Boundaries of City of Christchurch and County of Heathcote altered

ORDER IN COUNCIL

At the Government House at Wellington, this 1st day of November, 1944

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS in pursuance of section one hundred and thirty-seven of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area be excluded from the County of Heathcote and included in the City of Christchurch:

And whereas a Commission appointed under the said section held inquiries and recommended that the said area be excluded from the County of Heathcote and included in the City of Christchurch:

And whereas it is deemed expedient to make the alteration of boundaries recommended by the said Commission:

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of November, one thousand nine hundred and forty-four, the area described in the Schedule hereto shall be excluded from the County of Heathcote and included in the City of Christchurch.

SCHEDULE

AREA EXCLUDED FROM COUNTY OF HEATHCOTE AND INCLUDED IN CITY OF CHRISTCHURCH

ALL that area of land in the Canterbury Land District, containing by admeasurement 30 acres 0 roods 30 perches, more or less, situated in Block XVI, Christchurch Survey District, and Block II, Sumner Survey District, and being Reserve 4324, bounded by a line commencing at a point on the boundary of the City of Christchurch, such point being the westernmost corner of Reserve 4324; thence easterly and south-easterly by right lines bearing 95° 09', distance 2792·2 links, and bearing 146° 32', distance 2701·7 links, to a point on the boundary of the County of Heathcote; thence westerly and north-westerly generally along the boundary of the County of Heathcote to the point of commencement.

AREA EXCLUDED FROM COUNTY OF WAIMAIRI AND INCLUDED IN CITY OF CHRISTCHURCH

ALL that area of land in the County of Waimairi of the Canterbury Land District, bounded by a line commencing at a point at the intersection of the south-western side of Wairarapa Road with the north-western boundary of Lot 1, Deposited Plan No. 10276, being a point on the existing boundary of the City of Christchurch; thence proceeding in a south-westerly direction along the said north-western boundary of Lot 1, Deposited Plan No. 10276, and the north-western boundaries of Lots 1, 2, 3, 4, 5, 6, and 15, Deposited Plan No. 10549, Lots 9, 10, 11, and 12, Deposited Plan No. 11695, and the north-western and the south-western boundary of Reserve 4340, Deposited Plan No. 10276, to the western end of Galway Avenue; thence south-easterly to and along the south-western boundary of Lot 8, Deposited Plan No. 11695; thence north-easterly along the south-eastern boundaries of the said Lot 8 and Lots 7, 6, 5, 4, 3, 2, and 1, Deposited Plan No. 11695 aforesaid,

Lots 13, 12, 11, 10, 9, 8, and 7, Deposited Plan No. 10549, and along the south-eastern boundary of Lot 6, Deposited Plan No. 10276, to a point at the intersection of that boundary with the south-western side of Wairarapa Road, which is the existing boundary of the City of Christchurch; thence north-westerly along that boundary to the point of commencement.

Declaring Road in Block XIV, Waipakura Survey District, to be Government Road

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portions of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.

The North-western and South-western Sides of Portions of Public Roads, in the County of Waimea, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government House at Wellington, this 25th day of October, 1944

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the fourteenth day of July, one thousand nine hundred and forty-four, viz.:—

“The Waimea County Council, being the local authority having control of the roads in the County of Waimea, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western and south-western portions of public road fronting part Section 16, Waimea East, Block VI, Waimea Survey District, and contained in the Certificate of Title, Volume 57, folio 139”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western and south-western sides respectively of the portions of roads (described in the Schedule hereto) within a distance of thirty-five feet from the centre-lines of the said portions of roads.

SCHEDULE

The north-western and south-western sides of all those portions of roads situated in the Nelson Land District, County of Waimea, adjoining part Section 16, Waimea East, Block VI, Waimea Survey District. As the same are more particularly delineated on the plan marked P.W.D. 119825, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
