generally
up the Waipari River to the north-western boundary of Section 6,
Block VI aforesaid; thence in a south-westerly direction generally
along the north-western boundary of Section 6 aforesaid to the
Ngaroma Road; thence in a north-westerly direction generally
along that road to the Mangaharekeke Stream; thence due south
by a right line passing through Section 5, Block VI aforesaid, to the
northern boundary of Section 2, Block X, Wharepapa Survey
District; thence in a westerly direction along the northern boundaries
of Sections 2 and 1, Block X aforesaid, and Section 1, Block IX,
Wharepapa Survey District, to the Puniu River; thence in a
northerly direction generally down the Puniu River to its intersection by the Wharepapa Road in Block I, Wharepapa Survey
District; thence in a north-easterly direction generally along
the Wharepapa, Aotearoa, and Rotongata Roads to the Kaiwhio
Stream; thence in a north-westerly direction generally down the
Kaiwhio and Owairaka Streams to the south corner of Lot 12,
D.P. 2108, being part of Ngamako Block; thence northerly generally
along the south-eastern boundary of the said Lot 12 and the south-eastern and north-eastern boundaries of Lot 10, on the said
D.P. 2108 to the Tika Road; thence along the south-eastern side
of that road to and across Kihikihi-Arapuni Main Highway, and along
the north-eastern side of that highway to and across a public road
to the southern corner of Allotment 55, Puniu Parish; thence along
the south-eastern boundaries of that allotment and Allotment 55A
of the said parish to the Mangaohoe Stream; thence eastward along
