All that area containing by admeasurement 3 acres, more or less,
being Lot 31, D.P. 12180, being part of closed road and parts of
Sections 1, 2, 26, and 79, Wainui-o-Mata District, Blocks XVI and
XVII, Belmont Survey District.

Also all that area containing by admeasurement 11 acres
2 roods 34 perches, more or less, being Lot 122, D.P. 12424, being
part of Section 8, Lowry Bay District, and part of Section 1,
Wainui-o-Mata District, Blocks XVI and XVII, Belmont Survey
District.

Also all that area containing by admeasurement 2 acres 1 rood
14 perches, more or less, being Lot 85, D.P. 12752, being parts of
Sections 1 and 3, Wainui-o-Mata District, Block XVI, Belmont
Survey District.

As the same are more particularly delineated on the plan
marked L. and S. 1/1122, deposited in the Head Office, Department
of Lands and Survey, at Wellington, and thereon bordered red.

Reserve in Canterbury Land District brought under the Tourist and
Health Resorts Control Act, 1908

ORDER IN COUNCIL

At the Government House at Wellington, this 11th day of
October, 1944
Present:
His Excellency the Governor-General in Council
By virtue of the powers and authorities conferred upon me by the
sixth section of the Tourist and Health Resorts Control Act,
1908, I, Cyril Louis Norton Newall, the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, do hereby order and
declare that the reserve for recreation purposes in the Canterbury
Land District, described in the Schedule hereto, shall be and the
same is hereby brought under the operation of and declared to be
subject to the provisions of the Tourist and Health Resorts Control
Act, 1908; and such reserve shall hereafter be managed, administered,
and dealt with in manner directed by the said Act.

SCHEDULE

CANTERBURY LAND DISTRICT

All that area containing by admeasurement 1,350 acres, more or
less, being part of Reserve 2652, Blocks V and IX, Mueller Survey
District, and bounded as follows: Towards the north-east by the
right bank of the Hooker River; towards the south-east by other
part of Reserve 2652, 9437·1 links, 1972·2 links, and 850·0 links;
towards the south by Sawyer's Creek; towards the west generally by
other part of Reserve 2652, otherwise defined generally as the upper
limit of vegetation; towards the north-west by a public road, down
the bed of the Black Birch Stream, and again towards the north-west
by other part of Reserve 2652, 6300·0 links : save and except there-
out the intersecting roads. As the same is more particularly
delineated on the plan marked L. and S. 8/8/76A, deposited in the
Head Office, Department of Lands and Survey, at Wellington, and
thereon bordered red.

Vesting a Reserve in the Dunedin City Council

ORDER IN COUNCIL

At the Government House at Wellington, this 4th day of
October, 1944
Present:
His Excellency the Governor-General in Council
WHEREAS the land described in the Schedule hereto has been
duly set apart as a reserve for recreation purposes
And whereas, in the opinion of the Governor-General, it is
expedient to vest the said reserve in the Mayor, Councillors, and
Citizens of the City of Dunedin:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, and in exercise of
the powers and authorities conferred upon him by section nine of
the Public Reserves, Domains, and National Parks Act, 1928, doth
hereby declare that, from and after the day of the date hereof, the
reserve described in the Schedule hereto shall become vested in the
Mayor, Councillors, and Citizens of the City of Dunedin, in trust,
for recreation purposes.

Section 165, Wakari Survey District: Area, 3 acres 2 roods
15·7 perches, more or less.

The Samoa Land Emergency Regulations 1944

ORDER IN COUNCIL

At the Government House at Wellington, this 11th day of
October, 1944
Present:
His Excellency the Governor-General in Council
Pursuant to the Emergency Regulations Act, 1930, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, doth hereby make the
following regulations.

REGULATIONS

  1. These regulations may be cited as the Samoa Land Emergency
    Regulations 1944.

  2. These regulations shall come into force on the day following
    the date of their publication in the Western Samoa Gazette.

  3. In these regulations, unless the context otherwise requires,--
    "The Act" means the Samoa Act, 1921:
    "Defence purposes" includes the provision of aerodromes
    and the construction of works of any nature whatsoever
    for naval, military, or air force purposes:
    Expressions used herein and in the Act shall have the same
    meanings as in the Act.

  4. (1) Any European or Native land in Samoa may, by Order
    in Council, be taken for defence purposes, and it shall thereupon
    become absolutely vested in His Majesty as from the date of the
    Order in Council, or from any later date specified therein in that
    behalf, free from all estates, rights, and interests of any other person
    therein, save so far as any such estates, rights, or interests are
    expressly saved by such Order in Council.

(2) Where any land has been so taken for defence purposes all
persons having in respect of that land any right, title, estate, or
interest which is extinguished or divested by the taking of the land
shall be entitled to compensation therefor from the Crown.

(3) The amount and form of the compensation may be agreed to
between the persons entitled to the compensation and the Adminis-
trator, and in default of any such agreement the compensation shall
be assessed and awarded by the High Court either on the application
of the Administrator or on that of any person claiming the
compensation or any share therein.

(4) In any case where land taken pursuant to these regulations
is at the time of the taking occupied for a public purpose or for
defence purposes, due regard shall be had to the amount of any
moneys paid or payable in respect of such occupation for the purpose
of assessing the compensation to be paid pursuant to this regulation,
whether the assessment is made by agreement or by the High Court.

(5) Any lease, easement, or other limited right, title, or interest
in any European or Native land may be taken by Order in Council
for defence purposes, and compensation in respect thereof shall be
payable in the same manner as in the case of land taken under the
foregoing provisions of this regulation.

  1. While these regulations continue in force sections 272 and
    273 of the Act shall extend and apply as if defence purposes were a
    public purpose within the meaning of the Act, and section 8 of the
    Samoa Amendment Act, 1938, shall extend and apply as if land
    taken under these regulations were land taken under Part IX of the
    Act for a public purpose and as if defence purposes were a public
    purpose within the meaning of the Act.

Appointment of Member of Island Council of Atiu

Pursuant to section sixty-five of the Cook Islands Act, 1915,
and to an Order in Council made thereunder on the twenty-first
day of March, one thousand nine hundred and sixteen, His Excellency
the Governor-General doth hereby appoint

Tere Mataiapo, of Tengatangi, Atiu,
to be a member of the Island Council of Atiu during his pleasure
as from the date hereof, in lieu of Toroa (deceased).

As witness the hand of His Excellency the Governor-General,
this 4th day of October, 1944.

Appointment of Member of Board of Health under the Health Act,
1920

In pursuance and exercise of the powers and authorities con-
ferred upon me by the Health Act, 1920, I, Cyril Louis Norton
Newall, the Governor-General of the Dominion of New Zealand,
do hereby reappoint

Sir Donald Johnstone McGavin, Kt., C.M.G., D.S.O., M.D.,
F.R.C.S.,
as a member of the Board of Health under the aforesaid Act for a
period of three years.

As witness the hand of His Excellency the Governor-General,
this 5th day of October, 1944.
