within which the Loan may be raised

ORDER IN COUNCIL
At the Government House at Wellington, this 4th day of
October, 1944
Present:
His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the sixteenth day of
October, one thousand nine hundred and forty (hereinafter
called “the said Order in Council”), and subject to the determina-
tions as to borrowing and repayment therein set out, consent was
given to the raising by the Dunedin City Council (hereinafter called
“the said local authority”) of the sum of forty thousand pounds
(£40,000), being portion of a loan known as “Electricity Loan,
1940, £100,000” (hereinafter called “the said loan”):
And whereas by Order in Council made on the seventh day of
October, one thousand nine hundred and forty-two, the determina-
tions aforesaid were varied in respect of a portion of the said loan
amounting to seventeen thousand pounds (£17,000) by extending
the period within which such sum might be raised to four (4) years
from the date of the said Order in Council:
And whereas the authority conferred by the said Order in
Council has not yet been exercised to the extent of seven thousand
pounds (£7,000) (hereinafter called “the said sum”), and it is
expedient to again vary the determinations aforesaid in respect of
the said sum by further extending the term, as specified in clause
seven of the said Order in Council, within which the said sum or
any portion thereof may be raised:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, and in pursuance
and exercise of the powers and authorities conferred on him by
section eleven of the Local Government Loans Board Act, 1926, as
set out in section twenty-nine of the Finance Act, 1932 (No. 2),
and of all other powers and authorities enabling him in this behalf,
doth hereby vary the determinations aforesaid in respect of the
said sum by prescribing that no moneys shall be borrowed under the
consent given by the said Order in Council after the expiration of
five (5) years from the date thereof.

Auckland City Council’s Loan of £540,000

ORDER IN COUNCIL
At the Government House at Wellington, this 4th day of
October, 1944

His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the thirty-first day
of August, one thousand nine hundred and forty-three
(hereinafter called “the said Order in Council”), and subject to
the determinations as to borrowing and repayment therein set out,
consent was given to the raising in New Zealand by the Auckland
City Council (hereinafter called “the said local authority”) of a
loan of five hundred and forty thousand pounds (£540,000), to be
known as “Waterworks Extension Loan, 1943” (hereinafter called
“the said loan”):
And whereas by Order in Council made on the twenty-third
day of February, one thousand nine hundred and forty-four, the
determinations aforesaid were varied in respect of a portion of the
said loan amounting to one hundred thousand pounds (£100,000),
and it is expedient to vary certain of the determinations aforesaid
in respect of a further portion of the said loan amounting to two
hundred and sixty thousand pounds (£260,000) (hereinafter called
“the said sum”), to be known as “Waterworks Extension Loan,
1943, £540,000 (issue of £260,000)”:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred on
him by section eleven of the Local Government Loans Board Act,
1926, as set out in section twenty-nine of the Finance Act, 1932
(No. 2), and of all other powers and authorities enabling him in
this behalf, doth hereby vary certain of the determinations aforesaid
in respect of the said sum by prescribing as follows:
(1) In lieu of a term of thirty (30) years, as specified in clause
one of the said Order in Council, the term for which the said sum
or any part thereof may be raised shall not exceed twenty-five (25)
years.
(2) In lieu of a rate of interest not exceeding three pounds
ten shillings (£3 10s.) per centum per annum, as specified in clause
two of the said Order in Council, the rate of interest that may be
paid in respect of the said sum or any part thereof shall be such
as shall not produce to the lender or lenders a rate exceeding three
pounds five shillings (£3 5s.) per centum per annum.
(3) In lieu of making provision for the payment of the said
sum by establishing a sinking fund in respect thereof, as specified
in clause three of the said Order in Council, the said local authority
may raise the said sum or any portion thereof upon terms of
making the same, together with interest thereon, repayable by
equal aggregate annual or half-yearly instalments extending over
the term of twenty-five (25) years, as specified in clause one hereof.

WHEREAS by Order in Council made on the nineteenth day of
May, one thousand nine hundred and forty-three (hereinafter
called “the said Order in Council”), and subject to the deter-
minations as to borrowing and repayment therein set out, consent
was given to the raising in New Zealand by the Auckland City Council
(hereinafter called “the said local authority”) of a loan of one
hundred and seventy-one thousand eight hundred pounds (£171,800)
(hereinafter called “the said loan”), being the balance of a loan of
two hundred and twenty-one thousand eight hundred pounds
(£221,800), known as “Waterworks Development Loan, 1940”:
And whereas by Order in Council made on the first day of March,
one thousand nine hundred and forty-four, the determinations
aforesaid were varied in respect of a portion of the said loan amounting
to twenty thousand pounds (£20,000), and it is expedient to vary
certain of the determinations aforesaid in respect of a further portion
of the said loan amounting to fifty thousand pounds (£50,000)
(hereinafter called “the said sum”), to be known as “Waterworks
Development Loan, 1940 (issue of £50,000)”:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, and in pursuance and
exercise of the powers and authorities conferred on him by section
eleven of the Local Government Loans Board Act, 1926, as set out
in section twenty-nine of the Finance Act, 1932 (No. 2), and of all
other powers and authorities enabling him in this behalf, doth hereby
vary certain of the determinations aforesaid in respect of the said
sum by prescribing as follows:

In pursuance and exercise of the powers and authorities conferred
by section forty of the Public Reserves, Domains, and National
Parks Act, 1928, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
declare that from and after the eleventh day of October, one
thousand nine hundred and forty-four, the public domains described
in the Schedules hereto shall be united to form one public domain,
to be known as the Kaiteriteri Domain.
FIRST SCHEDULE
KAITERITERI DOMAIN.—NELSON LAND DISTRICT
All those areas containing by admeasurement 53 acres 3 roods
27·4 perches more or less, and described as follows:
All that area containing by admeasurement 42 acres 3 roods
34 perches, more or less, being part Lot 1 (D.P. 2789), part of Sec-
tion 16, Square 9, and Lot 2 (D.P. 2789), part of Section 31, Block XII,
Kaiteriteri Survey District, and being all the land comprised in
Certificate of Title, Volume 83, folio 57 (Nelson Registry).
